Dear Mr. Goehringer:
On February 18, 2000 we completed a site inspection at 29315 Main Road, Orient, known as
the Dr. Vallo Benjamin Project.
The roof of the house is fiat and we were not able to determine where surface water runoff is
directed. There were no visible gutters and downspouts. It is believed to be directed into
drywells. The ground from the bluff top slopes away from the bluff face so there is no danger
of surface runoff causing damage.
Annual weeds, dense vines and some trees are present on the bluff face. The weeds and
vines have been cut back across the upper portion of the bluff. There are some cut logs and
stumps left on the bluff face. It is recommended that the debris of the trees be removed and
that the vines and weed cover be left in place. Other existing trees on the bluff face should
also be cut down to their bases and removed, leaving their root systems intact. On the east
side of the property leading down the bluff face appears to be an old ravine that has a stairs
built into the ground using four by fours in a terrace effect. Along the side slopes of the ravine
there appears to be little vegetation. It is recommended that the slope be planted to salt and
drought tolerant grasses, vines and shrubs such as 'Cape American Beachgrass', Virginia
Creeper and Bayberry. The landowner may contact us for Plant Materials Specification
Sheets and a List of Suppliers.
On the beach there are two jetties which appear to be formed naturally by glacial erratics.
There are also many rocks and boulders on the east side of the bluff toe acting as riprap
protecting the toe of the bluff. It appears that the bluff is relatively stable at this time.

On the west side of the house where the pool and deck are proposed, the ground is relatively
flat. The slope is away from the bluff towards the south and west. There doesn't appear to be
any problems with the location of the pool and deck, however, pool water discharge should not
be allowed to be directed over the bluff face.

WHEREAS, a public hearing was held and concluded on August 8,
1985, in the Matter of the Application of OTTO ZAPF, Appeal No. 3381;
and
WHEREAS, the board members have considered all testi, mony
documentation entered into the record in this matter; and it i_s
noted that there has been no public opposition; and

WHEREAS, the board members are personally familiar with the
premises in question and the surrounding properties; and

1. By this application, appellant requests permission to
locate an 28' by 28' accessory storage structure in the frontyard
area with a requested setback from the westerly property line at
not closer than 20 feet and from the south property line at not

2. The parcel in question is located in the "A-80" Residen-
tial and Agricultural Zoning District, contains an area of three
acres and is identified on the Suffolk County Tax Maps as District
1000, Section 013, Block 2, Lot 4.
3. The subject premises is presently improved with one
single-family dwelling situate approximately 320 feet from its
front (south) property line. For the record, it is noted that
the structure depicted "pcb cott" at the northeast corner on the
survey dated December 19, 1984, has been removed entirely.

4. For the record it is also noted that a conditional
approval of access and conditional alternative access route have
been granted under Appeals No. 3062 dated February 4, 1983, and

5. It is apparent that in locating the requested accessory
garage-storage structure in the limited buildable rearyard area
near the bank along the L.I. Sound, a variance would also be
required under Article XI, Section 100-119.2. The board finds that
the area chosen is the most practical concerning the character,
size, shape and location of the property in question.
In considering this appeal, the board finds and determines
that: (1) the relief requested will not be detrimental to
adjoining properties; (2) there will be no substantial change
in the character of this district; (3) the relief requested
will not cause a substantial effect of any increased population
density; (4) the circumstances of this appeal are unique;
(5) the difficulty cannot be obviated by some method feasible
for appellant to pursue other than a variance; (6) the
interests of justice will be served by granting the variance
applied as noted below.

commences at a point on the northerly side of Main Road (running along
the easterly boundary of a 2.232 acre parcel now or formerly of Kyrkos-
tas) running northerly 424.08 feet, a width of 15 feet, thence running
northeasterly and northerly 1597.22 feet, thence running northwesterly
and northerly 50.09 feet to the driveway area of the parcel in question.
It is noted for the record that this is an alternative choice
of access for the owner of the parcel in question, and in the event
the Owner does not choose this alternative access, then the prior

the difficulty cannot be obviated by a method feasible for appellant
other than a variance; that the relief requested will be in harmony

off the north side of Main Road, Orient, NY; subject parcel being
bounded on the north by the Sound; west by Wilsberg; south by Reese;

The public hearing on this application was held on October 21, 1982,
at which time the hearing was declared closed, pending reinspection and
deliberations.
The board made the following findings and determination:
By this application, appellant seeks approval of access over a
private right-of-way at the north side of the Main Road (State Route 25),
which right-of-way is shown to have a width of 10 feet, extending from
a point at the southeasterly corner of other premises of the applicant
(Kyrkostas), northerly a length of 1647.31 feet to the premises in question
(3.136 acres). After inspection and investigation, the board finds that
this right-of-way is the only legal recorded access to the premises
in question. The premises in question contains an area of 3.136 acres
as shown on survey dated June 6, 1967 by VanTuyl & Son, L.S. and is more
particularly identified as County Tax Map District 1000, Section 013,
Block 02, Lot 004. For the record it is noted that the property to the
west of this right-of-way is a pending major subdivision entitled, "Hill
Crest Estates at Orient; and it is noted that along the easterly side of
the subject right-of-way, there is a 25'-wide right-of-way owned now or
formerly by Harrison Demarest, Sr., but over which the applicant herein
does not have a legal access.
It is the consensus of the board, after inspecting the subject
right-of-way, that the right-of-way should be widened to 15' where
possible, and that improvements are necessary for sufficient access.
In considering this appeal, the board determines the variance
request will not cause detriment to adjoining properties; that the
circumstances herein are unique; that the difficulty cannot be
obviated by a method, feasible to appellants, other than a variance;
that no adverse effects will be produced on available governmental
facilities of any increased population; that the relief requested
will be in harmony with and promote the general purposes of zoning;
and that the interests of justice will be served by allowing the
variance as indicated below.

Gentlemen:
We have received the above application requesting a variance for new
construction, to be located at less than 100 feet from the top of the L.I. Sound bluff.
(A copy of the applicant's sketch is attached together with a copy of the County Tax
Map of the general area). Information relative to our review is provided as follows:
Construction proposed: deck addition to swimmingpool at west side of
dwelling maintaining a greater nonconforming setback than existing
dwelling. Site Location: 1000-13-2-4 at 29315 Main Road, Orient.
Would you please provide an evaluation and suggestions relative to the bluff
and immediate area for possible concerns or affects due to the proposed
construction. A public hearing will be held March 2, however, if more time is
necessary, please let us know and an extension would be available to keep our
record open, pending receipt of your evaluation.
