BATUELLO 1000-109-1-24.3 STREET& LOCATION: 1725 Alvah's Lane, Cutchogue DATE OF PUBLIC HEARING: January 10, 2002 PROPERTY FACTS: The subject property is a parcel of 167,967 ,sq. ft, in Cutchogue, with 528 ft frontage along the west side of Alvah's Lane, Cutchogue. The property is improved with a single-family dwelling and several accessory (nonhabitable) buildings. BASIS OF APPEAL: Article III, Section 100-33, based on the Building Department's Notice of.Disapproval dated November 7, 2001,denying a permit for additions and alterations to the existing house because: (1) the proposed construction will result in a side yard designation for the existing accessory buildings; (2) the proposed construction will be less than the code requirement of 75 feet for a minimum rear yard setback. AREA VARIANCE RELIEF REQUESTED: Applicants request variances authorizing setbacks noted in the November 7, 2001 Notice of Disapproval. The setbacks are proposed at 25 feet from the rear property line, and several accessory buildings will be located in a side yard area due to the proposed location of the new additions. FINDINGS OF FACT: The Zoning Board of Appeals held public hearings on this matter on January 10, 2002, at which time written and oral evidence were presented. Based upon all testimony, documentation, person observations of members of the board and other evidence, the Zoning Board finds the following facts to be true and relevant: 1: Applicants own a large 167,967 sq. ft. lot that is currently occupied by a two-story, single family residence, set back approximately 196 feet from Alvah's Lane. There are five existing accessory buildings on this former farm lot, all of which are in a conforming rear yard location. 2. Applicant's problem arises because he wishes to construct a new addition, and theexisting residence would connect via a breezeway to the existing accessory barn, which barn is being converted to a habitable "playroom" addition, thereby creating one principal building/single-family dwelling. In proposing this action, other existing accessory structures will no longer Page 2-January 10,2002 ZBA Appl.No.5048—C.and R.Batuello Parcel 1000-109-1-24.3 at Cutchogue be located in the permitted rear yard area, but instead the side yard of the new connected dwelling, and the accessory barn with an existing setback of 25 feet, would become part of the principal building and require a setback of 75 feet. 3. In discussing this variance request with the applicant, board members expressed particular concern that the breezeway be enclosed, connecting the new addition to the former barn, and be designed to conform with both town and state building codes. That is because the applicants altered the site plan on December 26, 2001, after the November 7,2001 Notice of Disapproval was issued. The public hearing on applicant's requests was held January 10, 2002. 4. By way of testimony offered during the January 10th hearing, and by letter dated January 10, 2002, to the Board of Appeals and to the Southold Town Building Department, the applicants submitted a revised site plan identified as "sketch Z-3", dated January 10, 2002, prepared by Paul Gugilotta Associates, Architects- Engineers. Applicants agreed that the enclosed breezeway connection, connecting the new addition to the existing barn, would be constructed to meet town and state requirements for the converted use (accessory to habitable playroom). IN ACCORDANCE WITH THE REVIEW STANDARDS SET FORTH IN TOWN LAW 267-B 3 "AREA VARIANCES", THE BOARD HAS CONSIDERED THE BENEFIT TO THE APPLICANT IF THE VARIANCE IS GRANTED, AS WEIGHED AGAINST THE DETRIMENT TO THE HEALTH, SAFETY AND WELFARE OF THE NEIGHBORHOOD AND COMMUNITY BY SUCH GRANT, AND DETERMINES THAT: - 1. Grant of the area variances to permit the existing accessory structures to remain in the newly-created side yard, and to permit the existing. barn/future "playroom" to retain its 25-foot rear yard setback converted will not produce an undesirable change in the character of the neighborhood or be a detriment to nearby properties. The structures have existed on the 3.8-acre site for many years with no ill effects to surrounding properties. The rear yard area of the variance request is adjacent to a vineyard, and the proposed alterations will not be visible from Alvah's Lane or to nearby residences. 2. The existing structures, therefore, become nonconforming and no other relief is available except a variance. 3. The requested variance is not substantial because it merely authorizes the existing accessory structures to remain in their current location, and permits an existing barn/future "playroom" to remain its rear yard setback. 4. No evidence was presented to suggest that the proposed changes would be an adverse effect or impact on the physical or environmental conditions in the neighborhood. 5. Grant of the requested variances is the minimum action necessary to enable the applicants to enjoy the benefits of an accessory in- ground swimming pool and accessory shed while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. 6.
