No. 4845 — ROBERT FRENTZEL STREET & LOCATION: 1900 Old Orchard Lane, East Marion 1000-37-2-9.1 DATE OF PUBLIC HEARING: August 10, 2000 FINDINGS OF FACT PROPERTY FACTS/DESCRIPTION: The applicants' property comprises 22,500 sq. ft. located on the west side of Old Orchard Lane, East Marion with 150 feet of lot depth and 150 ft. of road frontage. It is improved with a single-family dwelling with garage, set back 32.5 feet from Old Orchard Lane, 11.63 feet from the northerly property line (not including a small protrusion that is to be removed) and about 75 feet from the rear property line. BASIS OF APPLICATION: Building Inspector's June 22, 2000 Notice of Disapproval denying a permit to expand the house for the reason that the proposed addition would have a rear setback of 36'4" in violation of the 50-ft. requirement of Code Section 100-244B. AREA VARIANCE RELIEF REQUESTED: Applicant requests a variance to locate proposed construction that will add a second floor to the existing house and a near two-story addition with a rear setback of 36'4" in violation of the 50 ft. requirement of Code Section 100-244B. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspection, the Board makes the following findings: (1) The existing house is small and the owners wish to enlarge it for year-round occupancy. They testify that the only practical direction for expansion is westerly into the rear yard, because the southerly and southwesterly yards are planted in mature gardens and have some significant topographical irregularities. Because this lot is over 20,000 sq. ft., Code Section 100-244 requires a rear yard of 50 feet. The current rear yard is about 75 feet; applicant proposes a rear yard of 36'4". Applicant also proposes a northerly side yard that continues the existing nonconforming setback of 11.63 feet for the entire length of the addition. The required side yard setback under Code Section 100-244 is 15 feet. (2) The proposed project will result in a much larger house than now exists, with two stories rather than one and a much larger footprint. The proximity to the northerly and westerly property lines raises a serious possibility that the property will appear crowded and the house will intrude on the neighbors. Because the project is in the planning stage, applicant is in a position to revise the plan to allow for greater setbacks. (3) The Board concludes that with greater setbacks as set forth below, the project will not produce an undesirable change in the character of the neighborhood or detriment to nearby properties. 4 I Page 2—September 6, 2000 ZBA Appl. (5) The action set forth below is the minimum necessary and adequate to enable applicant to enjoy the benefit of a larger home with minimum disruption of established gardens, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION/ACTION: On motion by Chairman Goehringer, seconded by Member Collins, it was RESOLVED, to DENY the variance applied for and ALTERNATIVELY to GRANT a variance authorizing a rear setback of no less than 40 feet from the rear property line, subject to the CONDITION that the northerly wall of the proposed addition shall for its entire length be set back no less than 1eet from the northerly property line. Dear Sir: It has been many months since your decision concerning the construction of the Frentzel home on Old Orchard Lane, in East Marion. I felt it would be prudent to hold my thoughts until construction had progressed to a stage in which it would be possible to imagine the final out- come. The structure is every bit intrusive, as all of us in the area had suspected; oversized in its environs, it dwarfs the surrounding homes and casts us all in shadows. There has been no other construction previously allowed in Gardiners Bay Estates that even remotely compares to this monstrosity. As a result of the Board of Appeal's dereliction in judgement, you have driven the thin edge of the wedge into our stable and uniform community, opening the area to future atrocities, using relativism as your guide, as well as your excuse. Such an affront to our sensibilities leads us all to wonder whether Frentzel's variance had been approved by unscrupulous means. The real problem here is our lack of direct means to defend ourselves from an intrusion of this kind. We have no choice but to look to a third party who has the power of enforcement behind it. The premises is located in Section Two of Gardiners Bay Estates - the map for which was filed in 1927. While there is some new construction, the structures in the area primarily are (1) summer bungalows, or (2) summer bungalows which have been renovated, expanded and/or converted into year-round use. The subject premises consists of 22,500 square feet(0.53 of an acre) located on the west side of Old Orchard Lane in East Marion. It originally was comprised of three of 50x150' lots on the filed map. In March 1974, the applicants purchased the premises as two separate 75x150' lots. The dwelling was and is located on the northern of the:two 75' lots. For a reason unknown to both the owners and the Southold Assessors Office, the two parcels were combined on November 5, 1981. (See Southold Town Property Card.) ' The applicants purchased the property with the intention of retiring to East Marion. They personally landscaped the parcel and installed and tended the lush gardens located on the southern and western part of the property. The focus of the current house (and the proposed addition) is from the north side of the premises toward the south. The applicants wish to expand and renovate the dwelling so that it will be,their retirement home. While converting the existing first floor into a foyer/breakfast room/kitchen, dining room, living room and den, the applicants propose to add an atrium and master bedroom suite off the northwest corner of the house. A second floor inchiding,a study and guest rooms will be added. The garage at the south end of the house will be extended to provide extra space on the second floor for Mr. Frentzel's extensive model train collection. The approximately 5x15' existing extension as well as the chimney projection on the northern side of the current dwelling will be removed making the side yard setback not more than 11.63'. The proposed lot coverage is-15%. Because the proposed rear yard setback is 36'4" rather than the requisite 50', the applicants are seeking a rear yard variance of 13'8". It should be noted that if the applicants were to sell a strip less than 17' wide to the neighbor to the south, the proposed structure with a 36'4" setback would be in total compliance with the Code. 1. An undesirable change will NOT be produced in the character of the neighborhood or a detriment to nearby properties, if granted, BECAUSE: The requested variance is consistent with what currently exists in the neighborhood. As a general rule, the lots in Gardiners Bay Estates are non-conforming under the Town Code. Most of the lots are smaller than 20,000 square feet for which the rear yard setback is 35' (which is less that the proposed 36'4" setback in this case). Nonetheless, many of the neighboring dwellings in Gardiners Bay Estates have insufficient setbacks. For example, the house immediately to the north (Fisher, Lot#7.1) has a side yard setback of only 7'± (possibly 6'±, depending on whether the deck remains in the place reflected on the 1991 survey) rather than the required 10'. The house across the street (McKeon, Lot #12.1) has a rear yard setback of 13',± rather than 35'. Whereas the Code requires a 35' setback, the Thorp house (Lot#4.1) has a rear yard setback of 25'±. The house at the end of block (Lasgar, Lot #33) has a rear yard setback of 151h',± rather than 35' and a front yard setback of 19'± rather than the required 35'. (See copies of surveys'annexed.) Numerous additional examples exist throughout the Gardiners Bay community. • The extension is directed back from the road and located in an area that will serve to preserve the privacy of the neighbors and the applicants. Accordingly, the proposed addition will not produce an undesirable change in the character of the neighborhood or detriment to nearby property. 2. The benefit sought by the applicant CANNOT be achieved by some method, feasible for the applicant to pursue other than an area variance BECAUSE: In light of the layout of the current house and the grounds, the proposed extension parallel to northern line is both logical and aesthetically appropriate. The proposed master bedroom wing to the rear affords the applicants' privacy and preserves the house's focus toward the mature landscaping to the south and west. A two-story box on the property with the master suite on the second floor is not feasible. One of the applicants has arthritic knees as well as a leg problem which dictate against daily and repeated stair- climbing to a second floor master bedroom. Moreover, the owners wish to use the house as a retirement home. . A relocation of the extension so that the dwelling is shaped as a "T" would result in a larger-side yard If the unexplained 1981 combination had not occurred (and a Code merger were avoided);,.the '-•.; lot would be less than 20,000 square feet and the proposed 36'4" rear yard setback would be acceptable under the current Code. which essentially would be and would provide a view of a fence and the windowless side of the northern neighbor's house. Placing the addition at the back of the garage is not architecturally sound. It would require that the owners walk through or along the garage to get to the main living space on the north side of the house. To extend the house to the south is neither feasible nor appropriate. Such a plan would increase the road frontage, require relocation of the garage, and destroy a major portion of the mature landscaping installed and maintained by the owners. Simply put, the proposed "L" shaped dwelling makes sense. 3. The amount of relief requested is not substantial BECAUSE: The requested 13'8" rear yard setback is less than a 28% variance from the required 50' setback. Other existing non-conforming dwellings in the immediate vicinity have substantially larger variances. The McKeon's 22' setback is a 63%'variance from the Code; the Lasgar property has a 56% yard variance and a 46% front yard variance; the Fischer property has a 30% side yard variance; and the Thorp house has a 29% rear yard variance. 4. The variance will not have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district BECAUSE The extension toward the back of the property is designed to minimize the physical and environmental impact on the neighborhood. The addition is directed away from the street and into an area where neighbors will be least disturbed. If the extension were tothe south, there would be a significant adverse impact on the street scape as a result of the increased road frontage of the house. The proposed structure is in keepiniwith the neighborhood. 5. Has the,alleged difficulty been self-created? ( ) Yes. (X) No. 6. But I can't help but express my reservations regarding their proposed addition. This looming 25 foot high addition,which is bigger than many of the houses in our neighborhood,is being built a scant 11 1/2 feet from my property line along almost my entire back yard. In addition, our houses were originally built very close together,less than 20 feet apart. We are afraid this addition will create a"city"like atmosphere where the only view you have from some of your windows is that of another building, and what that will do to our property value. I don't know if this is possible,but I was hoping that some Solomon like compromise could be reached where the addition would be allowed but attached to the other side of their house, behind their garage. I know they must have spent a lot of time, effort, and money on this project and this arrangement would allow them to build their addition with very little change to their plans. It would also move the structure away from most of the neighbor's property lines thereby limiting the impact it would have on any of us. I would like to make one final proposal. I think part of the reason for putting the structure where it was proposed was to make it into a kind of inhabitable fence, screening their yard from most of their visible neighbors. Therefore, if they would be willing to move the addition to the other side of the house we would be willing to incur the expense of planting screening trees on our property to help create a better view for them from their backyard by blocking the view of our backyard. DOTY: I'm fine Mr. Chairman, how are you? I have the Affidavit of Posting was signed for the Board. CHAIRMAN GOEHRINGER: Thank you. We're ready whenever you are. MS. DOTY: The separate parcel is 22,500 sq. ft. property located in Gardiners • Bay Estates. That area is predominately small non-conforming lots and this is probably the largest in the neighborhood. The applicants are requesting a rear yard variance of 13 feet 8 inches less than 28%. One could theorize that if they sold a 17 foot wide strip on the sound side of their property, we wouldn't be here. We'd have less than 20,000 sq. ft. and rear yard setback of 35 feet with the bluff but that's not the case before you. The applicants wish to convert the existing - essentially summer bungalow into their retirement home and they want to have the living space primarily on the first floor. The architect just mentioned it's convenient for older people to have their living space on the first floor, their master bedroom. The plans show a master bedroom suite to the back of the property along the north line of the property following the existing north line of the house. And the living space will actually focus towards the mature gardens there. The applicants installed it. I don't know if you all went out to the premises but they are lovely. CHAIRMAN GOEHRINGER: There's also a significant elevation factor. MS. DOTY: Yes, as well as that. They're behind the garage. The addition extends back from the road, which limits the measure impact actually on the neighborhood. We cold theoretically go down the roadside but that would have a dramatic impact on the road coming into the house and would, in fact I think that Page 31 August 10, 2000 Board of Appeals Hearings (coughing) the street there by extending to the south. This is the most feasible way of achieving what the applicants' want, which is living space on the first floor for the retirement home. It is conceivable that a two-story box could be put up there but unfortunately one of the applicants has arthritic knees and have legs and that means that's against going up and down the stairs all the time. By focusing the house to the south and the west, they're actually increasing the privacy for the neighbor that's closest to them, which is the one to the north because the house is actually going to go that way and there's not going to be that much activity to the north. We're also increasing the side yard setback by eliminating two projections into that side yard setback. So the wall will be no more than, the north side of the house will be no more than 11 feet, 11.63 feet from the side yard. This is really no different than what exists in the neighborhood. There are any number of insufficient setbacks pre-existing I grant you because of the pre zoning. But for example across the street, the neighbor it's the McKeon house, it has a 13 foot rear yard setback. Now that's a 63% variance from the Code. Up the street there's a 56% variance, for the rear yard and a 46, I have all of this, I'll give it to you. Next door there's a 30% variance on the side yard because the house next door toward the north, is only 7 feet off the line. Other configuration of the house, just don't make sense. If for example the extension were moved to the back of the garage, which has been suggested, that divides the property in two essentially. Actually increases the activity on the north side of the property and decreases the privacy of the neighbors to the north. Linda was kind enough to fax the property of a letter that the Board received from the neighbor to the north and that person doesn't seem to object to the rear yard setback at all. It's an issue of the extension of the house backwards of which we can do anyway and a second-story could be put on the existing dwelling without a variance. He makes some comment about limited views from windows, etcetera but I have a photograph here which I took before I got the letter of the side of the house which has no windows at all and the house is actually directed a little bit to the north and the west of, that is the - neighbor to the north of and this is not a spite addition or any effort to strain the • property to the north. This is the logical place to put living quarters over property existing dwelling and therefore we requested the Board grant less than- 14 foot variance and do you have any questions? CHAIRMAN GOEHRINGER: George? MEMBER HORNING: You mentioned single story but the proposal is for a two- ; story addition, is it not? MS. DOTY: That's correct. I have plans here for the Board. They are simplified plans which show you what the proposed addition is. It doesn't have' all the plumbing features in it etcetera. I realize that the 11 foot side is not an issue because you're essentially going along the existing footprint of the property. MS. DOTY: We're actually improving. MEMBER TORTORA: (more than one person speaking) because it's going to be a considerable size house and it is going to present a wall that will be 11 feet from their property. So I guess the question I'm asking is you have such a large parcel of property and so many options of other places that it could be where you wouldn't impose on neighbors on either side and you practically wouldn't even be required to get a rear yard variance. Why wasn't it designed like that? MS. DOTY: Because of the existing landscaping that was there. The depression of the land and the fact that the living space on the house, is at the other end of the house. Now Mrs. Tortora, I do have a photograph of the Fisher's house which will hand to the Board but and I took it very innocently on Sunday. This is the existing dwelling and this is the Fisher's house. So you can see there's not a window on that side of the house. MEMBER TORTORA: There isn't. It's still going to be pretty close and you have so much room on the other side where you wouldn't be required any variance. That's my only comment. CHAIRMAN GOEHRINGER: Could you just state your name for the record? MS. FRENTZEL: I'm Melanina Frentzel and I've lived here 56 years of my life and this is going to be our retirement home and we've worked on these plans. We had a local architect, which we those very carefully so everything would be done exactly right, two years and living in this house, I have another home in Greenport that is now for sale. We thought of the neighbors. We thought of Sean and - Craige barbequing at night and the barbeque grill going in our window. We thought of Mrs. Neece with no privacy because if we sit on our deck, she has absolutely no privacy. Sally has privacy now because we put up a fence because her evergreen trees are too high and there's absolutely— CHAIRMAN GOEHRINGER: Ma'am, ma'am, you have to address the Board. MS. FRENTZEL: So we put a fence up if we were there for the privacy and when we worked with our architect for two years, we probably will have a pool because we do have the land for it. We are going to have the grandchildren and,children and they also have children and grandchildren and,we were advised that what we were doing was legal and correct and that's how we did the plan. Not that if you find it's not that way, but we do want you to know and our Real Estate Committee kept asking for the plans and I grew up here and I know the most important thing - before anything is to have it approved by you people which I did say to Anne let's Page 35 August 10, 2000 Board of Appeals Hearings perhaps believed that a 35 foot setback was adequate without realizing they were over a line in the code. I have heard some reference to a gully which I am not familiar with but it appears that if the gully is prohibiting the design, if the gully is in such a location that it prohibits the addition from going to the south where all of the apparent space is, then why couldn't this gully be filled and I guess this would be a question to the architect because at first blush, looking at this layout, there's at least a half a dozen designs that come to be readily to go in the other direction without in any way of infringing upon any of the neighbors. So it's a question of the gully. As I said I'm not familiar with that but maybe that question could be answered. Why couldn't it be filled and why couldn't this design be proposed in such a way that it doesn't infringe on anybody else's property? Thank you. CHAIRMAN GOEHRINGER: Who would like to answer that? How are you tonight? MR. FAIRWEATHER: Fine, thank you. Extending the house to the south, we took - a very conscious effort not to increase the house in its width along the street there. Most of the houses in Gardiners Bay Estates are 30, 40, 50 feet wide. We had the right to make this house 100 feet wider if necessary but we really didn't want to change the character of the neighborhood by doing that. It just seemed appropriate to extend the house towards the back which will have the least impact on the neighborhood and also as it's been pointed out, there are topographic situations on the south side of the property but we are also dealing with a pre- existing house which we're just trying to extend on to, and the pre-existing house has L shape already on the north side of the property and we were just extending back on,that side of the property. It is improved with a single-family dwelling with garage, set back 32.5 feet from Old Orchard Lane, 11.63 feet from the northerly property line (not including a small protrusion that is to be removed) and about 75 feet from the rear property line. BASIS OF APPLICATION: Building 'Inspector's June 22, 2000 Notice of Disapproval denying a permit to expand the house for the reason that the proposed addition would have a rear setback of 36'4" in violation of the 50-ft. requirement of Code Section 100-244B. AREA VARIANCE RELIEF REQUESTED: Applicant requests a variance to locate proposed ' construction that will add a second floor to the existing house and a near two-story addition with a rear setback of 36'4" in violation of the 50 ft. requirement of Code Section 100-244B. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and ' personal inspection, the Board makes the following findings: (1) The existing house is small and the owners wish to enlarge it for year-round occupancy. They testify that the only practical direction for expansion is westerly into the rear yard, because the southerly and southwesterly yards are planted in mature gardens and have some significant topographical irregularities. Because this lot is over 20,000 sq. ft., Code Section 100-244 requires a rear yard of 50 feet. The current rear yard is about 75 feet; applicant proposes a rear yard of 36'4". Applicant also proposes a northerly side yard that continues the existing nonconforming setback of 11.63 feet for the entire length of the addition. The required side yard setback under Code Section 100-244 is 15 feet. (2) The proposed project will result in a much larger house than now exists, with two stories rather than one and a much larger footprint. The proximity to the northerly and westerly property lines raises a serious possibility that the property will appear crowded and the house will intrude on the neighbors Because the project is in the planning stage, applicant is in a position to revise the plan to allow r greater setbacks.
