HEAD START CHILD DEVELOPMENT SERVICES, INC. Parcel: 1850 Main Bayview Road, Southold 1000-75-4-28 Zone District: R-80 Residential Date of Public Hearing: October 19, 2000 FINDINGS OF FACT PROPERTY FACTS/DESCRIPTION: Applicant-L.I. Head Start Child Development Services, Inc., is the proposed tenant of a building formerly occupied by The Church of the Open Door with school facility. The property contains five acres with access off the westerly side of Main Baview Road in Southold and is referred to as Lot 3 on the Minor Subdivision Map of Salvatore Catapano. The building and existing parking areas received approvals on April 14, 1986 from the Town for the former church facility and related uses. APPLICANT'S REQUEST/BASIS OF APPLICATION: The Applicant is requesting a Special Exception under Article III, Section 100-31, subsection B(4) of the Southold Town Zoning Code for a nursery school. The proposed Nursery School is proposed for 45 students on the lower level of the existing building, with the applicant returning to the Board for consideration of occupancy of the first floor. Details of the layout of the site, as exists, are more particularly shown on the Sheet A-1 of Plan dated April 12, 1989 prepared by Richard A. Keillor, R.A. All parking and screening will be determined by the Southold Town Planning Board as provided under the Zoning Code site plan regulations and/or approved site plan of record. STANDARDS/REASONS FOR BOARD ACTION: After review of the requirements set forth pursuant to Chapter 100, Article III, Section 100-31-B, governing a Nursery School Use by Special Exception review, and on the basis of testimony presented and personal inspection, the Board finds: 1. Nursery schools are permitted in this R80 Residential Zone District under Section 100-31B(T) of the Town Zoning Code, subject to special exception authorization of the Zoning Board of Appeals. In this review the Board determines that the proposed Nursery School Use is in harmony with the zoning ordinance and will not adversely affect the neighborhood if such requirements are met. 2. The proposed Nursery School complies with the lot size provisions of the Zoning Code. This building and facility will be located on five acres of land. In addition, the Board has reviewed the General Standards governing Special Exception uses set forth in Section 100-263 and finds that: Page 2 — Appl. No. SE-4880 ' L.I. Head Start Decision Rendered 10/19/00 A) This Nursery School will not prevent the orderly and reasonable in this Residential Zone District and adjacent districts. The adjacent property to the north is agricultural with sales of farm products. B) This use will not prevent orderly and reasonable use of permitted or legally established uses in the district wherein the proposed use is to be located or of permitted or legally established uses in adjacent use districts. C) The safety, health, welfare, comfort, convenience, and the order of the town will not be adversely affected by the proposed use and its location. The proposed expansion will allow the Nursery School to provide enhanced services that will benefit all of the community. D) The use will be in harmony with and will promote the general purposes and intent of the code. E) The use is compatible with its surroundings and with the character of the neighborhood and of the community in general, particularly with regarding to visibility, scale and overall appearance. F) The structures, equipment and material will be accessible for emergency protection. In making this determination, the Board has also reviewed other matters under Section 100-264, and finds that no adverse conditions will result from this authorization: A. There will be no adverse change in the character of the existing and probable development of uses in the district and the peculiar suitability of such district for the location of such permitted uses. B. Property values will be conserved. A Nursery School use is encouraged and allowed by Special Exception approval from the Board of Appeals. C. The location of the proposed Nursery School will not cause traffic congestion on public streets, highways and sidewalks. D. There is availability of adequate and proper public or private water supply and facilities for the treatment, removal or discharge of sewage, refuse or other effluent (whether liquid, solid, gaseous or otherwise) as a result of this use. E. The use or the materials incidental thereto will not give off obnoxious gases, odors, smoke or soot. • Page 3 —Appl. No. SE-4880 L.I. Head Start Decision Rendered 10/19/00 F. The use will not cause disturbing emissions of electrical discharges, dust, light, vibration or noise. G. The operation of a nursery school facility will not cause undue interference with the orderly enjoyment by the public of parking or of recreational facilities, existing or proposed by the town or by other competent governmental agencies. H. The necessity for bituminous-surfaced space for purposes of off-street parking of vehicles incidental to the use and whether such space is reasonably adequate and appropriate and can be furnished by the owner of the plot sought to be used within or adjacent to the plot wherein the use shall be located, and by approval of the Southold Town Planning Board under the site plan regulations. I. There is no evidence to show that there will be any hazard to life, limb or property because of fire, flood, erosion or panic by reason of or as a result of the use or by the building to be used, or by the accessibility of the property or structures thereon for the convenient entry and operation of fire and other emergency apparatus. There will not be undue concentration or assemblage of persons upon such plot in the normal activities of a library. J. The use and the building location will not cause an overcrowding of land or undue concentration of population. K. The plot area is sufficient, appropriate and adequate for this library use. L. The use to be operated is not unreasonably near to a church, school, theater, recreational area or other place of public assembly. M. The site is particularly suitable for a nursery school, which was formerly use as a church with its own school facilities. N. No evidence has been presented to show that there would be any detrimental impact to adjacent properties and land uses. O. Adequate provision has been made for the collection and disposal of storm-water runoff, sewage, refuse, solid, and liquid waste. There will be no gaseous waste generated from this project. P. The natural characteristics of the site are such that the proposed use may be introduced without undue disturbance or disruption of important natural features, systems or processes and without risk of pollution to groundwater and surface waters on and off the site. GOEHRINGER,CHAIRMAN SOUTHOLD TOWN BOARD OF APPEALS RE: APPLICATION NUMBER 4880 , SPECIAL REQUEST FOR NURSERY SCHOOL ACTIVITIES L.L HEAD START CHILD DEVELOPMENT SERVICES Dear Mr Goehrmger As you are aware,we attended last nights public hearing to'present the above referenced application Durmg the hearing, a discrepancy regarding the total proposed children occupancy was discussed and accordingly,we wish to clarify and revise the subject application The subject application stated that the Lower Level of the facility will have three (3) classrooms with a total child occupancy of 45 children (two (2) classrooms with 18 children each and one (1) 'classroom with nine (9) children) We wish to revise the total number of children at the Lower Level to 54 (three (3) classroom with 18 children each) The mam reason for the revision is that the Department of Social Services recently licensed the subject facility for a total capacity of 72 children The total is based on the facility providing classrooms on the Lower and Upper Levels As discussed, L I Head Start will be submitting Tenant Plans for the development of the Upper Level A S A P (Studio A is presently preparmg these_plans) The Upper Level is proposed to have one(1)classroom with a child occupancy of 18 In summary, please consider this a formal request to revise the Lower Level child occupancy from 45 to 54, Domg so will allow L I Head Start to provide day care/nursery services to the maximum number of children licensed by Department of Social Services -which will directly benefit the residents of the Town of Southold Thank you in advance for you consideration of this request Should you have any questions regarding the above,please do not hesitate to call me Very truly yours, Studio A Architectural Group,P.C. Premises, (iii) constitute a public or private nuisance, (iv) cause Tenant to default in any of its other obligations under this lease, or (v) violate any zoning or occupancy conditions imposed by any municipality or governmental regulations to be applicable to the Premises SECTION 6 REPAIRS AND MAINTENANCE: (A) Landlord represents that the electrical , plumbing 4 and mechanical systems will be in operating condition at the inception of the Lease term, and the roof free from leaks Thereafter, Tenant shall, at Tenant ' s expense, keep and maintain the Premises in good order, including but not limited to, all electrical , HVAC, plumbing and mechanical systems, and structural components of Lhe improvement to the Premises, and shall repair and replace, when necessary, all parts thereof (B) Tenant shall make all repairs necessary to preserve and maintain the exterior and structure of the Premises including the foundation, down spouts and gutters, if any and roof of the entire structure of the Premises and including all repairs and maintenance of water and sewer pipes serving the Premises Landlord shall either reimburse Tenant or credit Tenant against the next successive rent payments due hereunder for the amount by which any single structural repair exceeds the sum of $3000 00 (C) Tenant shall be solely responsible for the cost of maintaining the parking area (including snow removal) and for the cost of necessary patching thereof SECTION 7 COMPLIANCE WITH LAW: Tenant shall in the use and occupancy of the Premises conform to all laws , orders , and regulations of the Federa] , State, and Municipal governments, or any of their departments, and regulations of the New York Board of Fire Underwriters , applicable to the Premises SECTION 8 INTENTIONALLY OMITTED 5 SECTION 9 CONDEMNATION: (A) Total or Substantial Partial Condemnation If the whole of the Premises shall be taken for any public or any quasi-pub] ic use by any statute or by right of eminent domain, or by private purchase in lieu thereof (collectively the "Proceeding" ) , then this lease shall automatically terminate as of the date that title shall be taken If any part of the Premises shall be so taken as to render the remainder thereof unusable for the purposes for which the Premises were leased, then Landlord and Tenant shall each have the right to terminate this lease on thirty days notice to the other given within twenty days after the date of such taking In the event that this lease shall terminate or be terminated, the rental (s) shall, if and as necessary, be equitably adjusted (B) of Sale of the Premises which has been executed by the parties , all compensation awarded or paid upon a total or partial taking of the Premises shall belong to and be the Property of the Tenant SECTION 10 SUMS EXPENDED BY LANDLORD TO BE ADDITIONAL RENT In the event that the Landlord shall pay any sum of money, or do any act which shall require the expenditure of any sums by reason of the failure of the Tenant to perform any of the covenants , terms or conditions herein contained, the Tenant covenants to repay immediately such sums to the Landlord upon demand, and in default thereof the sums so paid by the Landlord, together with interest thereon may be added as additional rent to the fixed rent becoming due upon the next rent day, or any subsequent rent day and shall be payable as such Notwithstanding the foregoing, and except for emergencies, Landlord shall not expend any sum for which Tenant may be responsible under this Section, unless Landlord gives Tenant fifteen (15) days notice of Landlord' s intent to expend sums by reason of Tenant ' s failure of performance SECTION 11 INTENTIONALLY OMITTED SECTION 12 ENTIRE AGREEMENT• No oral statement or prior written matter lease, Landlord may, on reasonable notice to Tenant (except that no notice need be given in case of emergency) , cure such breach at the expense of Tenant and the reasonable amount of all expenses, (60) days after notice from Landlord discharge any mechanic ' s lien for materials or labor claimed to have been furnished to the Premises on Tenant ' s behalf , and Tenant shall hold harmless and indemnify Landlord against any expense incurred by Landlord in discharging mechanic ' s liens imposed for labor or materials furnished upon the authorization of , or for the benefit of Tenant SECTION 15 LANDLORD' S RIGHT TO INSPECT AND REPAIR: Landlord may, but shall not be obligated to, enter the Premises at any reasonable time, on reasonable notice, (given at least 24 hours in advance, during normal business hours) , to Tenant (except that no notice need be given in case of emergency) for the purposes of inspection or the making of such repairs, replacements, and additions in, to, on and about the Premises, as Landlord deems necessary Tenant shall nave no claim or cause of action against Landlord by reason 8 thereof In exercising the rights reserved to him hereunder, Landlord shall not interfere with Tenant ' s right to quiet enjoyment SECTION 16 ESTOPPEL CERTIFICATES: Tenant shall , without charge, at any time and from time, within ten days after requested by Landlord, certify by written instrument, duly executed, acknowledged and delivered, to Landlord, or any other person, firm or corporation specified by Landlord (A) that this lease is unmodified and in full force and effect, or, if there have been any modifications , that the same is in full force and effect as modified and stating the modifications, (B) whether or not there are then existing any set- offs or defenses against the enforcement of any of the agreements, terms , covenants or conditions hereof and any modification hereof upon the part of Tenant to be performed or complied with, and, if so, specifying the same, (C) the dates, if any, to which the base rent and additional rent and other charges hereunder have been paid in advance, (D) the date of expiration of the current term, (E) and the base rent then payable under this lease SECTION 17 SURRENDER OF PREMISES: On the last day or sooner termination of the demised term, Tenant shall quit and surrender the Premises broom-clean, in good condition and repair (reasonable wear and tear excepted) Tenant shall be permitted to remove all alterations, additions and improvements which may have been made in, on or to the Premises, and movable furniture or unattached 9 movable trade fixtures put in at the sole expense of Tenant Tenant shall , on or before the end of the demised term, remove from the Premises all its Property together with any unauthorized alterations, additions and improvements, the removal of which is requested by Landlord, and any or all of such Property not so removed shall , at Landlord' s option, become the exclusive Property of Landlord or be disposed of by the Landlord, at Tenant ' s cost and expense, without further notice to or demand upon Tenant If the Premises be not surrendered as and when aforesaid, Tenant shall indemnify Landlord against loss or liability resulting from the delay by Tenant in so surrendering the Premises including, without limitation, any claims made by any succeeding occupant founded on such delay Tenant ' s obligations under this section shall survive the expiration or sooner termination of the demised term SECTION 18 TENANT' S INSURANCE POLICIES: Immediately upon commencement , and throughout the term of this Lease, Tenant shall maintain in force and effect the following insurance coverage (a) Fire and standard extended coverage insurance, insuring the leased Premises for the benefit of Landlord and Tenant, in an aggregate amount which is not less than one hundred (100%) percent of the full replacement value thereof (b) a Policy or policies of comprehensive liability insurance, including public liability and Property damage, that will insure Tenant and Landlord against liability for claims of damage because of injury to persons or Property and for death of any person or persons occurring in or about the Premises, with a combined single limit coverage of not less than One Million Dollars PAYMENT AND OTHER TERMS. Tenant shall bear all costs of obtaining and maintaining the insurance described in this Section 10 The " full replacement value" of the Building and other improvements to be insured under subparagraph (a) hereof shall be determined by the company issuing the insurance policy All insurance required by this Article shall be written by one or more responsible insurance companies licensed to do business in the State of New York and shall provide that it shall not be subject to cancellation or change except after at least thirty (30) days ' prior written notice to Landlord The policy or policies, or duly executed certificates for them, shall be deposited with Landlord on or before the date when the Lease term commences and, upon renewal of such policies , not less than thirty (30) days ' prior to the expiration of the term of the coverage If Tenant fails to obtain the insurance for which Tenant is obligated hereunder, or if Tenant fails to present Landlord with evidence thereof, Landlord shall have the right to obtain the required insurance and be reimbursed for all costs thereof within thirty (30) days after presentment Tenant with a bill therefor The insurance required by this Section shall be primary insurance and the insurer shall be liable for the full amount of the loss up to and including the total limit of liability as set forth in the declaration, without the right of contribution for any other insurance coverage held by Landlord Both parties shall be named as coinsureds under the policies INDEMNIFICATION.
