No. 4775 - DERITH SUTHERLAND 1000-88-3-19 STREET& LOCALITY: 1230 Waters Edge Way, Southold DATE OF PUBLIC HEARING: January 13, 2000 FINDINGS OF FACT PROPERTY FACTS/DESCRIPTION: The subject property is shown as the "Myles Lot" on the Map of Bay Haven at Southold filed January 22, 1959 as Map No. 2910 in the Office of the Suffolk County Clerk. The lot consists of 17,150 sq. ft. with 107.61 ft. frontage along Gin Lane and 160.07 ft. along Watersedge Way. The lot is improved with a one-story frame dwelling with attached garage. The dwelling was built many years ago (40 years plus) and is set back approximately 37.5 feet from the front property line and the 10' front deck reduces the front setback to approximately 27.5 feet BASIS OF APPLICATION: Building Inspector's November 5, 1999 Notice of Disapproval which states that under Section 100-244 of the Zoning Code, a minimum front yard setback is required at 35 feet and the applicant's deck creates a setback of 27'7". AREA VARIANCE RELIEF REQUESTED: Applicant requests a variance for a 10' deck at the. front of the dwelling, leaving a front yard setback of 27.5 feet facing Watersedge Way. REASONS FOR BOARD ACTION, DESCRIBED BELOW: Based on the testimony presented, materials submitted and personal inspection, the Board makes the following findings: (1) Applicant purchased the property in 1996. The 10 ft. by 24 ft. deck was added in 1998, without a building permit. Applicant now seeks a building permit and certificate of occupancy for the deck. Because the house is 37.5 feet from the front property line, and the Code requires a 35-ft. setback, applicant needs a variance in order to have any sort of deck on the front of the house, which is the side with the sunny southern exposure and water view. (2) The deck is modest in design and does not stand out noticeably from the house. The house is the last one on the northerly side of Watersedge Way, and has no immediate neighbor to either the east or west. For these reasons, grant of the requested variance will not produce an undesirable change in the character of the neighborhood or detriment to nearby properties. (3) There is no evidence that grant of the requested variance will have an adverse effect or impact on physical or environmental conditions. (4) Grant of the requested variance is the minimum necessary and adequate to enable applicant to enjoy the benefit of a deck located on the southerly, waterview side of the house, while preserving and protecting the character of the neighborhood, and the health, safety, welfare of the Page 2 -January 19, 2000 ZBA Appl. Southold Town A^Ird of Appeals d — December 11* 1969 The Chairman opened the hearing by reading the appliostiom for a special exception* legal notice of hearing* affidavit attesting to its publication in the official newspaper* and notice to the applicant A letter addressed to the Town Clerk* from Mr. Downs* dated March 31* 1964* inquiring liabout front yard setback,, and Mr. Terry's reply of April 1* 1964* contained in file was read. A letter from the Bay Haven Property Owners Association protestisi the Dawns use of their home as a 2 family dwelling was road. Upon receipt of this complaint an inspection of the premises was made by Building Inspector George Fisher. A copy of this report and a letter' notifying the Downs of their violation was sent to them. A letter was also sent to the president of the Bay Haven Property Owners Assoc. informing them of the action taken. THE CI AIRk3N: is there anyone present who wishes to speak for this application? MRS. DSS: I think I have stated the reason for it* and this is the only reason. we have never solicitated rental on it. As a matter of fact* some of the members of the association asked us if we would rent it to their friends and relatives. I think the reason the comply was made was because we did not rent it to them and we do not belong t their association. HOWARD TERRY: The Downs are not part of the subdivision. There are 3 parcels in this area which are not part of the subdivisions Sops Downs* and Pospisil. These 3 houses were under construction at the time the subdivision map was filed, The outline of the Bay Haven sub- division map goes around these lots. They are described property* the are not part of the subdivisions although they do have their access on the same street. MR. HULSE. In what year were these houses built? HOWARD TURP: Mr. Myles original building permit # 614 Z was • issued on March 24*, 1959* and its O.O. #4 513 on Feb. 23* 1960. This was for a- single family dwelling 24' x 36' and a 12' x 20' garage on the westerly end. TETE CHAIRMAN: Somewhere along the line* before he sold it to Mr. & Mrs. Downs What was the original owners .kame? HOWARD TERRY: Charles & Mary Jane Myles. HOWARD TERRY: Yea, that's right. The house was ordginally built with a one car garage. Then on June 2, 1961 he applied for another permit for a garage addition, when this was completed we issued C.O. # 1075Z, dated July 20, 1961 for a one family dwelling. MR. HULSE: Well, sometime after that he must have added this apartment. HOWARD TERRY: Sometime after the C.O. was issued and before the Downs bought the property, somebody converted what was the old garage into an apartment. MR. DOWNS: When the new garage was built, the old one was converted into this apartment. HOWARD TERRY: When we issued the C.O. that was just an enclose( room, it was not an apartment. So sometime after the C.O. was issue( and before the Downs bought the property, somebody went in there and set that apartment up, we don't know did it. THE CHAIRMAN: What is the size of the lot? HOWARD TERRY: 105' x 160' THE CHAIRMAN: This apartment is rented now? MRS. DOWNS: Tes, there is a young single Baan in theme. THE CHA1RM411s well, you have an illegal use. MRS. DOWNS: Yea, we realise that now. THE CHAIRMAN: There is no way that I know of that.the Board can give any relief. I can give you considerable history on our experience with this type of thing. BERGEN: We did this provided that they had enough open area for 2 building lots, 25,000 sq. ft. of area. • THE CHAIRMAN: I am talking about even prior to that. We had a case in Orient on Skippers Lane. It was a large house with about 14 rooms but the lot was not very large. The man that bought it thought that he would do a lot of the work himself. He was going to convert it into a 2 family house. His boother-ins-law would use the up-stairs and he would use the down-stairs. When the hearing was held all the people in the area protested it. We granted the appeal and they took it to the Supreme Court and to the Appelate Division of New York, both of which upheld our decision. But when they carried it on to the Court of Appeals in Albany our decision was reversed. Incidently, this is the only case that I can recall that our decision was ever reversed. Shortly after this, there was an amendment made to the Zoning Ordinance which permitted this Board, in its discretion, using a whole page of regulations, to grant 2 family occ.ipancy on property where there is 25,000 sq. ft, of area or the equivalent of 2 building lots. So there is no way we can help you. The fact that you did not know that this house was an illegal use when you bought it is irrelevant. As far as the hardship your mother would suffer from loss of income, the Board is not permitted to consider financial hardship, as a legal hardship. The reason stated in your application is not a valid reason for appeal. MR. DOWNS: Well, what about Giordano? THE CHAIRMAN: The Bay Haven Property Owners Association has made a complaint about him too. It is being checked out.
