No. 4891 —JAMES MILLER PARCEL 121-1-1.11 STREET & LOCALITY: 2100 Arbor Lane, Mattituck DATE OF PUBLIC HEARING: November 16, 2000 FINDINGS OF FACT PROPERTY FACTS/DESCRIPTION: Applicant's property is located along the south side of Arbor Lane at a cul-de-sac, Mattituck northerly side of Sound Avenue, Mattituck. A June 29, 1998 survey map shows that the yard area to the north of the existing dwelling is proposed as the fence enclosure/paddock area for the owner's horses. BASIS OF APPEAL: Article XXIII, Section 100-231 based on the Building Inspector's October 4, 2000 Notice of Disapproval for the reason that the paddock fence height is proposed greater than four (4) feet high in the front yard area. AREA VARIANCE RELIEF REQUESTED BY APPLICANT: Paddock fence at a height of five (5) feet high located in the front yard area. (The barn shown on the map submitted with this appeal application is not proposed by applicant at this time and was not processed as part of the appeal.) REASONS FOR BOARD ACTION, DESCRIBED BELOW: (1) The grant of the area variance will not produce an undesirable change in character of neighborhood or a detriment to nearby properties there are paddocks in nearby areas with fences of similar height. (2) The benefit sought by the applicant cannot be achieved by some method, feasible for applicant to pursue, other than an area variance. The location of the dwelling as exists with a front yard setback greater than 240 feet creates a very front yard, which is desirable on a parcel of five (5) acres. (3) The requested area variance is not substantial. (4) The proposed fence will not have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district and is necessary at a height of five (5) feet to be effective as an enclosed paddock for horses. In considering this application, the Board deems the grant of a fence at five feet in height, instead of four feet, as the minimum necessary and adequate, and at the same time preserves and protects the character of the neighborhood, and the health, safety, welfare of the community. e 4 Page 2- 11/16/00 Appl.
