No. 4881 — GINA MAXWELL STREET & LOCATION: 170 Orchard Street, Orient 1000-25-3-3.1 DATE OF PUBLIC HEARING: November 16, 2000 FINDINGS OF FACT PROPERTY FACTS: Applicant's property is a roughly rectangular lot on Orchard Street in Orient, with 89 feet of road frontage, depth of 94 feet, and a total area of 8460 sq. ft. It is improved with a two-story frame building that was formerly the Orient firehouse and is now applicant's home, and a small shed. BASIS OF APPEAL: Building Inspector's Notice of Disapproval, dated September 11, 2000, denying a permit to add a deck and fencing because (1) lot coverage already exceeds the 20% allowed under Code section 100-244B (2) the fence would be higher than the 6-1/2 feet allowed under Code section 100-231B. AREA VARIANCE RELIEF REQUESTED: Applicant requests a variance authorizing construction of the deck as proposed, bringing lot coverage to 34.4%, and the fence as proposed. REASONS FOR BOARD ACTION, DESCRIBED BELOW: On the basis of testimony presented, materials submitted and personal inspection, the Board makes the following findings: (1) Applicant's lot is small, as is common in Orient. The principal structure covers 31.02% of the lot and the shed covers 1.13%, for a total of 32.15%. The limit set by Code Section 100- 244B is 20%, so any addition requires a variance. (2) The new deck on the east side of the principal structure extends only six feet from the building wall and is 32 feet long. It adds 2.27% to lot coverage, for a total of 34.4%. Applicant proposes to erect wooden columns along the edge of the deck, each connected to the house by a horizontal beam at the top of the column to create a pergola on which vines will be grown. (3) Applicant proposes to erect wooden columns 8-1/2 feet high along the easterly property line. These columns would be connected to each other at the top, and the space between the columns would be filled with wood lattice fencing measuring six feet from the ground. The Board considers this structure, taken as a whole, to be a fence 8-1/2 feet high. Code section 100-231B sets a limit of 6-1/2 feet. (4) Several columns of the sort described in paragraph (3) already exist on a neighbor's land close to the property line at the southeast corner of applicant's property. Applicant proposes to erect lattice fencing to a height of six feet above the ground along her property line close to such columns. Because the fencing and the columns would be physically separate, on separate lots in Page 2— December 7, 2000 ZBA Appl. No. 4881—G. Maxwell ' Parcel 1000-25-3-3.1 at Orient separate ownership, applicant's six-foot fencing would comply with Code section 100-231 B and not require a variance. (5) Even in the context of Orient village, where lot coverage tends to be dense, the proposed coverage on applicant's lot is very substantial. However, the principal structure is not a house but rather an institutional building converted to dwelling use, and its bulky physical presence has been part of the neighborhood for a very long time. Applicant's project is intended to improve the property's appearance, and the addition to lot coverage due to the deck is not great. The proposed pergola over the deck will not create the visual density that would result from a full addition of the same square footage as the deck. For these reasons, the increase in lot coverage requested by applicant will not produce an undesirable change in the character of the neighborhood or detriment to nearby properties. (6) There is no evidence that grant of the requested variance will have an adverse effect or impact on physical or environmental conditions. (7) The action set forth below is the minimum necessary and adequate to enable applicant to implement her plan while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION/ACTION: On motion by Member Tortora, seconded by Member Collins, it was RESOLVED, to GRANT the requested variance authorizing construction of the deck as proposed, resulting in lot coverage of 34.4%, and authorizing erection of columns 8-1/2 feet high on the easterly side of the property with wood lattice fencing between the columns to a height of six feet above the ground, as proposed, subject to the following CONDITIONS: (1) The horizontal beams extending from the building wall to the tops of the columns along the deck shall go no further, and the remaining easterly side yard shall remain entirely open to the sky; (2) No further increase in lot coverage shall be authorized on this property. Box 1179 Southold,New York 11971-0959 Dear Chairman Goehringer: This is in response to your notice concerning the forthcoming hearing on Thursday, November 16th at 7:30 p.m. (Appl. No. 4881 –Gina Maxwell). I own the home next door, directly to the east, and received notification of the hearing by certified mail. Since I am out of town at the current time, I am replying • by letter. As I understand it, there are two issues: (1) whether or not a variance should be granted to a property whose dwelling, stairs, decks and outbuildings already occupy more than 20% of the lot size; and (2) whether or not, if such a variance is granted, a fence will be permitted to be erected that is greater than 6.5 feet in height. As to the first issue, that is a matter for the board to decide. Clearly the main building occupies more than 20% of the lot. Moreover, the survey that accompanied the notice of this hearing fails to show an additional building— presumably a storage shed—which now stands on the western edge of the property, further adding to the excessive building-to-lot-size ratio. As to the second issue, I have some real concerns. Not only would the proposed fence, itself, reach a maximum of 8 feet in height, it would reach an additional 1.5 feet above the ground level of Ms. Maxwell's property if it were placed atop the stone wall graded border which now exists on the property's eastern side. -2- While I have no personal objection to anyone wanting to "privatize" his or her property, the height of this proposed fence, I believe, would far outreach what I've always been led to believe were guidelines for size in Orient's historic district. Additionally, one of the fine attributes of our small village is that "compound fencing" is virtually non-existent. In other words, while there may be trees and shrubs separating property lines, people don't build 8-foot walls around their properties. It destroys the natural property-to-property sightlines and openness within the village. I submit these views respectful of Ms. Maxwell's desire to enhance her own property as she sees fit. I would like The Board to know that Ms. Maxwell explained in detail what her intentions are for improving her property—especially regarding the fence which separates our two lots. Her design ideas and the sample fencing that she showed me were helpful in putting my concerns to rest. An open lattice fence which she indicated she intends to install would not have the closed look of a "stockade" but would allow for light and air circulation as well as some sense of visual openness, which would be in harmony with the surrounding area. This lot is known as the old Orient "fire house" and is improved with a 2-1/2 story frame building as shown on the March 19, 1991 survey prepared by Roderick VanTuyl, P.C. 3 . There will also be a stairway (approximately 48 sq. ft. ) at the westerly side of the dwelling. 4 4. The lot coverage for the building, as exists, .is approximately 25+- percent (2125 +- sq. ft. ) . The increased lot coverage over the existing for the new area and modified deck area is 500 sq. ft. (11 ft. by 41 ft. plus permitted stairway and overhang) which includes the existing deck area to be reconstructed. The total lot coverage, with the new construction, would be 30. 88 percent of the total lot area (2625+- sq. ft. ) . 5. It is the position of the Board in considering this application that: ( a) the circumstances are uniquely related to the property and there is no method feasible for appellant to pursue other than a variance - particularly since the size of the property is substantially smaller ( 80%) than the 40, 000 for conforming lots in an R-40 Zone District; (b) the relief is substantial in relation to the requirements; (c) the variance requested does not involve any increase of dwelling unit density; (d) the relief requested will not cause a substantial effect on available governmental facilities; 4 (e) the relief requested is not unreasonable due to the uniqueness of the property and the immediate area; (f) the variance will not in turn be adverse to the safety, health, welfare, comfort, convenience, or order of the town, or be adverse to neighboring properties since the modification is minimal and the extension is for an open deck. - Accordingly, on motion by Chairman Goehringer, seconded by Member Dinizio, it was RESOLVED, to GRANT relief under Appl.
