No. 4883 — MARI SHEA STREET & LOCATION: 1350 Smith Road, Peconic 1000-98-3-25 DATE OF PUBLIC HEARING: November 16, 2000 FINDINGS OF FACT PROPERTY FACTS/DESCRIPTION: The applicant's property is located on the west side of a Smith Road (a private road) in Peconic. The property contains a lot area of 36,000+- sq. ft. with 200 ft. road frontage. Existing is a one-story frame dwelling, accessory garage and swimming pool located in the rear yard. The front wall of the house is 38 feet from the property line; a stoop, about six ft. wide, extends out 5-1/2 feet from the front wall. BASIS OF APPLICATION: Building Inspector's September 11, 2000 (corrected November 13, 2000) Notice of Disapproval, denying a permit to expand the house because the proposed addition would be less than the Code requirement at Section 100-244B) for a minimum 40 ft. setback from the front property line. AREA VARIANCE RELIEF REQUESTED: Applicant's original application for a building permit proposed a five-foot front porch, eight feet deep and running the entire width of the house, with a second-story deck. Applicant requests a variance authorizing a front yard setback of 30 feet to accommodate an eight-ft. porch as amended. REASONS FOR BOARD ACTION: Based on the testimony and record before the Board and personal inspection, the Board make the following findings: (1) Because the existing house is less than 40 feet from the front property line, any addition at the front requires a variance. Applicant's plan for expansion of the house includes a front porch as an integral element. (2) Applicant proposes a major expansion of the house, adding a second story and a full-width front porch with deck above. The change from a one-story house set back 38 feet from the front property line, to a two-story house set back 30 feet, would be substantial. Concern for the visual impact on the street and neighborhood leads the Board to conclude that a greater setback is need in order to avoid an undesirable change in the character of the neighborhood or detriment to nearby properties. Dear Mr. Goerhringer: 1 am writing to express our concerns about this appeal,which is scheduled for hearing at 6:55 p.m. this evening, We axe very reluctant to oppose the application of a neighbor,but believe that the special circumstances of this application would make granting it a bad idea. We own a house at the end of the Smith Road,at the bay. We spend substantial time there at all times of year. Smith Road,which is referred to as "The Lane"by its residents, is a very narrow private road. The houses on 'The Lane",much of the way to where it meets Indian Neck Road, constitute one of the earliest bayside communities in Southold Town. Our house dates from around World War I, and the other houses in the community were built not long afterwards. Although some of them have had some modifications over the years, the houses on"The Lane" constitute a harmonious architectural grouping,entirely evocative of its era. The applicant's house,with its existing setback of only 38 feet, appears already to be as close to the road as any other house,and closer than most. We are concerned that an addition across the front of the house bringing it only 30 feet from the road would be a substantial visual intrusion on the appearance of our historically significant community.
