No. 5060 - RUTH ANN BRAMSON 1000-31-14-4.5 SITE LOCATION: 12042 MAIN ROAD, EAST MARION BASIS OF APPEAL: Building Department Notice of Disapproval dated December 7, 2001 denying a permit for the proposed alterations and additions because there is a proposed study in the dwelling above the 2-1/2 story height limitation of Code Section 100-32. AREA VARIANCE REQUESTED: Applicant requests a variance for a study room above the first floor living room, with stairs leading to the study room from the second floor of the dwelling, as shown on the September 2000 Plans prepared by Peter E. Bullis, Architect. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on February 21, 2002, at which time written and oral evidence was presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: PROPERTY FACTS: The subject property contains 21,835 sq. ft. with frontage on a private right-of-way that extends to Main Road (State Route 25) in East Marion. The lot is improved with a two-story single family residence currently being renovated and accessory garage as shown on the November 3, 1999, last amended August 30, 2001, survey prepared by Joseph A. Ingegno, L.S. REASONS FOR BOARD ACTION: In accordance with the review standards set forth in Town law 267-b 3 "Area Variances", the board has considered the benefit to the applicant if the variance is granted, as weighed against the detriment to the health, safety and welfare of the neighborhood and community by such grant, and determines that: 1. Grant of the area variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The variance is for approval of a study room with stairway access from the second floor to the study and attic level under the roof. The overall exterior appearance of the residence will not be out-of-place because the total height of the dwelling is 31 ft., within the Town Code's 35-ft. maximum height limit. Only a small part of the so-called third floor would be used as a study, the remainder of the floor is attic and storage space under the roof. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. Because the study area has been deemed to be a third floor by the Building Inspector, a variance is required for its approval. • Page 2—February 28, 2002 ' ' Appl. No. 5060—R. Bramson 1000-31-14-4.5 at East Marion 3. The variance granted herein is not substantial and represents authorization for a study room with stairway access from the second floor. The 31 ft. total height of the dwelling is below the Town Code's 35 ft. height limit. 4. The alleged difficulty has been self-created. 5. The variance granted will not have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district. No evidence has been submitted to suggest that the variance will have an adverse impact on physical or environmental conditions in the neighborhood. 6. Grant of the requested variance is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a study room while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. BOARD RESOLUTION: In considering all of the above factors, and applying the balancing test under New York Town Law, motion was offered by Member Tortora, seconded by Member Oliva, and duly carried, to GRANT a Variance for a study room with stairway as shown on the September 2000 Plans prepared by Peter E. Bullis, Architect, SUBJECT TO THE CONDITION that the study room shall not at any time, now or in the future, be used for sleeping purposes. This action does not authorize or condone any current or future use, setback or other feature of the subject property that violates the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. Bullis, Architect. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on February 21, 2002, at which time written and oral evidence was presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: PROPERTY FACTS: The subject property contains 21,835 sq. ft. with frontage on a private right-of-way that extends to Main Road (State Route 25) in East Marion. The lot is improved with a two-story single family residence currently being renovated and accessory garage as shown on the November 3, 1999, last amended August 30, 2001, survey prepared by Joseph A. Ingegno, L.S. REASONS FOR BOARD ACTION: In accordance with the review standards set forth in Town law 267-b 3 "Area Variances", the board has considered the benefit to the applicant if the variance is granted, as weighed against the detriment to the health, safety and welfare of the neighborhood and community by such grant, and determines that: 1. Grant of the area variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The variance is for approval of a study room with stairway access from the second floor to the study and attic level under the roof. The overall exterior appearance of the residence will not be out-of-place because the total height of the dwelling is 31 ft., within the Town Code's 35-ft. maximum height limit. Only a small part of the so-called third floor would be used as a study, the remainder of the floor is attic and storage space under the roof. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. Bullis 1 , '3 • 128 Front Street Marblehead, MA 01945 •1 *'"•�' Re: RUTH ANN & ROBERT BRAMSON SCTM#31-14-4 .5 Dear Mr. Bullis: The following action was taken-by the Board of Town Trustees during its regular meeting held on October 25, 2000 regarding the above matter: WHEREAS, Peter F. Bullis on behalf of RUTH ANN & ROBERT BRAMSON applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated October 5, 2000, and WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on October 25, 2000 at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standard set forth in Chapter 97 of the Southold Town Code, r 411WHEREAS, the Board has determined that the projectas proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees approve the application of RUTH ANT & ROBERT BRAMSON for the complete renovation of the existing house including a porch addition to the south and one-•story additions to the east and north, with the condition that there be hay bales during construction on the top of the bank and that there be no change in the existing grade. BE IT FURTHER RESOLVED that this determination should not be considered a determination made for any other Department or Agency which may also have an application pending for the same or similar project. The lot is improved with a two-story frame cottage and accessory garage as shown on the November 3, 1999 survey prepared by Joseph A. Ingegno. The existing cottage is shown at 63 feet at its closest point to the wood bulkhead. BASIS OF APPLICATION: Building Inspector's February 29, 2000 Notice of Disapproval citing Article XXIII, Section 100-234B, sic (100-239.4B) of the Zoning Code with respect to a proposed 56.5 (4--) ft. setback from the bulkhead for a new addition. Article XXIII, Section 100-239.4B requires a minimum of 75 feet for new building area when a degree of nonconformity is increased or expanded. AREA VARIANCE RELIEF REQUESTED: Applicant requests a Variance for an expansion of the existing cottage for a porch addition at a minimum of 56 feet to the bulkhead (at its closest point). The setback from the bulkhead increases in a westerly direction along the proposed angle of the addition. REASONS FOR BOARD ACTION. DESCRIBED BELOW: Based on the testimony and record before the Board and personal inspection, the Board makes the following findings: - 1. Grant of the area variance will produce an undesirable change in'character of neighborhood or a detriment to nearby properties. The proposed porch addition would extend approximately eight (8) feet seaward from a small cottage located on a well-vegetated bluff, which is landward of the bulkhead. The porch would not be visible to nearby residences, nor was any evidence presented to suggest that it would adversely impact nearby properties. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for applicant to pursue, other than an area variance because the applicant wishes to enjoy the waterfront vista of this property and no otheraltemative location provides a reasonable opportunity for this benefit. 3. The requested area variance is not substantial and represents a 19-foot reduction in the code required 75 ft. minimum setback to the wooden bulkhead, and an eight-foot increase in the preexisting 63-ft. setback. 4.
