No. 4887— VICTOR BECK PARCEL 87-3-56 STREET ADDRESS: 2215 Minnehaha Boulevard, Southold DATE OF PUBLIC HEARING: November 16, 2000 FINDINGS OF FACT PROPERTY FACTS/DESCRIPTION: Applicant's property is located along Minnehaha Boulevard at Laughing Waters, Southold. A survey prepared by Stanley J. Isaksen shows an existing dwelling on a 10,5610.23 sq. ft. parcel. This property has frontage along Minnehaha Boulevard on the east and south property lines. BASIS OF APPEAL: Article XXIV, Section 100-244B based on the Building Inspector's October 5, 2000 Notice of Disapproval for the reason that the proposed addition will exceed the code limitation of 20% for lot coverage by all building construction. AREA VARIANCE RELIEF REQUESTED BY APPLICANT: Proposed 20x20 ft. garage addition, or 400 sq. ft. of additional lot coverage. The existing garage at the north end of the dwelling will be converted to additional living area (bedroom). REASONS FOR BOARD ACTION, DESCRIBED BELOW: (1) The grant of the area variance will not produce an undesirable change in character of neighborhood or a detriment to nearby properties. The increase is only 2.7% of the overall lot size. An increase of lot coverage at 284 sq. ft. over the allowable 20% will not be visually noticeable. (2) The benefit sought by the applicant cannot be achieved by some method, feasible for applicant to pursue, other than an area variance. It will not be feasible to remove any existing construction areas for a garage. (3) The requested area variance is not substantial, representing 2.7% of the total lot size. (4) The proposed garage will not have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district. The garage will meet the code setback requirements and will be located off the area presently used as a garage (proposed to be converted for additional bedroom area). In considering this application, the Board deems the grant of an increased lot coverage for a garage, as the minimum necessary and adequate, and at the same time preserves and protects the character of the neighborhood, and the health, safety, welfare of the community. , '• Page 2- 11/16/00 Appl. The hardship begins with the the current garage. It is a large(almost a two car garage) originally detached from the house.The house was subsequently modified and extended to attach to the garage. This is fine except that the side door of the garage leading into the house enters into the master bedroom. We have lived with this condition but it is not always easy. Deliver persons,plumbers other maintenance personneTperiodically walk into the open garage and knock on the bedroom door.Recently a long time good friend of the family from out of town, came to visit. When she arrived the driveway garage door was open so she proceeded to enter the house from the garage and was embarrassed to find herself in the master bedroom. The current garage isnot quite wide enough for two cars but makes up for that in depth, and provides some much needed storage space. The proposed added garage area is only 46.1 square feet larger,but because of the shape it will accommodate a second car. Since my wife and I both drive and own two cars in this our retirement home, and we would like to avoid inclement weather whenever possible as we get older,we do not think this is unreasonable. In fact during the planning of this project it was realized that the addition of a single car garage could be used and get just under the 20%area limitation, however we would be loosing a substantial portion of space for thingslike bicycles and other items normally found in a garage. In addition to the above,last year we were awarded custody of our now three year old granddaughter and have,for a number of months, been addressing options to correct the above situation as well as provide more room for a growing family.Although we have three bedrooms(two very small)all are occupied. Mrs. Beck suffers from a long term crone ailment that requires her to sleep alone,the child in the tiny one&Mr. Beck in the third.
