FINDINGS OF FACT
PROPERTY FACTS/DESCRIPTION: The applicants' property is vacant land located east side of
Case's Lane Extension, Cutchogue. This property is shown on the Map of"Frank H. Case" as Lot
No. 3. A survey dated November 24, 1999, prepared by John Schnurr, L.S. shows the lot
dimensions as follows: 312.25 ft. along Cases Lane Extension; lot depth of 302+- feet (average);
acreage of 2.46 acres (to center line of creek).
BASIS OF APPLICATION: Building Inspector's April 21, 2000 Notice of Disapproval for the reason
that the accessory garage will be located in the side yard. Article III, Section 100-33 requires that
accessory buildings be located in a rear yard (or in the case of a waterfront parcel, in a front or
rear yard as provided under Section 100-33C.)
AREA VARIANCE RELIEF REQUESTED: Applicants are proposing a 30x25x6x15.2x31 ft. accessory
two-car garage in the yard area north of the dwelling location, also proposed. This yard is a side
yard.
REASONS FOR BOARD ACTION: Based on the testimony and record before the Board and personal
inspection, the Board makes the following findings:
1. Grant of the area variance will not produce an undesirable change in the character of the
neighborhood or a detriment to nearby properties. Applicant proposes to construct a new dwelling
with an accessory garage attached to the dwelling by a porte-cochere, or roof-covered portico, to
be used for vehicles to drive through and park or access the garage. The proposed side yard
location is 62 feet to the nearest property line and the variance will have no impact on nearby
properties.
2. The benefit sought by the applicant cannot be achieved by some method, feasible for the
applicant to pursue, other than an area variance. Normally, accessory garages are permitted to be
attached to the principal dwelling and would be conforming in this side yard location if the
connected structure is a breezeway (8' x 10' or smaller), or a full enclosure. The porte-cochere,
however, does not conform to the code definition of a breezeway, and the applicant has no other
relief except a variance for this side yard location.
3. The area variance is not substantial. The new dwelling and accessory garage will maintain the
overall appearance of a single-family dwelling and attached garage.

4. The proposed variance will not have an adverse effect or impact on the physical or
environmental conditions in the neighborhood or district because the property is large, 2.14 acres
(tie line measurement), and the proposed side yard location of the accessory garage conforms to
the 60 ft. front yard set back requirement for a principal structure.
In considering this application, the Board deems this action to be the minimum action necessary
and adequate to enable the applicants to enjoy the benefit of a porte-cochere, while preserving
and protecting the character of the neighborhood and the health, safety and welfare of the
community.
RESOLUTION: On motion by Member Tortora, seconded by Chairman Goehringer, it was

NOTICE IS HEREBY GIVEN, pursuant to Section 267 of the Town Law and Chapter 100 (Zoning),
Code of the Town of Southold, the following application will be held for public hearing by the
SOUTHOLD TOWN BOARD OF APPEALS at the Town Hall, 53095 Main Road, Southold, New York
11971, on THURSDAY, AUGUST 10, 2000 at the time noted below (or as soon thereafter is
possible):
7:35 p.m. Appl. No. 4846 - W. AND K. KNOERSCHILD. This is a request for a Variance to
Article III, Section 100-33, based on the Building Department's April 21, 2000 Notice of Disapproval.
The Disapproval denied an application for a building permit to construct garage for the reason the
garage will be located in the side yard of proposed new dwelling. Location of Property: 985 Case's
Lane Extension, Cutchogue, NY; Parcel 1000-109-5-14.43.
The Board of Appeals will at the above time and place hear all persons or their
representative desiring to be heard or to submit written statements (before this hearing is

Re: Chapter 58—Public Notice Requirements-August 10,2000
Dear Applicant:
Please find enclosed a copy of the Legal Notice describing your recent application. The Notice will be
published in the next issue of the Suffolk Times.
Pursuant to Chapter 58 of the Southold Town Code(copy enclosed),formal notice of your application
and hearingdate must now be mailed with a map or property sketch showing the new location of the area being
considered. By Friday,July 21st,please send the enclosed Notice CERTIFIED MAIL, RETURN RECEIPT
REQUESTED,as soon as possible,with a copy of the project map to all owners of land(vacant or improved)
surrounding yours,including land across anystreet or right-of-way that borders your property. Use the current
addresses listed on the current assessment records in the Town Assessors'Office(765-1937)or the County Real
Property Office in Riverhead. If you know of another address for a neighbor,you may want to send the notice to
that address as well.
By Monday,July 31st, please complete your Affidavit of Mailing(copy enclosed)with parcel numbers
noted for each,and return it to us with the white receipts postmarked by the post office. Later,when the green
signature cards are returned to you by the Post Office,please mail or deliver them to us. If any signature card
is not returned,please advise the Board at the hearing.
A sign isalso necessary for posting at the property by you not later than Wednesday,8/2/00,and
therefore must be picked up by you or your representative some time,between now and August 1st,between the
hours of 8 and 4 p.m. The sign must be located on the property no more than 10 feet from the front property line
x bordering the street. (If you border more than one street or roadway,an extra sign is enclosed for the front yard
facing each.) Thesign(s)must remain in place for at least seven(7)days,and if possible,remaining until the day
of the hearing.
After the signs have been in place for seven(7)days,please submit your Affidavit of Posting
to us(copy enclosed)for our permanent file. When convenient,please also return the sign to us.
If you do not meet the deadlines stated in this letter,please contact us promptly. It may be nec-
essary to cancel your hearing if the required steps are not followed. Thank you for your cooperation.
