No. 50{3-41- Gary and Joanna Campo. Property Location: 650 Three Waters Lane, Orient Parcel 15.-6-24 BASIS OF APPEAL: The Building Department's Notice of Disapproval dated January 31, 2002 denying a permit to construction addition and alterations to existing single family dwelling construction (B.P. #27955-Z issued 12/10/01) on a non-conforming lot, for the reason that the new construction not permitted pursuant to Article XXIV, Section 100-244B, which requires a minimum rear yard setback of 35 feet on parcels that measure less than 20,000 square feet in total size. AREA VARIANCE REQUESTED: The applicant is requesting a setback variance for the construction of a new balcony and deck addition, at 24 feet from the rear property line. Findings The Zoning Board of Appeals held a public hearing on this application on April 18, 2002, at which time written and oral evidence was presented. Based upon all testimony, documentation, personal inspection of the property and the area, and other evidence, the Zoning Board finds the following facts to be true and relevant. PROPERTY FACTS: The subject property is a non-conforming lot on which a new single family home is being constructed. The lot is shown as Lot 11 on the subdivision map of Orient-By-the- Sea. The subject property is 100 x 125 feet in size according to a survey done by Harold F. Tranchon. Jr. on June 5, 2001, amended 7-10-01. The property is located in a R-40 Zone. REASONS FOR THE BOARD ACTION: Based on the testimony and personal' inspection, the Board makes the following findings: 1. Grant of the variance will not produce an undesirable character in the neighborhood or a detriment to nearby properties. The variance involves the construction of a balcony and deck in the rear yard. The applicant is restricted because of the non-conforming lot. s 2. Benefits sought by the applicant cannot be achieved be achieved by some other feasible means other than an area variance. The lot is only 12,500 square feet and his proposed addition will be 24 feet from the rear yard property line instead of the required 35 feet. 3. The variance is not substantial because the lot is the same size as the other lots in the neighborhood and would not present'a problem for the neighbors. 4. The difficulty was self- created when the applicant bought a non-conforming lot. 5. The variance granted will not have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district. Granting of the requested variance is the minimum necessary for the applicant to enjoy a balcony and deck, while preserving and protecting the character of the neighborhood and the health, safety, and welfare of the community. REASONS FOR BOARD ACTION: In considering all of the above factors, and applying the /` balancing test under New York Town Law, the following Resolution was adopted: On motion by Member Oliva, seconded by Chairman Goehringer, it was RESOLVED, to GRANT the setback variance for a balcony at 32 feet from the rear lot line and deck addition at 24 feet from the rear lot line, SUBJECT to the condition that the deck shall remain open to the sky, as proposed. This action does not authorize or condone any current or future use, setback or other feature of the subject property that violates the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. When picking up the sign, a $15 check will be requested for each metal stand as a deposit (if needed). There is no cost for a poster without a stand. Please post the Town's official poster/sign no later than April 11th. Securely place the sign on your property facing the street, no more than 10 feet from the front property line bordering the street. (If you border more than one street or roadway, an extra sign is available for the additional front yard.) The sign(s) must remain in place for at least seven (7) days, and should remain posted through the day of the hearing. If you need a replacement sign, please contact us. By April 16th, please either fax or deliver to our office your Affidavit of Mailing (form enclosed) with parcel numbers noted for each, and return it with the white receipts postmarked by the Post Office. The original Affidavit is due not later than the date of the hearing. Also, when the green signature cards are returned to you by the Post Office, please mail or deliver them to us before the hearing, if possible. If any signature card is not returned, please advise the Board at the hearing. These will be kept in the permanent record as proof of all Notices. 'By April 18th, and after the signs have been in place for seven (7) days, please submit your signed Affidavit of Posting to our office.
