No. 4815 - GEORGE GARBE 1000-35-6-27 STREET & LOCALITY: 685 Osprey Nest Road, East Marion DATE OF PUBLIC HEARING: May 4, 2000 FINDINGS OF FACT PROPERTY FACTS: Applicant's property contains an area of approximately 17,500 feet situated along the south side of Osprey Nest Road and along Gull Pond Inlet in East Marion. It has a frontage along the road of 66+- ft. and its average depth is 176+- feet. The property is improved with an existing house with attached carport and deck with a setback of 31+- feet from the front line along Osprey Nest Road. Located in the north/west side yard is an accessory shed which is the nature of this variance. BASIS OF APPEAL: Building Inspector's Notice of Disapproval dated March 2, 2000 denying a permit for an 'as-built' accessory shed on the grounds that: (1) it is in the side rather than rear yard in violation of Code section 100-33, and (2) it is two feet from the lot line in violation of the three- foot setback requirement of Zoning Code Section 100-33B.1. RELIEF REQUESTED: Applicant requests a variance authorizing location of the 7' x 8' (+-) shed as-built. REASONS FOR BOARD ACTION, DESCRIBED BELOW: On the basis of testimony presented, materials submitted and personal inspection, the Board makes the following findings: (1) The rear of applicant's property faces Gull Pond. Applicant testified that he and his neighbors all make a point of not placing structures in their rear yards, in order to preserve the views. There is no room for the shed in the front yard. The practical location is the side yard, requiring a variance. (2) The shed has been in its current location for about 25 years. It is unobtrusive, and it backs up on the abutting neighbor's shed; for these reasons the nonconforming location is not objectionable, and the nonconforming setback is not significant. (3) There is no evidence that grant of the requested variance will have an adverse effect or impact on physical or environmental conditions. (4) Grant of the requested variance will not produce an undesirable change in the character of the neighborhood or detriment to nearby properties. : Page 2- May 10, 2000 Appl. The Notice will be published in the next issue of the Suffolk Times. Pursuant to Chapter 5.8 of the Southold Town Code (copy enclosed), formal notice of your application and hearing date must now be mailed with a map or_property_sketch_showing_the._new location of the area being considered. Send the enclosed Notice CERTIFIED MAIL, RETURN RECEIPT REQUESTED, as soon as possible, with a copy of the project map to all owners of land (vacant or improved) surrounding yours, including land across any street or right-of-way that borders your property. Use the current addresses listed on the current assessment records in the Town Assessors' Office (765-1937) or the County Real Property Office in Riverhead. If you know of another address for a neighbor, you may want to send the;notice to that address as well. By Friday, please complete your Affidavit of Mailing (copy enclosed) with parcel numbers noted for each, and return it to us with the white receipts postmarked by the post office. Later, when the green signature cards are returned to you by the Post Office, please mail or deliver them to us. If any signature card is not returned, please advise the Board at the hearing. A sign is 'also necessary for posting at the property by you not later than Thursday, 4/27/00, and therefore must be picked up by you or your representative some time between today and April 26th between 8 to 4 p.m. The sign must be located on the property no more than 10 feet from the front property line bordering the street. (If you border more than one street or roadway, a sign is enclosed for the front yard facing each one.) The sign(s) must remain in place for at least seven (7) days, and if possible, remaining until the day of the hearing. After the signs have been in place for seven (7) days, please submit your Affidavit of Posting (copy enclosed) to us for the permanent file.
