No. 4755 - EDWARD WETZEL STREET & LOCATION: 30 Second Street, New Suffolk 1000-117-10-20.4 DATE OF PUBLIC HEARING: October 14,1999; November 18, 1999 FINDINGS OF FACT PROPERTY FACTS/DESCRIPTION: The applicant's property consists of 5,450 sq. ft. in area with 100 ft. frontage along the west side of Second Street, New Suffolk. The property is improved with a one-story cottage as shown on the survey map prepared by Peconic Surveyors, P.C. and updated March 18, 1999. BASIS OF APPLICATION: Building Inspector's August 25, 1999 Notice of Disapproval which states that the application for a building permit to "construct a 2nd story addition and porch addition" encroaches on the rear yard setback. Under Article MV, Section 100-244 nonconforming lots require thirty-five (35) feet for a rear yard setback and lot coverage is limited to 20%. AREA VARIANCE RELIEF REQUESTED: By application for a building permit dated July 6, 1999, applicant is requesting a second story addition and porch addition which reduces the rear yard setback from 30 feet to 23+- feet, and increases lot coverage to 31+- sq. ft. over the 20% limitation. Applicant is also requesting that the Board rescind Conditions under former Appl. No. 1597 which restrict the property to seasonal use as a cottage. REASONS FOR BOARD ACTION, DESCRIBED BELOW: Based on the testimony and record before the Board and personal inspection, the Board makes the following findings: 1. The percentage of lot coverage requested will not negatively impact the surrounding properties because it is a balance between the necessary part of the maintenance and enjoyment by applicants of their property and the general community which is a seasonal community. 2. Since the lot in question is significantly substandard, any specific alteration of seasonal dwelling would require a variance. 3. The area variance is not substantial and the Board concurs that regular maintenance and updating of the seasonal dwelling would require a minimum variance as applied for (lot coverage for porch and roof alteration-expansion/second-story addition). 4. Since the total area around said parcel contains all substandard lots and applicant is not expanding toward community resort area, there will be no adverse effect to physical or environmental conditions of the neighborhood. 5. In considering this application, the Board deems this action to be the minimum necessary and I n Page 2 - December 14, 1999 ZBA Appl. MR. WETZEL: The proposed extension is a 7 foot extension. There's going to be a porch on the side there and it'll come to the rear. The house is going to remain a single family, two people, retirement cottage, modest in size and not over powering, similar in style, appearance and occupancy in the neighborhood and the neighbors is not oppose to changes. CHAIRMAN GOEHRINGER: Except for one neighbor. I received one note. Did you receive it? MR. WETZEL: No, we didn't. CHAIRMAN GOEHRINGR: OK, we'll give you that. Reading from your notes here, I'm not sure that there's an objection, there's a matter of concern. Let me rephase that statement because I did meet with that neighbor on Saturday. Lets see I'm reading from the notes that you gave us. You're showing the a, what's this 21 sq. ft. over and 31 sq. ft. over, issue that you have? Are you familiar with that? WETZEL: Less 1%, right. I actually got another figure as well, 20.3% which comes out to 21 ft. sq., so, between 20.6 and 20.3. CHAIRMAN GOEHRINGER: Is the house presently heated as it stands right now? MR. WETZEL: No. CHAIRMAN GOEHRINGER: No. I think the best way to deal with this aspect from the concerns of the neighbor, is to give you a copy of this. I have to get a copy so we may have to take a short recess to copy it for you. But, we also need you to do is, as I have spoken to your father, and that is, to modify your application regarding the 1972 decision of this Board and so we'll have you back on November 18th. You can address the issues with the neighbor. My suggestion is possibly speaking to the neighbor. MR. WETZEL: Beforehand. CHAIRMAN GOEHRINGER: Beforehand, OK. He is of course the gentleman that does not live in that house. This is Mr. Leary, he lives on the other side of Cutchogue. I have a three page thing, which actually four pages, which includes, it's not a thing, it's a document, which includes his survey and some particular concerns he has. GENERAL CONDITIONS General Condition 1: Facility Inspection by the Department The permitted site or facility, including relevant records, is subject to inspection at reasonable hours and intervals by an authorized representative of the Department of Environmental Conservation (the Department) to determine whether the permittee is complying with this permit and the ECL. Such representative may order the work suspended pursuant to ECL 71-0301 and SAPA 401(3). The permittee shall provide a person to accompany the Department's representative during an inspection to the permit area when written or verbal notification is provided by the Department at least 24 hours prior to such inspection. A copy of this permit, including all referenced maps, drawings and special conditions, must be available for inspection by the Department at all times at the project site. Failure to produce a copy of the permit upon request by a Department representative is a violation of this permit. General Condition 2: Relationship of this Permit to Other Department Orders and Determinations Unless expressly provided for by the Department, issuance of this permit does not modify, supersede or rescind any order or determination previously issued by the Department or any of the terms, conditions or requirements contained in such order or determination. General Condition 3: Applications for Permit Renewals or Modifications The permittee must submit a separate written application to the Department for renewal, modification or transfer of this permit. Such application must include any forms or supplemental information the Department requires. Any renewal, modification or transfer granted by the Department must be in writing. The permittee must submit a renewal application at least: a) 180 days before expiration of permits for State Pollutant Discharge Elimination System (SPDES), Hazardous Waste Management Facilities (HWMF), major Air Pollution Control (APC) and Solid Waste Management Facilities (SWMF); and b) 30 days before expiration of all other permit types. No claim shall be made against the State of New York on account of any such removal or alteration. 2. The State of New York shall in no case be liable for any damage or injury to the structure or work herein authorized which may be caused by or result from future operations undertaken by the State for the conservation or improvement of navigation, or for other purposes, and no claim or right to compensation shall accrue from any such damage. 3. Granting of this permit does not relieve the applicant of the responsibility of obtaining any other permission, consent or approval from the U.S. Army Corps of Engineers, U.S. Coast Guard, New York State Office of General Services or local government which may be required. 4. All necessary precautions shall be taken to preclude contamination of any wetland or waterway by suspended solids, sediments, fuels, solvents, lubricants, epoxy coatings, paints, concrete, leachate or any other environmentally deleterious materials associated with the project. 5. Any material dredged in the conduct of the work herein permitted shall be removed evenly, without leaving large refuse piles, ridges across the bed of a waterway or floodplain or deep holes that may have a tendency to cause damage to navigable channels or to the banks of a waterway. 6. There shall be no unreasonable interference with navigation by the work herein authorized. 7. If upon the expiration or revocation of this permit, the project hereby authorized has not been completed, the applicant shall, without expense to the State, and to such extent and in such time and manner as the Department of Environmental Conservation may require, remove all or any portion of the uncompleted structure or fill and restore the site to its former condition. No claim shall be made against the State of New York on account of any such removal or alteration. 8. If granted under 6NYCRR Part 608, the NYS Department of Environmental Conservation hereby certifies that the subject project will not contravene effluent limitations or other limitations or standards under Sections 301, 302, 303, 306 and 307 of the Clean Water Act of 1977 (PL 95-217) provided that all of the conditions listed herein are met. 9. At least 48 hours prior to commencement of the project, the permittee and contractor shall sign and return the top portion of the enclosed notification form certifying that they are fully aware of and understand all terms and conditions of this permit. Within 30 days of completion of project, the bottom portion of the form must also be signed and returned, along with photographs of the completed work and, if required, a survey. 10. All activities authorized by this permit must be in strict conformance with the approved plans submitted by the applicant or his agent as part of the permit application. During construction, concrete or leachate shall not escape or be discharged, nor shall washings from transit mix trucks, mixers, or other devices enter tidal wetlands and or protected buffer areas. 2. Any debris or excess material from construction of this project shall be completely removed from the adjacent area (upland) and removed to an approved upland area for disposal. No debris is permitted in tidal wetlands and or protected buffer areas. 3 There shall be no disturbance to vegetated tidal wetlands or protected buffer areas as a result of the permitted activity. 4 All areas of soil disturbance resulting from this project shall be stabilized immediately following project completion or prior to permit expiration, whichever comes first. The approved methodologies are as follows: a. Stabilization of the entire disturbed area with appropriate vegetation (grasses, etc.). 5. The storage of construction equipment and materials shall be confined to within the project work site and or upland areas greater than 75 linear feet from the tidal wetland boundary. 6. To protect the values of the tidal wetlands, a permanent vegetated buffer zone shall be established There shall be no disturbance to the natural vegetation or topography within an area extending 50 linear feet landward of the tidal wetland boundary 7. A row of staked hay bales or approvable erosion control devices shall be placed at the landward edge of the buffer area or 50 linear feet from the tidal wetland boundary, at commencement of regulated activities and remain in place until project is completed and all disturbed areas stabilized with vegetation. 8. Roof runoff must be directed to drywells a minimum of 75 linear feet landward of the most landward edge of the tidal wetland boundary, and must be installed a minimum of 2 feet above seasonal high groundwater. 9 This permit does not authorize any alteration, expansion or replacement of existing septic systems. The premises in question is a parcel of land located on the westerly side of Second Street, New Suffolk, more particularly known as County Tax Map District 1000, Section 117, Block 10, Lot 20.7, having an area of 7,231 square feet. There is presently erected on the lot a private one -family dwelling with porch and the deck under consideration. The dwelling without the deck has a frontyard setback of approximately 142 feet from Second Street. Appellant previously applied to this Board for approval of the subject deck in Appeal No. 2693, which was denied. The relief requested in this application is synonymous to the previous appeal. Appellant in this appeal has set forth the practical diffi- culties in removing the deck and the reasons for locating the deck as applied for rather than in the rear yard or other side yard areas. Upon personal inspection of the premises, the Board finds that the existing structure and deck would exceed 20% of the lot coverage of the total lot area; and it is the feeling of the Board to grant the variance herein technically would not warrant justification. In considering this appeal, the board determines that the variance request is not substantial; that the circumstances herein are unique; that by allowing the variance no substantial detriment to adjoining properties would be created; that the difficulty cannot be obviated by a method, feasible to appellant, other than a variance; that no adverse effects will be produced on available governmental facilities of any increased population; that the relief requested will be in harmony with and promote the general purposes of zoning; and that the interests of justice will be served by allowing the variance. Following deliberations, the board took the following action: WHEREAS., a public hearing was held and concluded on January 9, 1986 in the Matter of FRANK E. AND MARY L. BROPHY under Appeal No. 3437; and WHEREAS, the board has considered all testimony and documentation entered into the record concerning this application, including numerous letters in opposition and three in favor of this application;.and WHEREAS, the board members have personally viewed and are familiar with the premises in question as well as its'surrounding area; and WHEREAS, the board made the following findings of fact: 1. The property in question is known and referred to as 75 Second Street, New Suffolk, Town of Southold, and is identified on the Suffolk County Tax Maps as District 1000, Section 117, Block 10, Lo.t 20._.7. 2. By letter dated November 26, 1985, a request is made for a rescission of a previously issued variance under Appeal No. 2922 (rendered December 17, 1981). 3. The relief granted under Appeal No. 2922 was for the construc- tion of a 10' by 12' deck addition with a setback of not less than 6'6" from the front property line and approximately 10'6" setback from the southerly side property line. 4. The zoning code requirements during 1981 for the frontyard setback of the addition was 142 feet, which was the existing structure's setback at that time, and the sideyard setback requirement was 11'6". 5. For the record it is noted that the zoning code was amended by Local Law #9-1983, adopted August 9, 1983, permitting.a minimum sideyard setback at 10 feet. (The restriction as to the minimum front yard has not changed since the 1981 variance.) 6. Also noted for the record are the prior decisions of this board rendered: (a) under Ap.pea.l No. 2693 on May 22, 1980; (b) under Appeal No. 2725 on August 28, 1980; (c) under Appeal Southold Town Bow. - of Appeals -16- Febru,.., 6, 1986 Regular Meeting (Appeal No. 3437 - BROPHY, decision, continued:) No. 2788 on April 23, 1981, all as described in each record. 7. It is the opinion of the board that appellants' request to rescind the action which approved the construction of a 10' by 12' deck addition will reestablish the property's conformity as to its front yard setback as existed previously at 142 feet. 8. It should be noted that future construction, including bedroom additions, decks, roofed patios, accessory buildings, etc. are restricted to the maximum -permitted 20% lot coverage requirements as well as all other setback and zoning requirements of the code; and that by allowing this variance for the permanent removal of the deck and rescission of Action taken under Appeal No. 2922, the deck will not be reconstructed. In considering this application, the board has determined: (a) the relief requested is_ unique; (b) the relief requested is not substantial, being in relation to the zoning requirements since the dwelling's frontyard setback will be reestablished at 142 feet; (c) by removing the deck, there will be no substantial change in the character of this district; (d) the public health, welfare and safety of the town will be served by upholding this application; (e) there is no other method available for the appellants to pursue other than a variance; (f) the spirit of the zoning ordinance will best be served by allowing the variance, as noted below. Accordingly, on motion by Mr. Doyen, seconded by Mr. Sawicki, it was RESOLVED, that the relief granted under Appeal No. 2922 by resolution of this board rendered December 17, 1981, BE AND HEREBY IS RESCINDED, and the deck construction be REMOVED PERMANENTLY. Southold Town Hall, Main_Road., Southold, New York 11971. Present were: Gerard P. Goehringer, Chairman; Charles Grigonis, Jr., Serge Doyen, Robert J. Douglass and Joseph H. Sawicki, constituting all five members of the Board of Appeals. Also present were: Victor Lessard, Building -Department Administrator, Linda Kowalski, Board Clerk, and approximately 30 persons at the beginning of the meeting. The Chairman opened the meeting at 7:30 p.m. and proceeded with the following deliberations and decision pending in the Matter of PAUL LEARY under Appeal No. 3489 concerning premises of FRANK E. AND MARY BROPHY, 75 Second Street, New Suffolk, NY: Application of PAUL LEARY for a reversal of decision of the building inspector for a nullification of actions by the Building Department to issue a modified Permit and Demolition Permit, and that the property owners be left to regular procedures of law, to be allowed only after review by the Board of Appeals and in accordance with all other provisions of law. Name of Owners and Location of Property in Question: FRANK E. AND MARY BROPHY, 75 Second Street, New Suffolk, NY; County Tax Map Parcel No. 1000-117-10-20.7. This is an Appeal of Paul Leary of two determinations of the Building Inspector with respect to (1) the granting of Building Southold Town Board -of Appeals -2- September 11, 1986 Regular Meeti (Appeal No. 3489 - LEARY/BROPHY, continued:) Permit No. 14319Z, dated October 3, 1985 to Peter R. Brophy, as agent for Frank and Mary L. Brophy, to make alteration and addition to an existing dwelling at premises located at 75 Second Street, New Suffolk, New York (Suffolk County Tax Map District 1000, Section 117, Block 10, Lot 020.7) and (2) the granting of a building permit No. 14638Z, dated March 11, 1986, to Peter Brophy, as agent for Frank and Mary Brophy, to partially demolish existing dwelling at premises located at 75 Second Street, New Suffolk, New York. Hearings were held by this Board on May 1, 1986, June 19, 1986 and July 17, 1986, at which hearings the attorneys for the Appellant and for Mr. Brophy introduced in evidence numerous docu- ments and presented extensive oral arguments on numerous issues. From the Appellant's petition, it appears that Appellant bases his appeal on the following: (a) That under Appeal on July 27, 1972, it imposed a "no improvements be made to the Board of Zoning Appeals." No. 1,597 rendered by this Board condition in its decision that property without approval of the (b) That an Environmental Impact Statement should be required pursuant to Article 8 of_the_Environmental Quality Review Act (SEQRA) and Chapter 44 of the Town Code. (c) That the issuance of the Building Permit was in violation of the Flood Management Prevention Law (Chapter 46) of the Town Code. (d) That the Building Permit issued violated the Zoning Code in that it permitted the _construction and/or alteration of a building with an area in excess of 20% of the lot area. The issues raised will be considered in the order set forth above. (a) Under Appeal No. 1597 decided on July 27, 1972, this Board authorized the division of premises at New Suffolk into six separate lots, one of which was the premises which are the subject of this appeal. In its decision, the Zoning Board of Appeals imposed five conditions. The second condition, which is at issue here, provides as follows: "No improvements can be made without approval of the Board of Appeals by the provisions Southold Town Board of Appeals -3- September 11, 1986 Regular Meetin, (Appeal No. 3489 - LEARY/BROPHY, decision, continued:) of the Ordinance relating to lot coverage." It is the position of the Appellant that this condition must be construed to mean that any improvement requires the approval of this Board. The Attorney for Brophy maintains that such condition should be construed to mean that the approval of this Board is required only in cases in which such an improvement results in the building area exceeding 20% of the lot area. This Board con- strues condition 2 to mean that this Board's approval is only required when improvements would result in the building area exceeding 20% of the lot area. (b) With respect to the SEQRA questions raised by Appellant, this Board can find no provision of Article 8 of the Environmental Quality Review Act or the rules promulgated pursuant thereto, or Chapter 44 of the Town Code which confers upon this Board jurisdiction to pass upon determinations of an administrative officer with respect to SEQRA proceedings, nor does this Board believe that it has jurisdiction to pass upon determinations of an administrative officer with respect to SEQRA proceedings, nor does this Board believe that it has jurisdiction to review its own SEQRA determinations made in a previous appeal. It would seem that review of SEQRA deter- minations are reserved to the courts. (c) The Appellant's claim that the Building Inspector issued the Building Permit in violation of the Town's Flood Management Protection Law is without merit. The record contains Development Permit No. 100F issued on March 11, 1.986, pursuant to the Town's Flood Management Protection Law. (d) The assertion that the building area exceeded 20% of the lot area is not borne out by the several maps introduced at the hearing. The only map indicating lot coverage in excess of 20% was the Sealand map dated May 13,_.1986, which erroneously included the area of the patio at t_he rear entry to the dwelling, which, since it was at ground level, should not have been included in the calculation of building area pursuant to the definition contained in Section 100-13 of the Zoning Code. In his petition, appellant dwelt heavily on the question of the demolition permit being issued during or after the fact and that the Building Permit first permitted an alteration and was thereafter amended to permit the reconstruction of the subject dwelling. Since no evidence was presented on these issues tending to show that such acts by the Building Inspector Southold Town Boara-uf Appeals -4- Septembc, 11, 1986 Regular Meeting (Appeal No. 3489 - LEARY/BROPHY, decision, continued:) were improper or illegal, such contentions are dismissed. Accordingly, on motion by Mr. Goehringer, seconded by Mr. Grigonis, it was RESOLVED, that for all of the above reasons, the appeal herein is in all respects dismissed. Subsequent to the close of the hearing., Appellant's attorney, by letter dated July 24, 1986, submi_tted.- se_v_eral photo- graphs of the subject dwelling showing "radius" steps at the rear entry; an open porch and steps at the front entry, and a retaining wall in the front yard area. Such letter and photos were returned by the Chairman on July 28, 1986 with a letter advising that the hearing was closed and no further evidence would be considered. By letter dated August 1, 1986, Appellant's attorney resubmitted his photographs and moved to reopen the hearing. For the purpose of deciding the motion to reopen the hearing, the Board reviewed such letter and photographs. S'ection 100-13 of the Zoning Code defines "Building Area." Subsection 2(b) thereof excludes from such definitions "steps and open porches projecting not more than 5 feet from the exterior walls and having an area of less than 30 sq. ft." It would appear from such photos that the steps and open porch fall within subdivision 2(b), and therefore, are to be excluded from the calculation of "building area." The "structure" located in the front yard is obviously a retaining wall and is excluded from the definition of a "building" in Section 100-13(3) of the Zoning Code. The receipt of such evidence would, in the Board's opinion, add nothing to Appellant's case, and no useful purpose would be served by reopening the hearing and, accordingly, the motion to reopen the hearing is denied.
