No. 4799 - RUTH ANN BRAMSON 1000-31-14-4.5 STREET & LOCALITY: 12402 Main Road, East Marion Tows Clerk, Town of SoitBold DATE OF PUBLIC HEARING: April 6, 2000 FINDINGS OF FACT PROPERTY FACTS/DESCRIPTION: The applicant's property consists of 21,835.99 sq. ft. in area with 30 ft. frontage along a private right-of-way leading to the Main Road (State Route 25), in East Marion. The lot is improved with a two-story frame cottage and accessory garage as shown on the November 3, 1999 survey prepared by Joseph A. Ingegno. The existing cottage is shown at 63 feet at its closest point to the wood bulkhead. BASIS OF APPLICATION: Building Inspector's February 29, 2000 Notice of Disapproval citing Article XXIII, Section 100-234B, sic (100-239.4B) of the Zoning Code with respect to a proposed 56.5 (+-) ft. setback from the bulkhead for a new addition. Article XXIII, Section 100-239.4B requires a minimum of 75 feet for new building area when a degree of nonconformity is increased or expanded. AREA VARIANCE RELIEF REQUESTED: Applicant requests a Variance for an expansion of the existing cottage for a porch addition at a minimum of 56 feet to the bulkhead (at its closest point). The setback from the bulkhead increases in a westerly direction along the proposed angle of the addition. REASONS FOR BOARD ACTION, DESCRIBED BELOW: Based on the testimony and record before the Board and personal inspection, the Board makes the following findings: pair 1. Grant of the area variance willAproduce an undesirable change in character of neighborhood or a detriment to nearby properties. The proposed porch addition would extend approximately eight (8) feet seaward from a small cottage located on a well-vegetated bluff, which is landward of the bulkhead. The porch would not be visible to nearby residences, nor was any evidence presented to suggest that it would adversely impact nearby properties. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for applicant to pursue, other than an area variance because the applicant wishes to enjoy the waterfront vista of this property and no other alternative location provides a reasonable opportunity for this benefit. 3. The requested area variance is not substantial and represents a 19-foot reduction in the code required 75 ft. minimum setback to the wooden bulkhead, and an eight-foot increase in the preexisting 63-ft. setback. 4. There is no evidence that the grant of the variance will have an adverse effect or impact on the Page 2-April 19, 2000 •ZBA Appl. No. 4799- R. Bramson Parcel 1000-31-14-4.5 physical or environmental conditions in the neighborhood or district. The applicant has agreed to accept the following conditions to mitigate any potential adverse environmental impacts. In considering this application, the Board deems this action to be the minimum necessary and adequate to preserve and protect the character of the neighborhood, and the health, safety, welfare of the community. RESOLUTION/ACTION: On motion by Member Tortora, seconded by Member Dinizio, it was RESOLVED, to GRANT the variance requested, SUBJECT TO THE FOLLOWING CONDITIONS: 1. All roof run-off shall be guttered on the cottage's south side to a dry well located northwest of the cottage. 2. Invasive locust saplings shall be removed from the southerly foreshore adjacent the residence and replaced by Rosa Rugosa, Grasses, Bayberry, Beach Plum, or similar low-growing indigenous plants. No other residence is easily visible when one is shielded by boundary line indigenous vegetation including evergreen cedars and the closest westerly neighbor is a large residence on an 8 .4 acre parcel (SCTM 1000-31-14-10 . 1 ) about five hundred (500 ' ) feet to the northwest and a boathouse and residence west of that. 3 . On an evaluation of this application under Town Law § 267-b(3) (b) ( 1 ) , it is my opinion that construction of the proposed porch would not produce an undesirable change in the neighborhood for the reasons a) the improvement will not be visible from any off-site residence or property; b) the closest neighbor (east) has approved the plan by a letter submitted to this Board; and c) the effect of the porch is to congregate and limit outdoor activity on the porch, a preferable alternative adjacent the foreshore and bluff . 4 . Turning to Town Law § 267-b( 3) (b) (2 ) , the feasible alternative analysis, in my opinion a porch extending eight (8 ' ) feet seaward from a nine hundred (900 ' ) square foot waterfront cottage is not itself a choice taken from a long list of alternatives . The choices appear to be do nothing or if one seeks the reasonable amenity of a porch to enjoy the waterfront vista out of the weather then one is limited to at least that which is proposed here. In other words I do not see alternatives which would be the equivalent of what is proposed and be considered a reasonable alternative, much the same as the Court approved in Baker v. Brownlie, 248 A.D.2d 527, 670 N.Y. S. 2d 216 (2d Dept. 1998) . - 2 - 5 . Town Law § 267-b( 3) (b) ( 3) addresses whether the relief requested is substantial . Given the historic bulkhead, which is in good functional condition, the size of the existing cottage (merely 900 square feet) , the seaward expansion limited at eight (8 ' ) feet, and the points offered in mitigation in paragraph 6 of this affidavit, I do not consider the variance of nineteen ( 19 ' ) feet or twenty-five (25%) percent off the seventy- five (75 ' ) foot standard at Town Code § 239 .4 substantial . 6 . The last point in my analysis, § 267-b(3) (b) (4) , is whether the proposal will cause an adverse environmental effect. In my opinion, the only effects will be beneficial to the extent a covered porch tends, as stated above, to limit pedestrian traffic. The Planning Board approved the creation of a minor subdivision subject to receipt of a legal instrument that lots One and Two will not be further subdivided. The Planning Board specifically did not require any covenant with respect to the division of this lot. THE CHAIRMAN: I talked to John Wickham tonight about this minor subdivision. (There was no response . ) Southold Towai Board of Appeals -13- May 2 , 1974 After investigation and inspection the Board finds that applicant requests permission to divide and set off lots with existing buildings with less than required width and area on premises located on the south side of Main Road, East Marion, New York. The findings of the Board are that this division of property recognizes an existing situation and is the only feasible way to divide. The applicant has furnished a minor subdivision of 6 . 7 acres and will be limited to five residential structures on the four lots. Both the Planning Board and the Appeals Board have considered the division of this property before. The Board agrees with the reasoning of the applicant. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will not change the character of the neighborhood , and will observe the spirit of the Ordinance. On motion by Mr. Gillispie , seconded by Mr. Bergen, it was RESOLVED, Lucille Mosback, Rose Hill, North Carolina, be GRANTED permission to divide and set off lots with existing buildings with less than required width and area on premises located on the south side of Main Road, East Marion, New York, as applied for, subject to the following conditions: 1.
