No. 4890—JAMES AND HELEN LECHMANSKI STREET & LOCATION: 2495 King Street, Orient 1000-26-2-45 DATE OF PUBLIC HEARING: November 16, 2000 FINDINGS OF FACT PROPERTY FACTS: Applicant's property comprises 11,812 sq. ft. on King St., Orient, with road frontage of 63 feet and depth of approximately 187 feet. It is improved with a frame house and a garage, having footprints of 642.75 sq. ft. and 254 sq. ft., respectively. BASIS OF APPEAL: Building Inspector's Notice of Disapproval, dated September 11, 2000, denying a permit to expand the house and the garage because the proposed construction would bring lot coverage to 22% whereas Code section 100-244B limits coverage to 20%. AREA VARIANCE RELIEF REQUESTED: Applicants request a variance authorizing expansion of the house and garage as proposed with lot coverage of 22.3%. REASONS FOR BOARD ACTION, DESCRIBED BELOW: On the basis of testimony presented, materials submitted and personal inspection, the Board makes the following findings: (1) Data noted on a survey by Anthony W. Lewandowski, dated July 24, 2000, indicate that the expanded house would cover 1757 sq. ft., or14.9% of the lot, and the expanded garage would cover 880 sq. ft., or 7.4%. Total lot coverage would be 22.3%. (2) Although applicants propose to expand the house substantially, its width viewed from King St. would not increase. The expanded garage, however, would be wider than the existing garage. Small lots are common in the area, as are accessory garages and barns. For these reasons, the increase in lot coverage authorized by the action set forth below will not produce an undesirable change in the character of the neighborhood or detriment to nearby properties. (3) The Board concludes that allowing applicants some relief from the 20% lot coverage limit, to give them somewhat greater flexibility, is not a substantial variance. (4) There is no evidence that the action set forth below will have an adverse effect or impact on physical or environmental conditions. (5) The action set forth below is the minimum action necessary and adequate to enable applicants to implement their expansion plan while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. JAMES AND HELEN LECHMANSKI Dear Charman Goehrmger, This office has been retained by Mr and Mrs Lechmanski to clarify and expand on information which was submitted at the public hearing held on Thursday November 16, 2000 The Lechmanskis are applying for an area vanance as the lot coverage for their proposed construction will exceed the 20 percent permitted under Southold Town Code Sec 100-244B First they have asked me to clarify Mr Lechmanski's response to your question concerning access to the west side of the garage for maintenance The proposed addition to the garage will be no closer to the western property line than the four and one half feet that the present garage is The side walls of the proposed garage will be twelve feet above grade It is perfectly safe and appropnate to place a ladder or pump jacks on a four and one half foot wide space to perform maintenance on a twelve foot high wall Please note that even with the proposed one foot overhang on the eaves, the garage will comply with the Setback requirements of Sec 100-33B (1) (See Photo 1 ) AREA VARIANCE The Lechmanskis are asking for permission to fully use their property for a use which is permitted by the Southold Town Code and to the same extent as neighboring lots are being used The Lechmanski parcel is m an R-80 zone The dimensions of the proposed addition to the garage and to the dwelling are dictated by the Lechmanski's hobbies and lifestyle The dwelling is expected to be their permanent year round home for their retirement It is only prudent to plan for a bedroom on the ground floor This IP Lechmanski -ZISA Appl#4890 p 2 necessitates a larger footprint for the dwelling than if there was no ground floor bedroom The Lechmanskis have two hobbies which mandate a garage of the proposed dimensions They enjoy boating and Mr Lechmanski has several classic cars which up until now have been garaged at their winter home in Nassau County The ZBA has been given documentation relating to the ownership of these vehicles For the Lechmanskis to forego either their hobbies or the practicality of a ground floor bedroom in order to comply with the 20% requirement of Sec 100-244B would be a great detriment to their plans to retire to a parcel of land they have owned and used as a summer residence since 1971 It is the Lechmanski's position that their proposed construction would have no detrimental impact on the health, safety and welfare of the community The character of the neighborhood is single family residential As noted above, the Lechmanski parcel is in an R-80 zone It is obviously substandard size - as are the seven nearest lots on the north side of King Street The lots to the South, across King Street, are in R-40 zoning and most of them are only 100 feet by 175 feet (The lot diagonally across to the west is 7 5 acres and there is an undeveloped farm field of approximately 14 acres directly to the north) All but maybe two of the lots in the immediate area have been built on (See Photos 7, 8 and 9 )Many have houses and separate accessory buildings located on them Many of these accessory buildings are of comparable size to the Lechmanski proposal, m that they were originally used as barns for the nearby farms and are now used to store boats and garage cars (See Photos 4, 5 and 6 ) Locating a year round residence and accessory garage on the Lechmanski parcel is in keeping with the character of the neighborhood The Lechmanskis have explored every possible alternative to avoid having to obtain a variance As I noted above, the size of the accessory garage and the footprint of the dwelling are dictated by the Lechmanski's lifestyle - which is not extravagant The Lechmanskis have contacted the owners of the 14 acre parcel to the north about the possibility of purchasing some land but have met with no success The Lechmanskis have no alternative but to ask for the variance There is no evidence that the proposed construction will create any adverse impact on the environment or on the physical condition of the land and the neighborhood There will be no increase in traffic nor in the intensity of the use of the land The buildings meet height and setback restrictions The variance which is being requested is not substantial Sec 100-244B places an upper limit of 20 percent coverage for all building area The Lechmanski lot is 11,812 square feet and the proposed construction is 2,637 square feet This represents 22 3 percent of the total area This means that the Lechmanskis are asking for a variance of 11 5 percent This is a minimal request If the Lechmanski's parcel was just slightly larger- say perhaps the size of lot to the west, of which it was originally a part - the Lechmanskis would have received their building permit from the Building Department in September and there would have been no need for this appeal The impact on the neighborhood will be minimal Lechmanski -ZBA Appl#4890 p 3 It is interesting to also note that the Lechmanskis did not create this hardship Their parcel was created pnor to their purchase of the land and the creation was approved by the ZBA as is evidenced by the minutes of the ZBA hearing of August 15, 1968 which is included in the Lechmanski's file in the ZBA's office At that time the minimum size for lots was 17,500 square feet It was understood by the ZBA that it was approving a substandard size lot, and that such lot creation was not detrimental to the neighborhood It is reasonable to infer that the ZBA, in 1968, anticipated that any future owner of the Lechmanski parcel would want to use that parcel in a manner similar to all of the other parcels in the neighborhood Thus if the ZBA weighs the benefit to the Lechmanskis -the opportunity to fully use their property for a permitted use - against any detriment to the health, safety and welfare of the neighborhood or community, it would not be irrational, arbitrary or capncious for it to grant the variance being requested by the Lechmanskis AESTHETICS In the spirit of neighborliness, the Lechmanskis have instructed me to inform the ZBA that they are willing to explore certain design changes which would alter the extenor appearance of the garage Being mindful of the neighbors' fear that the garage will look like a"hangar", the Lechmanskis are willing to install seven windows, which they will be salvaging from the house, on the garage Three of the windows could be on the west side, thus breaking up the visual impact of the garage In addition, they are willing to use board and batten siding, instead of the more expensive cedar shingles which they had proposed to use, to make the garage appear to be more of a barn and less of a"hangar" Originally, they had intended to keep the garage red, m keeping with other barns in the neighborhood (See Photos 1, 2 and 3 )Instead, they are willing to consider painting the garage the same color grey as the accessory building on the neighbor's lot to the west (See Photo 4) Thank you very much for the opportunity to clarify these issues If you have any questions, please feel free to contact this office at 477-2700 S r y, Robert S Hughes cc Mr and Mrs Lechmanski PHOTO # 1 Lechmanski Gat a Setback . mar -
