No. 5082— PAUL AHLERS. Property Location: 1905 Gull Pond Lane, Greenport Parcel: 35-4-16 BASIS OF APPLICATION: Building Inspector's January 8, 2002 Notice of Disapproval, updated April 9, 2002, for thereason that applicants plan to locate an accessory storage building with a setback is less than five feet from the side property line and less than 40 feet from the front property line AREA VARIANCE REQUESTED: Applicant was disapproved in his building,permit application to the Building Department to construct a 12'x 16' accessory storage building at 29.3+- feet from the west line and 3.4+-feet from the south line, at its closest points. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on April 18, 2002, at which time written and oral evidence was presented. Based upon all testimony, documentation, personal inspection of the property and the area, and other evidence, the Zoning Board finds the following facts to be true and relevant. PROPERTY DESCRIPTION: The applicant's property is located on the northeast side of Gull Pond Lane in Greenport. The property is shown as Lot 1 on the Map of Fordham Acres (1962), and is improved with a one-story house with garage and accessory pool structure, as shown on the survey prepared by David H. Fox June 1, 2001, amended July 2, 2001 for the applicants. REASONS FOR BOARD ACTION, DESCRIBED BELOW: Based on the testimony and record before the Board and personal inspection, the Board makes the following findings: 1. Grant of the area variance will produce an undesirable change in character of neighborhood or a detriment to nearby properties. The above-mentioned variance will have no significant impact on the neighborhood. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for applicant to pursue, other than an area variance. Do to the location of the existing house, flood zone and wet land in the rear yard; the suggested location is the logical location. 3. The requested area variance is minimum. The 1' 8" variance to the 3"4" set back is minor. There is no evidence that the grant of the variance will have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district. There are several evergreen trees surrounding this area. 2). Resolution was offered by Mx, Gillispie, seconded by Mr. Bergen* and carried*_ WHEREAS application of Robert Preston having been considered at Public Hearing No. 302 on August 18,, 1960, and the Board finding that strict application of the Ordinance would produce undue hardship because applicant cannot secure a building permit without approval of access over this roadway which has been cut in and settled and is in good usable condition, The situation is unique and would not be shared by all properties alike in the immediate vicinity of this property because other than the adjoin- ing lot this is the only other lot to be developed in this area at the present time. The Chairman opened the hearing by reading notice of disapproval issued by the building inspector, application for a variance, legal notice of hearing and affidavit attesting to its publication in the official newspaper. THE CHAIRMAN: We went down there and took pictures which will substantially correct the application. (The Chairman described the pictures.) The houses are well back from the road and it is a Town highway and down there they regard the water as the front yard. The error which seems to be made is that the owner regards the legal front yard as the back yard and wishes to place the accessory garage in the front yard, The back yard defined in the Ordinance would be on the water side.
