NO. 4806 - THOMAS GURNEY 1000-112-1-10 STREET & LOCALITY: 4055 Aldrich Lane Ext., Mattituck DATE OF PUBLIC HEARING: May 4, 2000 FINDINGS OF FACT PROPERTY FACTS/DESCRIPTION: The property consists of 2.0973 acres (91,358 sq. ft.) with 105 ft. frontage along a private right-of-way which extends north of Sound Avenue, in Mattituck. The property is improved with a two-story frame house with deck addition(s) set back at 100 feet from the top of the bluff. BASIS OF APPEAL: Building Inspector's March 9, 2000 Notice of Disapproval denying: (1) an application for a building permit to build an in-ground swimming pool because it will be within 100 feet of the top of the Sound bluff, in violation of Section 100-239.4, and (2) stating that an as built hot tub is located in the side rather than rear yard and is set back 18.8 feet from the lot line rather than the required 20 feet, in violation of Section 100-336.4. RELIEF REQUESTED: Applicant originally sought a variance authorizing an 18 x 36 ft. in-ground swimming pool with a minimum setback of 54 feet from the top of the bluff. At the hearing on May 4, 2000, applicant indicated that the proposed pool had been rotated 90 degrees, resulting in a setback of 71.3 feet from the top of the bluff and 46.3 feet from the Coastal Erosion Hazard Line. Applicant also seeks a variance authorizing the location of the hot tub as built. GENERAL TERMS & CONDITIONS (BLUFF AREAS): Construction activity of pool and deck: (1) shall be limited to the use of one tractor with attached backhoe, and (2) excess fill shall be trucked to an area off site or to a location south of the dwelling, and (3) no re-grading within 60 ft. of bluff that would change the topography. REASONS FOR BOARD ACTION DESCRIBED BELOW: On the basis of testimony presented, materials submitted and personal inspection, the Board makes the following findings: (1) Although the property contains over two acres, it is narrow, measuring approximately 100 feet in width. The slope of the land and the presence of a driveway make location of a pool in a permitted front yard area impractical. The house is approximately 100 feet from the top of the bluff. (2) Statements were received from applicant's architect and engineer to the effect that a pool in the proposed location will not threaten the bluff. An inspection by the Suffolk County Soil and Water Conservation District resulted in no adverse comment. Although a neighbor testified as to concerns over the stability of the bluff, no evidence was introduced to indicate that grant of the relief set forth below will have an adverse effect or impact on physical or environmental conditions. Page 2 —Appl. No. 4806 , Re: 1000-112-1-10 (Gurney) ZBA May 10, 2000 Determination (3) The proposed pool location close to the house does not intrude on neighbors. Construction of the proposed pool, unenclosed except for required fencing, will not produce an undesirable change in the character of the neighborhood or detriment to nearby properties. (4) The hot tub is almost entirely behind the rear line of the house proper, but a small deck off the rear of the house has the effect of placing the tub in the side yard. The location is unobtrusive. The Code requires a 20 ft. setback from the lot line for accessory structures because the property is large in overall size, but in the context of the narrow property width, the tub's setback of nearly 19 feet is substantial. For these reasons, grant of the requested variance for the hot-tub location will not produce an undesirable change in the character of the neighborhood or detriment to nearby properties. (5) The actions set forth below are the minimum necessary and adequate to enable applicant to enjoy the benefits of a swimming pool and a hot tub while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION/ACTION: On motion by Member Collins, seconded by Member Tortora, it was RESOLVED, to DENY the relief requested at 71.3 feet, and BE IT FURTHER RESOLVED, to GRANT alternative relief for a variance placing the proposed pool in the revised location with a minimum setback from the bluff of seventy-five (75) feet, subject to the following CONDITIONS: (1) any decking or paving around the pool that is to any extent above grade shall be included in measuring setbacks; (2) any pool drainage shall be led away from the bluff and into dry wells; (3) hay bales at 10 ft. from over-cut for pool at the north side, approx. 55 - 60 ft. parallel to the pool; (4) owner shall submit final plan indicating final location of dry well(s) to be used in connection with pumping of pool water. Both structures are proposed at less than 100 feet from the bluff or bank of the L.I. Sound, and the spa structure is in a side yard location with less than 20 feet from the property line. Location of Property: 4055 Aldrich Lane Extension, Mattituck, N.Y.; Parcel No. 1000-112-1-10. CHAIRMAN GOEHRINGER: Mr. Gurney how are you tonight Sir? MR. GURNEY: Very good, very good. How are you? CHAIRMAN GOEHRINGER: I had the distinct pleasure of visiting your very beautiful property over the course of the last weekend and I met with you and your wife. It actually was the highlight of my entire day. MR. GURNEY: I don't know if that's good or bad. CHAIRMAN GOEHRINGER: That's good. OK, what would you like to tell us? MR. GURNEY: Well a few things. Number 1, what do I do with these green cards? CHAIRMAN GOEHRINGER: We need them. MR. GURNEY: I am seeking a variance within 100 foot setback. The key issue here is I believe is, the stability of the bluff. I have a G i Technical Engineer has a letter in the file which you have, which addresses the stability of the bluff. There is a letter from my architect which addresses the stability of the bluff. Today you received the report from the I believe it's Suffolk County Soil & Water Conservation which had a positive response to the stability of the bluff and vegatation which I maintain pretty well in regard to having a pool or no pool. I just keep the bluff in pretty good shape because I felt it's important to me more than anyone else. I also realized that one of my neighbors has objected due to some concerns about the bluff. His house which is probably 40 feet forward of my house so he has some concerns. Because of those concerns I have provided you with a new survey which I've turned the pool sideways in order to pull the pool back to minimize any concerns at all. At this point it puts the pool about 71 feet from the top of the bluff and I believe it's 46 feet from the coastal erosion line. So I pulled it pretty tightly to the house in order to avoid any of those particular issues. Additionally, my builder Mark Beckman has looked at Page 29 - May 4, 2000 Transcripts of Hearings — -9 c Board of Appeals the bluff and feels it's also stable. There's also three sub-service range areas on the property. One, on the waterside and there's two on the landward side. In order to take care of any existing drainage and any future drainage issues, if there would be any. As far as any other feasible locations, for the pool, there really aren't on the property. The typography doesn't work. There's a septic system. It would cause me to even try to squeeze into the front yard which is not esthetically pleasing at all. I can't also put it anywhere else on the property too far to have any safety concerns that I would have, having a pool that would be not close to the house and not able to watch any of the children. I don't know what kind of questions you would have. I open to any. CHAIRMAN GOEHRINGER: This is a liner pool or a gunite? MR. GURNEY: Gunite. CHAIRMAN GOEHRINGER: The only concern we have is the possibility of your adhering or the only two concerns is the possibility of your adhering to Soil & Water Conservation's thoughts about hay bales during construction and the situation of the drywell thereby pumping any water into a drywell as opposed to pumping it on the lawn which was, which is certainly not a good idea if you were using chlorinated water and number 2, the possibility of any type of topside erosion which that may cause. I realize that your property actually starts at the top of the bluff and falls away a little bit gently toward the house which could also cause a flooding problem on the house. So I think that you might want to adhere to us some sought of drywell and indicate that to us, you know, where you might want to put that. MR. GURNEY: Well there's two existing drywells on the landward side of the property. There's an existing one on the waterside which will probably:.be removed while the digging is going which I will then move it so there is one and I will continue to have another one in order to take care of any erosions. CHAIRMAN GOEHRINGER: When you finish that and get a final survey will you send us a final survey indicating where that drywell 'is so we can make it as a composite? MR. GURNEY: Abolutely. CHAIRMAN GOEHRINGER: So wherever you intend to move it but we'd like to know where it is. MR. MEMBER HORNING: What made you to decide to move it to be parellel to the house rather than rotate it? MR. GURNEY: Well a few reasons. Number 1, Soil & Water Conservation in some discussions with them, they had I don't want to say concern, but you know, they had some questions number 1 but more importantly, the DeGraffs, my neighbors who I try to keep you know, have a good relationship with all of my neighbors, had some concerns which I recently found out about, spoke to him to a_01s.�Q eliviate any of his concerns, I turned the pool in order to keep essential) everyone happy. I would prefer it the other way. That's my prefe ce, but you know, it's the Board's decision on which way it would go. I would prefer it the other way but I'm just trying to be a good neighbor. CHAIRMAN GOEHRINGER: Mrs. Tortora? MEMBER TORTORA: Is the location of the drywell on the left side? CHAIRMAN GOEHRINGER: We just discussed that. He hasn't figured out where he's going to put it but he's going to locate it somewhere in the area. MEMBER TORTORA: So what's the distance between the slate patio and the pool? MR. GURNEY: 13 feet. • MEMBER TORTORA: Is that the distance to the pool before decking or just the walkway area to the pool? MR. GURNEY: That's the a, 13 feet including the decking to the end of the patio and then they're stairs that go down out to the rear of the house, and I didn't want it so tied to the house where it comes up the stairs and have the ability to just fall in. MEMBER COLLINS: The way I read this revised plan from the existing little a (what would you call ) small deck on the rear of the house to the end of the pool across the slate patio is the 13 feet and then you get to the pool. MR. GURNEY: Well that's considehe line of the house with the furthest point. MEMBER COLLINS: I just thought I'd add, you know, Mr. Horning asked you, why did you rotate the pool 90 degrees and I think apart from Soil & Water and your neighbors, that you probably would have devine from the air that this Board does see pools on the bluffs not infrequently and our goal always is to keep them as far back from the bluff as possible and it almost always means, that the pool is rotated. During the evaluation we made several observations with respect to slope,vegetation,potential/existing erosional features,and proposed structure locations. The following is a summary of our observations and comments. The slope of the property(back yard)trends from the northeast to the southwest on the eastern border and from the west to east on the western border. This grading scheme would tend to harbor runoff on the property thus limiting soil erosion on the bluff face and along the(CHEL)Coastal Hazard Erosion Line.The vegetation along the bluff face and the back yard appeared to be healthy with several native species noted.However, Removal of vegetation along beach fronts/bluff faces may enhance erosional scenarios in these areas. As a result, you may want to limit the removal of native plants from this zone. During the bluff face evaluation some minor erosional features were noted above the toe line parallel with the stairs to the top of the bluff.Therefore,you may want to suggest that some native species of grasses or shrubs be planted in these areas. For more information on native grasses and shrubs you may want to contact Allan Connell of the USDA's(United States Department of Agriculture)division of NRCS(Natural Resources Conservation Service)or Cornell Cooperative Extension. It would also decrease the distance from the original proposal to the assumed private supply well on the western side of the property. Goehringer, Chairman Zoning Board of Appeals Southold Town Hall 53695 Main Road Southold, New York 11971 RE: Calendar for May 4, 2000 Appeal No. 4806 Application of Thomas Gurney Dear Chairman Goehringer and Members of the Board: My wife, Margaret and I are the owners of the residence immediately east of and contiguous with the Gurney premises, and we are writing to you to express our concerns about the proposed installation of a.pool on the seaward side of the Gurney's existing residence. .We are expressing our concerns in writing because we will,be unable to attend the meeting on- May 4, 2000, and we ask that this letter be made a part of the record. First, we ask that the Board inspect the Gurney premises but also that the Board inspect at the same time the bluff erosion now occurring at our residence on the east, the vacant lot to the east of us (which was the subject of the now withdrawn Hirsch application No.4724) and the Rothberg/Palmieri and Cannon residential parcels further to the east. The subsurface geology in the area of Gurney on the west and Cannon on the east, an enclave of five lots and four residences, is clay, as a result of which surface water runoff is a serious local problem. On an inspection, you will be able to,observe at least the following: 1. The north face of the bluff in this entire area is unstable and has suffered substantial failures within the last 15 years; 2. The top of the bluff is eroding at a much faster rate than the base of the bluff, a factor,which evidences the clay and the absence of any ability for rainwater (or pool water) to percolate; 3. The condition is not entirely unique to the Gurney, DeGraff, - . Rothberg/Palmieri or Cannon parcels; when the Board inspects you will see the former Levon, now Long Island Power Authority, parcel to Gerard P. Goehringer, Chairman April 28, 2000 Page 2 the immediate west, which was the site of a damage lawsuit resulting from shoreline erosion; 4. The base of the bluff immediately seaward of our residence eroded 15 feet plus or minus landward in the October 1991 "perfect storm"; 5. The face of the bluff seaward of the vacant lot between our residence and Rothberg/Palmieri (site of the former Hirsch application) is now without vegetation because of a massive "blow out" resulting from rainwater reaching the clay and then running northerly and out the bluff face; 6. Efforts by the Cannons and Rothbergs to establish grass with netting and hay at the top of their common boundary bluff have essentially failed; 7. The face of the bluff is approaching in many areas a vertical, even dangerously concave, configuration; and 8. The Suffolk County Soil Conservation Service has now (as a result of the Hirsch application) staked the base of the bluff in this area (you will see the stake on your inspection of the bass of the bluff) because of the exceptional risks. Introducing or placing a swimming pool seaward of the Gurney house will involve disturbance of the bluff area, heavy equipment, displacement of existing soil conditions and replacement with the weighty swimming pool, including the downward and seaward forces of that weight in the unstable sandy top area of the bluff. In addition, the pool invites discharge of water when servicing or cleaning (realistically an activity unmonitored and conducted at least cost). Our house is now at risk because of the unstable bluff. The proposed pool would place us at much greater risk. If the pool were located on the landward or south side of the Gurney house there would be no risk to anyone. In summary, the application introduces an undesirable change in the neighborhood (none of the above mentioned neighbors have pools on the seaward side of their property),and there is a reasonable alternative. We ask that this application be considered on the level of one neighbor to another. On that level, as well as any other, placing a pool atop an already unstable bluff is a bad idea.
