RYALL, JR. 1000-13-3-5.2 STREET & LOCALITY: 915 Sound View Drive, Orient DATE OF PUBLIC HEARING: September 14, 2000 FINDINGS OF FACT PROPERTY FACTS/DESCRIPTION: The subject property is an unimproved lot situated on South View Drive in Orient, with 120 feet of road frontage and a total area of 20,955 sq. ft. BASIS OF APPEAL: Building Inspector's Notice of Disapproval, dated July 24, 2000, denying a permit to build a house on the property for the reason that the setback from the property line on South View Drive would be 25 feet, whereas Code Section 100-244B requires 40 feet. RELIEF REQUESTED: Applicant requests a variance authorizing placement of the house as, proposed, with a 25-foot setback from the northwest property line along South View Drive. REASONS FOR BOARD ACTION, DESCRIBED BELOW: On the basis of testimony presented, materials submitted and personal inspection, the Board makes the following findings: (1) Applicant's property slopes down substantially from the road, having an elevation of about 78 feet at the northwesterly property line and about 56 feet at the southwesterly line. Applicant testified that the building envelope allowable under the Code would require construction on the steepest part of the land, and that the proposed location of the house —which requires a variance - is the most rational in light of the land contours. (2) South View Drive is a private road mapped at 50 feet wide, but the paved roadway is scarcely 10 feet wide and the proposed house is about 52 feet from that pavement although only 25 feet from the edge of the mapped road. The paved roadway is little traveled, is owned by a property owners association, and is unlikely ever to be widened. For these reasons, grant of the requested variance will not produce an undesirable change in the character of the neighborhood or detriment to nearby properties. (3) There is no evidence that grant of the requested variance will have an adverse effect or impact on physical or environmental conditions. (4) The action set forth below is the minimum necessary and adequate to enable applicant to build a house in the most rational location on the property while preserving and protecting the , • t Page 2- September 14, 2000 ZBA Appl.
