Location of Property: 375 Wampum Way, Nunnekoma Waters Lots 3 and 4 Parcel #87.-2-37 &38 (one lot combined). BASIS OF APPEAL: Building Inspector's Notice of Disapproval dated January 25, 2002, denying a permit for alterations and additions to an existing single-family dwelling because the new construction would have a 42.8 ft. front yard setback instead of the code-required 50 ft minimum, pursuant to Article XXIV, Section 100-244B. AREA VARIANCE REQUESTED: Applicant wishes to construct a 15' by 18' two-story addition with a front yard`setback of 42'8" at its closest point, and a deck addition with a front yard set back of 44'8" instead of the code-required 50 fit. minimum. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on April 18, 2002 at which time written and oral evidence was presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: 1. PROPERTY FACTS: The subject property is 40,500 sq.ft with frontage along Wampum Way and frontage on Corey Creek on the south and east property lines. The property is improved with a two-story dwelling with a wooden deck and greenhouse, all as shown on the site plan prepared by Samuels & Steelman, R.A. dated January 24, 2002. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted, the board make the following findings: 1. Grant of the area variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood is primarily developed with single-family residences, some which maintain the old subdivision front yard setbacks of 40 ft. The variance granted herein will not interfere with the view or privacy of adjacent property owners, nor will the proposed addition and deck appear out-of- keeping with nearby properties. / .i Page 2—April 18, 2002 �� Appl. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue,other than an area variances Applicants property is constrained by wetlands on the south and east side An east side location which would also require a rear yard variance. The proposed location is the most compatible one for both the environment and nearby properties. 3. The variance granted herein is not substantial and represents a 7'4" reduction for the addition, and a 5'4" reduction for the deck, in the code-required 50' minimum front yard setback. 4. The alleged difficulty has been self-created and is due the applicants' desire to enlarge and expand the dwelling. 5. The variance granted will not have an adverse effector impact on the physical or environmental conditions in the neighborhood or district. No evidence has been submitted to suggest that the variance will have an adverse impact on physical or environmental conditions in the neighborhood. 6. Grant of the requested variance is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an addition and deck while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Tortora seconded by Member Oliva, and duly carried, to: GRANT the Variance as applied for. This action does not authorize or condone any current or future use, setback or other feature of the subject property that violates the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. An undesirable change will not be produced in the CHARACTER of the neighborhood or a detriment to nearby properties if granted, because:' A variance is requested for a proposed addition that encroaches on the front yard setback by.7'-4". The proposed deck encroaches by 5'- 4". The proposed addition will not produce an undesirable change because the existing neighborhood is a mix of architectural types that have been built over the last 40 years. Several older homes do not respect the current front yard setback of 50' The proposed variance will not be detrimental to nearby properties because the the proposed addition is located away from any adjacent properties. The adjacent property to the north currently has it's view blocked by the existing house. The additional 7'-4" into the front yard would not block their view any more that the house already does. 2. The benefit sought by the applicant cannot be achieved by some method feasible for the applicant to pursue, other that an area variance, because: An alternative location for the proposed addition was considered at the existing greenhouse on the east side of the house. An as-built variance was requested for that greenhouse and at the public hearing (Nov. 15, 2001) the neighbor to the east expressed concern that a second flooraddition to the greenhouse would block her view. Respecting her concern, the proposed addition was located to the west along the street edge: 3. The amount of relief requested',is not substantial because: The existing lot width is 135' and according to the Bulk Schedule the minimum width of a lot within the R-40 zone is 150. The 50' rear and front yard setbacks required, allows for a building envelope of 35'wide. If the property was wider and met the minimum width of 150' a variance would not be required. The amount of relief is not substantial because half the proposed addition falls within the current setback and only 7T-4" falls within the front yard setback.. • 4. The variance will NOT have an adverse effect or impact on the physical environmental conditions in the neighborhood or district because: The property fronts on Corey Creek on the south and east property lines. The existing greenhouse is 22'from the existing wetlands. Adding to the east of the house and behind the existing greenhouse would locate the addition very close to the existing wetlands. The property is improved with a single-family, two story frame dwelling with a wooden deck and the "as buiIt" shed and..greenhouse all as shown on the survey prepared by Joseph A. ingegrio, L.S. dated May 7, 2001. BASIS OF APPEAL: Article IIIA,;•1Section-1.0Q-30A of the Zoning Code, based on the Building Inspector's Notice of;Disapproval dated Septe'inber 4, 2001 for the reason that the "as built" greenhouse and "frame shed addition to drivelling do not meet the minimum 50 ft. rear yard setback requirement. The request•indicates that the shed is 47.3'from its closest point to the rear lot line and the greenhouse is 29.4 feet at:its'closest point to the rear lot line. RELIEF' REQUESTED: A,rear yard,jsetback at 29.4 feet for the glass greenhouse and 47.3 ft. for the shed, both attached at the rear of the dwelling. REASONS FOR BOARD ACTION, DESCRIBED BELOW: 1. Grant of the area variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The "as built" greenhouse and shed addition existed in their current location since 1976 with no adverse impacts to the surrounding area. Since the applicant plans•;to continue the use of the addition as a "greenhouse only," and has agreed to such condition, no change will result from this variance. 2. The benefit sought cannot be achieved by some method, feasible for the applicant to pursue other than an area variance. Both the greenhouse and shed were constructed pursuant to Building Permit #8920-Z, issued 19/15/76, which was approved with a rear yard setback of ten (10) feet. The greenhouse and shed were constructed at a distance 29.4 feet from the rear property line, however, the prior owner did not obtain a Certificate of Occupancy for the structure.
