No. 4873— PETER and MEREDITH P. RUGG PARCEL: 6-3-8.2 STREET& LOCALITY: Munnatawket Avenue, Fishers Island DATE OF PUBLIC HEARING: November 16, 2000 FINDINGS OF FACT PROPERTY FACTS/DESCRIPTION: The subject property is a vacant parcel of 85,640+- sq. ft. , measuring 312.91 feet along Munnatawket Avenue on the southwest, as shown on the survey map prepared by Chandler, Palmer & King dated May 12, 2000, revised 11/6/00. A right-of-way exists over the northerly property line, extending from Munnatawket Avenue to Lot #1A on the "Minor Subdivision Plan — Property of Edith Dillon Edson, Central Avenue, Fishers Island, New York" dated December 11, 1992, additions and revisions to July 26, 1995." The applicant's parcel is referred to as Lot #2 on this Edson Minor Subdivision Plan. BASIS OF APPEAL: The Building Inspector issued a Notice of Disapproval on September 13, 2000, stating that the application for a building permit is disapproved on the following grounds: (a) an accessory building is proposed in a front yard location, and (b) a garage addition is proposed with a front yard setback at less than 60 feet from the edge of right-of-way. RELIEF REQUESTED BY APPLICANT: By a preliminary site plan map dated May 12, 2000, updated 11/6/00, received 11/14/00, applicant proposes to locate: (1) an accessory boat storage building at 50 feet from Munnatawket Avenue (southwest property line), 45 feet from the northerly (Oakes) property line, and 20 feet from the inside edge of the northerly right-of-way, and: (2) a garage addition at 105+- feet from the north property line (along Oakes to the north) and 44 feet from an existing right-of-way line is also proposed at the north end of a proposed three-bedroom residence. REASONS FOR BOARD ACTION and RESOLUTION/ACTION: On the basis of the testimony presented and personal inspection, the Board made the following findings: 1. (a) The granting of the area variance to locate an accessory building in a front yard area will not produce an undesirable change in the character of the neighborhood or be a detriment to nearby properties. This accessory building will be a minimum of 50 feet from the edge of the street (Munnatawket Avenue). An evergreen hedgerow will be planted along this side of the building to screen it from the street view. (b) The granting of the area variance to locate a garage addition with a reduced distance to the edge of the private right-of-way, will not produce an undesirable change in the character of the neighborhood or be a detriment to nearby properties. This building will have one front yard setback of 155+- feet from Munnatawket Avenue, and the other yard setback will be 44+- feet the edge of the unpaved portion of a dead-end private road as the proposed access to the applicants' driveway. The applicant will share the right-of-way with two (2) immediate residences. The ZBA finds that the proposed setbacks from this right-of-way are the minimum necessary and adequate, given the dead end nature and private status of the right-of-way, after considering the Interpretation under a similar Appl. No. 4836 (Koch) concerning front yard setbacks from streets. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue other than area variances. Rugg 1000-6-3-8.2 (Fishers Island) • southern slope, preventing placement of the garage addition (principal building) any farther from the right- of-way. Also, the sloping terrain of the property also prevents the placement of the proposed accessory building in a required rear yard area. 3. The requested area variances are substantial. The proposed placement of the accessory building is within a front yard area, rather than a code-required rear yard location. With regard to the garage addition to the dwelling (principal building), the closest setback to the private right-of-way is only 44 feet at its closest point. 4. The proposed variances will not have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district. The addition to the dwelling and one accessory building in this residential district will not alter the character of the residential neighborhood. 5. The situation has not been self-created. RESOLUTION: On motion by Member Horning, seconded by Member Tortora, it was RESOLVED, to GRANT alternative relief for an accessory storage building in a front yard location, and to GRANT the location of the proposed addition to the existing dwelling, subject to the following Conditions: 1. The proposed accessory building will be located at a minimum distance from Munnatawket Avenue of 50 feet and at a minimum of 15 feet from the private right-of-way to the north at its closest point. 2. Proposed accessory building will be shielded from direct view of Munnatawket Avenue by the planting of an evergreen hedgerow adjacent to, and the full length of that side of the building facing the street. 3. Proposed accessory building shall conform to all other provisions of the Town of Southold relating to accessory buildings and accessory uses. Munnatawket Avenue to Mrs . Edson' s property which affects my clients' property. In deed dated November 28, 1966 at Liber 6080 page 376 the Fishers Island Utility Company, Inc . conveys to Edith Gibb Dillon (now known as Edith Edson) and her late husband Thomas P. Dillon parcels #1, 2 and 3 , Parcel #1 was conveyed "subject to the rights of others for use as a roadway over a strip of land 25 . 00 feet in width extending Northeasterly from said Munnatawket Road with a turnaround having a radius of 40 . 00 feet at the Northeasterly end thereof, the center line of said right of way being bounded and described as follows : . . . " The three parcels were separately conveyed and the access to the property was specifically described as a "roadway" from Munnatawket Road to the parcel . The deeds described a private road. Thereafter Mrs . Edson obtained subdivision approval from the Southold Town Planning Board for a minor subdivision and filed the map in the Office of the Suffolk County Clerk on September 19, 1995 as Map No. 9741 . The Planning Board approved the subdivision with the existing private road as access to lot 1 and 2 . Moreover, the Planning Board approved building envelopes facing the private road. (See attached copy of relevant portion of subdivision map) Lot 2 of said subdivision was conveyed to Mr. and Mrs . Rugg by deed dated October . 8, 1997 at liber 11858 page 765 . The lot is again conveyed "subject to the right of way for ingress, egress and utilities over a strip of land 25 feet in width extending northeasterly from said Munnatawket Avenue with a turnaround having a radius of 40 . 00 feet at the Northeasterly end thereof, the center line of said right of way being bounded and described as follows : " The private road was again described in the deed to Mr. and Mrs . Rugg. In reliance on advice given to their attorney by the Building Department, Mr. and Mrs . Rugg have treated this private road as a "street" from which a "front yard" set back must be maintained. In accordance with the Town Code definition of "Street" , (Section 100-13) the "street" was "improved to the satisfaction of the Planning Board" and was " (2) shown on a map approved in the final subdivision plat" of Mrs . Edson' s minor subdivision. The Building Department correctly determined the private road to be a "street" . Mr. and Mrs . Rugg have designed their house with access off of the private road. Enclosed for your information is a letter written by Stephen Ham Esq. to Edward Forrester regarding the question of whether this property is considered a corner lot and whether the building department determines the side and rear lot lines . The building inspector reviewed the subdivision map and owner' s preliminary site plan and determined that the setbacks are measured from the private road and that this parcel is a corner lot . This was confirmed in his notice of disapproval . We respectfully request that you uphold the building inspector' s determination that the private road is a "street" and grant the requested front yard setback variance. If the private road is not deemed to be a "street" then the position of the house would require a rear yard setback variance, a result that would be a hardship to my clients with substantial additional expense and delay their construction schedule . Rugg relating to property on Fishers Island designated on the Suffolk County Tax Map as District 1000, Section 6, Block 3, Lot 8.2. (The property is also known as Lot 2 on the Minor Subdivision of Edith Dillon Edson.) As you can see, a number of variances would be needed before a building permit could be issued for the structures shown on this plan. In performing this balancing test, the Zoning Board is charged with the responsibility to consider the five factors enumerated in Town Law Section 267b-3 (b) . The variance should be granted for the following reasons : L. No undesirable change will - be produced in the character of the neighborhood or a detriment to nearby properties, if the variance is granted. The attached Garage is setback 44 ' from Right of Way/subdivision road rather than the required 60 ' feet . This property is lot 2 in a three lot subdivision. The house to the east, on lot 1, is the original house prior to the subdivision and is owned by Mrs . Edson. Only one other house, on Lot 3 , is to be developed and the access to lot 3 is off of Central Avenue. The Right of way provides access to the applicant, Mrs . Edson (lot 1) and a prior adjacent property owner, Mrs . Oakes . The proposed house is set back, away from the neighboring property. The garage is needed for the applicant' s private car collection. The property is sloped and the house is designed with the preservation of slopes and topography. The applicant wishes to minimize the cleared area, the building envelope is within the cleared area. The Accessory Building- is intended to be used to store the applicant' s boats off season rather than storage in the open in the same area on trailers . The boat house will be built into the hill and will be screened from view by the hill and shrubbery. Site plan shows the design of the boat house and how it is to be shielded from view. This property has no rear yard because of the topography of the property, the rear yard slopes r down into a land depression and wetlands . The Town Code states that boats on trailers are to be stored in the rear yard (100-31 (7) (b) stored in rear yard and ( c) 15 feet from the street or property line) . Without a boat house to store the boats in a building the owner could be in violation of the zoning code because he has no rear yard and the property is too sloped for practical storage of his boats anywhere other than where it is proposed. The neighbors favor construction of a boat house in the proposed location. 2 . The benefit sought by the applicant can not be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant requires garage space for five vehicles- one ' garage is under the house (2 bays) from the side entrance and the second garage area is on the first floor elevation facing west . The applicant has made use of all reasonable possibilities for the location of the garage. 3 . The - area variance is not substantial The application of the balancing test weighs in favor of the grant of the variance. While the setback of the garage is 44 feet from the edge of the 25 ' right-of-way. The setback from the improved access is actually 12 feet greater. Total setback of structure from the used right-of-way is 56 ' . The setback requirements are 60 feet because of the large lot size, however, the only usable area of the property is the front yard because of the slope of the property. The location of the house and garage is preferred by the neighbors because it is less visible and less intrusive towards their property line. (Letters in support-Mrs . The variance will have no adverse effect or impact on the physical or environmental conditions in ' the neighborhood or district . The house and boat house are being constructed in such a way as to benefit from the existing topographic features . The accessory structure will be tucked into the hill and the garage is facing the right-of-way in order to minimize changing the grade of the property. 5 . The alleged difficulty was not self-created. r ' The existing conditions of the property create the difficulty in that there exists a 35 ' change in elevation from the lowest to the highest slope and is constrained by a wetland setback in the rear. The house is designed with all of the environmental restrictions in mind and with the hopes of preserving the existing conditions . 6 . The variance requested is the minimum variance practicable given the personal benefits anticipated by the applicant . The house is placed towards the right- of-way and built at the crest of the natural slope, the boat house is proposed at the bottom of the slope and into the hill, the only alternative location for the boat house would be on Munnatawket Avenue- this is not desirable because it is a public street with more traffic activity than the right-of-way and boats backing _into a boat house may interfere with traffic flow, and a variance would still be required. The boat house could not be tucked into the hill, as is proposed by the applicant, and would be visible to the community. Meskouris ("Meskouris"). The Meskouris property is a vacant parcel of 24,808.8 sq. ft., measuring 102 feet on Summit Drive on the south, 100 feet along the northerly property line, 236.7 feet on the west side and 252 feet on the east. The easterly property line lies on the midline of a 15-foot right-of- way, and a 25-foot right-of-way lies across the northerly part of the property, entirely within the northerly property line. BASIS OF APPEAL: Appellants are appealing a Notice of Disapproval, dated June 9, 2000, issued by the Building Inspector to Meskouris, denying a building permit for a proposed house on the subject property as follows: "Proposed construction on nonconforming lot not permitted pursuant to Article XXIV Section 100-244B which requires a minimum front yard setback of 40 feet, subject lot has a right of way across property on easterly boundary creating front yard on that frontage. Setback on that frontage proposed at +1- 12 1/2 (twelve and one half) feet from boundary of right of way, 20 (twenty) feet from property line." RELIEF REQUESTED: The appeal claims that the Building Inspector failed to fully identify the proposed project's noncompliance with the Code's setback requirements. The appeal: (1) Claims that the northerly yard is not a front yard, and asks this Board to interpret the Code section 100-13 definition of"Yard, Front." (2) Claims that the Building Inspector incorrectly applied Code section 100-230A to authorize the proposed northerly setback, and asks this Board to interpret Code section 100-230A. Exceptions and Modifications. A. Established front yard setback. Where property in the vicinity is improved with principal buildings with front yards of less than that required by the provisions of this chapter, the front yard setback shall be the average setback of the existing buildings within 300 feet of the proposed building on the same side of the street within the same use district. REASONS FOR BOARD RESOLUTION SET FORTH BELOW: On the basis of testimony presented and materials submitted, the Board makes the following findings: (1) The Notice of Disapproval, and the testimony of the Head of the Building Department at the hearing on July 6, 2000, indicate that the Building Department considers the easterly and northerly yards on the subject property to be front yards because each faces a right-of-way. The Board disagrees. The Code definition of "Yard, Front," set forth above, makes no reference to a right-of-way. It defines a front yard in terms of a "street," and the Code definition of "Street," set forth above, makes no reference to a right-of-way. The rights-of-way on the subject property do not meet the Code definition of "Street." Thus, the easterly and northerly yards are not front yards. (2) The Head of the Building Department testified at the hearing on July 6, 2000 that the northerly setback of the house immediately west of the subject property is 51.2 feet from the property line and 26.2 feet from a right-of-way across that property shown on a survey by Young & Young dated October 7, 1983. The Building Inspector concluded that under Code Section 100-230A, the setback of that house could be used to determine the required northerly setback on the subject property, with the result that the proposed setback was found in compliance with the Code. The Board disagrees. The setback exception in Code section 100-230A, set forth above, requires more than one neighboring building: it refers to the presence of "principal buildings with front yards of less than that required" by the Code. Section 100-230A cannot be applied to determine the setback of a proposed building when there is only one improved property "within 300 feet ... on the same side of the street." Moreover, as stated above, this Board has determined that the northerly yard of the subject property is not a front yard. Therefore, Code Section 100-230A would not apply in any event, because it is expressly limited to front yard setbacks. (3) The Head of the Building Department stated in a memo of June 9, 2000 to this Board that "the Department has, as past practice, been measuring the yard requirements from right of ways by using the property boundary as a point of reference. It has been determined that pursuant to the definition of "right-of-way lines" in Section 100-13 of Southold Town [Code], that this measurement must be taken from the boundary of the right of way." The Board agrees with this conclusion.
