No. 5094— DONALD BUSKARD Location of Property: 2705 Gillette Drive, East Marion Parcel #38.-3-21.1 (18 and 21 combined as one lot) DATE OF PUBLIC HEARING: April 18, 2002 BASIS OF APPEAL Building Department's Notice of Disapproval February 1, 2002, denying an application for a permit to build an accessory swimming pool, proposed in a yard area other than a rear yard. AREA VARIANCE REQUESTED: The applicant is requesting a location of a proposed accessory in-ground swimming pool structure in the easterly front yard, with minimum setbacks of 40 feet (or greater) from the front line along East Gillette Drive, a minimum of 25 feet from the southerly lot line, and 51+- feet from the northerly lot line. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on April 18, 2002 at which time written and oral evidence was presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: PROPERTY FACTS/DESCRIPTION: The applicant's property is a 20,400 sq. ft. parcel located on the easterly side of Gillette Drive (and the west side of East Gillette Drive) in East Marion. The lot has 115 ft. road frontage and lot depth along the southerly side of 179+- feet. The property is improved with an existing two-story and one- story frame house and 1-1/2 story frame accessory garage. REASONS FOR BOARD ACTION, DESCRIBED BELOW: Based on the testimony and record before the Board and personal inspection, the Board makes the following findings: 1. Grant of the area variance will produce an undesirable change in character of neighborhood or a detriment to nearby properties. The front yard location of the pool as planned meets and exceeds that required for a principal building, or that required for accessory structures when located in a " rear yard" area. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for applicant to pursue, other than an area variance. No. 5094—Donald Buskard `�' 38.-3-21.1 at East Marion exceeds the setbacks required for a principal structure or accessory structure, and is appropriately planned. 3. The requested area variance is unique, due to the fact that there are two front yards and two side yards, as mentioned above. Under the definitions of the Code, there is no defined rear yard to locate a building or structure without a variance. 4. There is no evidence that the grant of the variance will have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district. As stated in paragraph 1 above, this accessory pool will have no impact on the continuity of the neighborhood. The property has no technical "rear yard." RESOLUTION/ACTION: On motion by Member Orlando, seconded by Chairman Goehringer, it was RESOLVED, to APPROVE the variance, as applied for. This action does not authorize or condone any current or future use, setback or other features of the subject property that violates the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action.
