No. 4785 -ANTHONY PIRRERA 1000-15-3-17 STREET& LOCALITY: 1525 Soundview Road, Orient DATE OF PUBLIC HEARING: March 2, 2000 FINDINGS OF FACT PROPERTY FACTS/DESCRIPTION: The subject property (referred to herein as Lot 17) is a vacant waterfront parcel on the north side of Soundview Road in Orient. A survey by Roderick VanTuyl, P.C. dated March 4, 1985 shows an area of 24,216 sq. ft. The dimensions of the property are 100 feet wide by 246 feet deep on the west and 239 feet on the east. The lot adjoining, immediately to the west referred to as Lot 16, has approximately the same measurements and is improved with a single-family dwelling. BASIS OF APPLICATION: Building Inspector's January 18, 2000 Notice of Disapproval which states only that under Section 100-25A "the subject parcel has merged with an adjoining parcel SCTM #1000-15-3-16." RELIEF REQUESTED: Applicant requests a Waiver of Merger pursuant to Article II, Section 100- 26 for Lot 17. REASONS FOR BOARD ACTION, DESCRIBED BELOW: On the basis of testimony presented, materials submitted and personal inspection, the Board makes the following findings: 1. Julius and Rose Giarraputo, husband and wife, purchased Lot 17 in 1967, and held it as tenants by the entirety. Upon the husband's death in 1973, Rose Giarraputo became the sole owner of Lot 17; she sold it to the applicant in May 1985. Rose Giarraputo had purchased Lot 16 in 1960 and held it solely in her name until 1987, when part ownership was transferred to family members. Both nonconforming lots merged pursuant to Code Section 100-25A as the result of sole ownership by Rose Giarraputo from July 1, 983 to May 1985. 2. Applicant purchased Lot 17 in May 1985 in the belief that it was separate and buildable. It appears that at the time of purchase, no thought was given to the possibility of merger of Lots 17 and 16. 3. Lot 17 is visually a separate property and not an integral part of Lot 16. 4. Waiver of the merger will not result in a significant increase in the density of the neighborhood because it will result at most in the construction of only one single-family home. 5. Lot 17 and the nearby lots on both sides of Soundview Road were all created in the same subdivision (Orient-By-The Sea, Section I filed 1957). Pirrera Re: 1000-15-3-17 substantially the same size as Lot 17, while the lots on the south side are smaller. Waiver will recognize a lot that is consistent with properties in the neighborhood and will recognize the established lines of Lot 17. 6. If merger is not waived, applicant will own an unbuildable soundfront property of no use to him for which he paid $135,000 in 1985. Waiver will avoid this economic hardship. 7. Lot 17 is generally flat, and construction on it should require no significant change in the natural details, character, and contours of the land. The Board notes that the lot is located on the Long Island Sound bluff, and that construction will be subject to applicable setback requirements. RESOLUTION/ACTION: On motion by Member Collins, seconded by Member Tortora, it was RESOLVED, to GRANT the waiver applied for. APPLICANT'S REASON#1 The subject property was owned by Rose and Julius Giarraputo, as tenants by the entirety, from 1967 until it was sold to me in 1985. Mr. Giarraputo died in 1973 survived by his wife. Under the Town's Zoning provisions, in 1973 the property merged to the adjacent parcel owned by Mrs. Giarraputo. The properties were held in separate ownership and conveyed to me and to others as if they had retained their separate status. From the Assessor's property card records it appears that Mrs. Giarraputo conveyed her parcel in 1987 to her son and then the property was conveyed again in 1998 to others. I purchased the property for$135,000.00 and obtained a mortgage for$100,000.00. The merger was never considered and a single and separate search would not have revealed the merger because the deed remained in both Rose and Julius Giarraputo.. No probate proceeding is required for the sale of a property held by husband and wife. APPLICANT'S REASON#2 I am under contract to sell the property which I have owned since 1985, paid real estate taxes as a Long Island Sound Front developable parcel, and at the time I purchased the property I fully expected to build on this parcel. The price I paid for this parcel was the fair market value for a buildable parcel. APPLICANT'S REASON#3 Even though the Town had been up-zoned to two acre, in 1985 the Town of Southold maintained an exempt subdivision list which the building department recognized for issuance of building permits. DATE OF PUBLIC HEARING: March 2, 2000 ' " - FINDINGS OF FACT , PROPERTY FACTS/DESCRIPTION: The subject property (referred to herein-as Lot 17) is a _ - - vacant waterfront parcel,on the north side of Soundview Road in Orient. A survey,by Roderick VanTuyl, P.C. dated March 4, 1985 shows an area of 24,216 sq. ft. The dimensions of the property are 100 feet wide by 246 feet deep on the west and 239 feet on the east. The lot adjoining, immediately to the west referred to. as Lot '16, has 'approximately the same_ , measurements and is improved with a single-family dwelling. r . - ' BASIS OF APPLICATION: Building Inspector's January 18, 2000 Notice of Disapproval which states only that under Section 100-25A "the subject parcel has merged with an adjoining parcel SCTM#1000-15-3-16." ' RELIEF REQUESTED: `Applicant requests a Waiver of Merger pursuant to Article II, Section 100- 26 for, Lot 17. - • ' REASONS FOR BOARD ACTION, DESCRIBED BELOW: On the basis of testimony presented, materials submitted and personal inspection, the Board makes the following findings: r 1. Julius and Rose Giarraputo, husband and wife, purchased Lot 17 in 1967, and held it as tenants i .by the entirety. Upon the husband's death in 1973, Rose Giarraputo became the sole owner of Lot j 17; she sold it to the applicant in May 1985. Rose Giarraputo had purchased Lot 16 in 1960 and held it solely in her name until 1987, when part ownership was transferred to family members. . Both nonconforming lots merged pursuant to Code Section 100-25A as the result of sole ownership by Rose Giarraputo from July 1, 983 to May 1985. 2. Applicant purchased Lot 17 in May 1985'in the belief that it was separate and buildable. It appears that at the time of purchase, no thought was given to'the possibility of merger of Lots 17, ' and 16. , .� 3. Lot 17 is visually a separate property and not an integral part of Lot 16. . 4. Waiver of the merger will not result in a significant increase in the density of the neighborhood .because it will result at,most in the construction of only one single-family home. . 5. Lot 17 and the nearby lots on both sides of Soundview Road were all created in the same subdivision (Orient-By-The Sea, Section I filed 1957). Waiver will recognize a lot that is consistentwith properties in the neighborhood and will recognize the established lines of Lot 17. 6. If merger is not waived, applicant will own an unbuildable soundfront property of no use to him for which he paid $135,000 in 1985. Waiver will avoid this economic hardship. 7. Lot 17 is generally flat, and construction on it should require no significant change in the natural details, character, and contours of the land: The Board notes that the lot is located on the Long . Island Sound bluff, and that construction will be subject to applicable setback requirements. Dear Board Members; We am currently the purchasers of the property across the street from the lot you have before you for tiRabd iVisiOf. When my wife and I were shown our lot in April of 1999, we were informed that the lot had an unobstructed view of the Sound. The property in question was part of the adjoining lot. I now know that has changed. In February of 2000, a variance hearing was held in the Health Department on our lot. This was because the 150 feet separation needed for shallow wells was not met due to the small size properties in the aebdivasaon. During the hearing it was said that there is a serious water problem in the area and because the tots across the street (north) and next door (west) were empty that our variance would be considered, After three weeks we was informed that the variance was granted. I do not wish to cause any undo problems for anyone but when people are given authority over future safety, health and well being of others, they should be informed of all that has transpired with regard to other persons, properties and agencies in surroudiug lots.
