FINDINGS OF FACT PROPERTY FACTS/DESCRIPTION: Applicant's property is located on the north side of a private Road, Fishers Island and is improved with a single-family dwelling, all as shown on a February 24, 2000 survey map prepared by Chandler, Palmer& King. BASIS OF APPEAL: Building Inspector's September 19, 2000 Action of Disapproval for the reason that an addition is proposed with a rear yard setback at 25.94 feet instead of the required 50 feet on this lot consisting of .58+- acre. AREA VARIANCE RELIEF REQUESTED BY APPLICANT: The request made by applicant is for a proposed addition 37.35 ft. x 25 ft. at the north side of the existing dwelling, and new one-story kitchen addition 11.29 ft. x 13.39 ft. proposed to be added at the northwest corner of the dwelling. The rear yard setback for the new construction is proposed at 25.94 feet at its closest point. REASONS FOR BOARD ACTION: (1) Granting of an area variance will not produce an undesirable change in character of neighborhood or a detriment to nearby properties. The proposed addition to this preexisting, nonconforming single-family residence: a) will not exceed code requirement for total lot coverage (allowable coverage of 5,000+- square feet, and proposed coverage including new addition of 2,000+- square feet. b) will be a single-story addition and as such will be unobtrusive to the existing neighborhood, and c) will be constructed in an otherwise fully developed neighborhood with no vacant building lots within the immediate area. (2) The benefit sought by the applicant cannot be achieved by some method, feasible for applicant to pursue, other than an area variance because any significant alteration or addition to this nonconforming building with nonconforming lot size requires a variance. The reasons for the variance are related to the unique size and shape of the parcel. M1IIFI. No. 4885—F.B. (4) The proposed variance will not have an adverse effect, alter or impact on the physical or environmental conditions in the neighborhood or district. because the proposed single-story addition to this particular single-family residence is situated on .58 acre within an R-120 Residential Zone District. with nonconforming setbacks as exists (5) The alleged difficulty has not been self-created. In considering this application, the Board deems this action to be the minimum necessary and adequate for the applicants to enjoy the benefit of a new addition to the dwelling, and that the grant of this variance will preserve the character of the neighborhood, and the health, safety, welfare of the community. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces- sary IIARDSIIIP because BENEFIT TO THE APPLICANT: Even through the house has three bedrooms; the public rooms of the house are small and confining. The size of the kitchen is more appropriate to a one- bedroom apartment and the living room shared with the dining room is much too small for family gatherings. The house was originally designed as a caretakers lodging and garage. Now it functions as a family beach house and vacation retreat. The owner would like a bigger kitchen and a living room with ocean views. Although the property is not far from the water it's orientation directly facing the house across the street with no projections -cuts owners off from the beautiful views they could otherwise be enjoying. (See Architectural Drawings, Site Plan & Topographical Map and Photographs: Exhibits 5, 6, 9 &10) NO OTHER OPTIONS: Without a variance, no substantially-sized addition is possible. To the east the road blocks expansion and to the west a steep hill blocks expansion. More stories might seem inappropriate and would also block precious and closely guarded views of property owners from above. One could not expand to the South in a way that would continue the architectural lines of the present house. The North side seems the best place for an addition both in terms of available space adjacent to the existing house and aesthetically too. The lines of the house can be extended in such a way that this former caretakers garage begins to look more like a shingle-style beach house affording opportunities for relaxation and enjoyment, 2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate. vicinity of this property and in this use district because UNIQUE: This long skinny lot is a different shape than the lots around it. The lot is non- conforming and unique. This parcel was once a part of Lot 34 which was divided into three portions. The hillside and road frontage was given the lot we are discussing while the other lots were given the flatter more useful land. Zoning regulations were apparently not considered when this lot was created. Our records of this lot as a unique parcel date to 1963 when it was sold by Cowan to Dini. (See Zoning Notes and Lot Coverage: Exhibit 11) The steep hill directly behind the house to the west makes that portion of the property unusable. THE YARD MIGHT BE A SIDE YARD: The lot is unusual enough to even question whether the yard we are discussing might be a side yard. As a side yard it is generous. (See Zoning Notes and Lot Coverage: Exhibit 11) 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CI IARACTER OF THE DISTRICT because • • • POSITIVE IMPACT ON CHARACTER OF DISTRICT: Because the addition is only one story and lot coverage it only 40 percent of the allowable lot coverage we need not worry that the . • building will be bulky or overbearing. The O'Keffe property to the Northwest is,on a much higher elevation this property will likely not be able to see the Harvey's new addition. The Harvey addition will certainly not block any view. Because of the difference in elevation creates a visual separation, it will not make very much difference if the Harvey's addition comes closer to the rear lot line. As far as the surrounding neighborhood in general: the addition would likely benefit the character of the neighborhood. Additional stones would look inappropriate and:block views. The proposed location is the least intrusive solution. It likely will no be able to be seen from above due to landscaping already in place. 3 . The amount of relief requested is not substantial BECAUSE The properties are separated by a difference in height. The area is little used as it a steeply sloped. 4 . The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district BECAUSE The addition is not large. Only 40 percent of allowable lot coverage and will have no impact on environmental conditions. 5 . Has the alleged difficulty been self-created? ( ) Yes . (X ) No 6 . This is the minimum that is necessary and adequate, and at the same time preserve and protect the character of the neighborhood and Yes the addition is not large in lot coverage and only 1-story. The house cannot be expanded in other ways because of the unusual shape of the lot and the structure's proximity to lot lines and a steeply sloping bank to the west of the structure. The lot is steeply sloping, narrow, irregular;unique and non-conforming. (See Site Plan, Survey, Photographs, and Location Map: Exhibits 5, 9, 10 &13.) REAR YARD OR SIDE YARD? 2. Due to the configuration of the lot there is some debate as to whether the "rear yard" in question might actually be,considered a side yard as it is not directly behind the house but to the side. One might ask where does the rear yard end and the side yard begin? As a side'yard it,would be in generous conformance. One could even consider the lot in a very different way. Could the property be'a corner lot? The front yard would be the property to the south and east. The back yard would be to the north and the side yard would be to the west. Irrespective of whether the lot is a corner lot or a regular lot, we conclude that this lot is unique. WITHOUT THIS VARIENCE, OPTIONS FOR EXPANSION ARE UNDESIRABLE 3. Substantial-expansion of the house would not possible without this variance. Thus the owner would be deprived of the enjoyment and use of his property. Property lines to the south and to the east limit additions on those sides. To the west, a steep hill climbs from 58' elevation to • more than 72' directly in back of the house preventing expansion in that direction. Our addition conforms to the historic shingle style of the house by extending of the lines of the present house while still affording views of the ocean. This configuration is in keeping with the style and scale of the other houses in the neighborhood. (See Zoning Analysis: Exhibit 12.) NOT DETRIMENTAL TO NEARBY PROPERITES 4. With no other houses very close by, the biggest consideration is whether this addition might interfere with views of the ocean enjoyed by property owners above. The answer to this question is No. Presently, only small portions of the Harvey roof above the second story are visible from the property above, and those portions do not block The view. In the proposed addition, property owners have taken care not to disturb views. The addition is one-story with a flat roof approximately 10' below the existing second floor roof. The addition will not block any view, nor is it even likely to be seen from above.'We think that because of the difference in height between the two properties creates a natural separation; the adjoining property will not suffer from the decrease in the rear yard to 25.94 feet (See Architectural Drawings, Photographs, Site Plan: Exhibits 5, 6 & 9.) • • 2 NOT BLULKY OR SUBSTANTIAL 5. The expanded house will cover only 40 percent of the allowable lot coverage. (See Lot Coverage Calculations: Exhibit 11.) BENEFIT TO PROPERTY OWNERS 6. Without this addition the kitchen is tiny and the living/dining room is too small for a three- bedroom house. The house across the street to the east blocks ocean views, so the only way one can see the ocean from the first floor is by leaning out the window. The owners would like a new living room and a more spacious kitchen and ocean views from the first floor. The projection to the east affords good views in two directions and adds an entrance to the house. To preserve architectural integrity, the design consists of the extension of the lines of the existing house projected forward to allow views and an entrance. The 70 sf. walk-on / walk-off entrance and adjacent porch are within the present front yard setback. • (See Site Plan and Architectural Drawings: Exhibits 5 & 6.) The cul-de-sac traffic circle is little used and mainly serves various houses all owned by the Harvey family. (See Photographs & Location Map: Exhibits 9 & 10.) HISTORY OF PROPERTY 7. Current owners are not responsible for the current lot configuration or placement of the house on the lot. The house was built and the lot was created before current zoning regulations. We believe the lot was created by deed in 1963. Then the bulk schedule required a 12,500 sf lot 100 feet deep of any width. We don't know how old the house is, but records show it existed prior to 1956. We have plans for an addition dated Nov 1, 1956, the architect of which also located the addition in the same place the new owners have chosen. (See Property Record Card and Zoning Notes Exhibits 7 & 11.) (See 1963 and 1985 Surveys: Exhibit 12.) We believe that any discrepancies between old and new surveys are due to past antiquated methods of measurement, which have now been improved.
