FINDINGS OF FACT
PROPERTY FACTS: Applicant's property is a parcel of approximately 54 acres in
Mattituck, lying between Old Main Road on the north and Peconic Bay Boulevard on the
south. A survey by John Metzger, dated July 5, 2000, shows a garage and a barn
located about 225 feet from Old Main Road. A house formerly located between those
two buildings and Old Main Road was burned down by the Mattituck Fire Department in
a training exercise. The property is otherwise unimproved.
BASIS OF APPEAL: Building Inspector's Notice of Disapproval, dated July 6, 2000,
denying a permit to build a new house to the south of the two existing accessory
buildings because such location would result in the accessory buildings being in the front
yard. Code section 100-33 requires accessory buildings to be in the rear yard.
RELIEF REQUESTED: Applicant requests authorization to locate a new house in an
area proposed 275 feet south of Old Main Road.
REASONS FOR BOARD ACTION, DESCRIBED BELOW: On the basis of testimony
presented, materials submitted and personal inspection, the Board makes the following
findings:
(1) In order for the existing accessory buildings to be located in the rear yard, the
new principal dwelling would have to be located between them and Old Main Road.
Given the large size and character of the property, that would be an illogical and
unnatural location. Thus, applicant needs a variance in order to build in a reasonable
location.
(2) The proposed house is located 275 feet from Old Main Road. Given the size
and character of the property, this location — which results in the accessory buildings
being in the front yard - will not produce an undesirable change in the character of the
neighborhood or detriment to nearby properties.
(3) There is no evidence that grant of the requested variance will have an
adverse effect or impact on physical or environmental conditions.

(4) The action set forth below is the minimum necessary and adequate to enable
applicant to build a house in a reasonable location while preserving and protecting the
character of the neighborhood and the health, safety and welfare of the community.

RESOLVED, to GRANT the variance as requested.

NOTICE IS HEREBY GIVEN, pursuant to Section 267 of the Town Law and Chapter 100
(Zoning), Code of the Town of Southold, the following application will be held for public hearing by the
SOUTHOLD TOWN BOARD OF APPEALS at the Town Hall, 53095 Main Road, Southold, New York
11971, on THURSDAY, .AUGUST 10, 2000 at the time noted below (or as soon thereafter is
possible):
6:35 p.m. Appl. No. 4848 - SUSAN LOMANGINO. This is a request for a Variance under Article
j III, Section 100-33, based on the Building Department's July 6, 2000 Notice of Disapproval which
states that accessory buildings and structures shall be located in the required rear yard. The subject
parcel contains two existing accessory buildings, and the proposed project calls for movement and
construction of a principal dwelling to the south of these accessory structures placing them in the
(southerly) front yard. This property contains more than one front yard with frontage along Old Main
Road (House #1150) and along the north side of Peconic Bay Boulevard, Laurel, Town of Southold;
Parcel#1000-122-7-8.6 containing 60+- acres.
The Board of Appeals will at the above time and place hear all persons or their representative
desiring to be heard or to submit written statements (before this hearing is concluded). The hearing will not
start earlier than designated. Files are available for review during regular Town Hall business hours (8-4

Please find enclosed a copy of the Legal Notice describing your recent application. The Notice will be
published in the next issue of the Suffolk Times.
Pursuant to Chapter 58 of the Southold Town Code(copy enclosed),formal notice of your application
and hearingdate must now be mailed with a map or property sketch showing the new location of the area being .�
considered. &Friday,Juiy2lst,please send the enclosed Notice CERTIFIED MAIL, RETURN RECEIPT
REQUESTED,as soon as possible,with a copy of the project map to all owners of land(vacant or improved)
surrounding yours,including land across anystreet or right-of-way that borders your property. Use the current
addresses listed on the current assessment records in the Town Assessors' Office(765-1937)or the County Real
Property Office in Riverhead. If you know of another address for a neighbor,you may want to send the notice to
that address as well.
By Monday,✓uiy3fst, please complete your Affidavit of Mailing(copy enclosed)with parcel numbers
noted for each,and return it to us with the white receipts postmarked by the post office. Later,when the green
signature cards are returned to you by the Post Office,please mail or deliver them to us. If any signature card
is not returned,please advise the Board at the hearing.
A sign is also necessary for posting at the property by you notiaterthan Wednesday,812100,and
therefore must be picked up by you or your representative some time, between now and August 1st,between the
hours of 8 and 4 p.m. The sign must be located on the property no more than 10 feet from the front property line
