Box 1179 Southold, New York 11971 ZBA Fax (516) 765-9064 Telephone (516) 765-1809 PROPERTY FACTS/DESCRIPTION: The applicant's property consists of 1.7+- acres with a 16. ft. strip of land fronting along the north side of North Road and 15+- ft. strip of land fronting along the east side of Sound Road, Greenport. The building area of the property is located in the Limited Business (LB) Zone District. A 15+- ft. strip of land extending from the North Road was acquired from an abutting landowner about 1998. BASIS OF APPLICATION: Building Inspector's June 24, 1999 Notice of Disapproval citing Article VII, Section 100-82 of the Zoning Code with respect to a proposed 12 ft. setback from the southerly property line instead of the code requirement of 20 feet for a proposed single-family dwelling structure. AREA VARIANCE RELIEF REQUESTED: Applicant is proposing to relocate and connect two accessory buildings to the existing one-story building while adding a 20.5 x 22.5 addition. The use of the principal building is proposed to be a single-family dwelling. The variance requested is a southerly (side) setback at 12 feet instead of 20 feet. (No other areas are noted in the Notice of Disapproval, which is the basis of applicants' request.) REASONS FOR BOARD ACTION, DESCRIBED BELOW: Based on the testimony and record before the Board and personal inspection, the Board makes the following findings: 1. Grant of the area variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The barn has been in its present location with a side yard setback of 12 feet for more than 30 years with no adverse impacts on the neighborhood. The proposed addition of the single-family residence to the barn in order to create one single-family dwelling structure will not alter or increase the existing side yard setback. 2. The benefit sought by applicant cannot be achieved by some method, feasible for appellant to pursue, other than an area variance. The barn, as it exists, is an accessory structure. However, when the single-family residence is relocated and attached to the barn, it would become, by code definition a principal structure. The newly classified principal structure would require a 20 -foot side yard setback, even though the existing footprint and 12 -foot setback of the barn would not change. No other alternative is economically feasible since relocation of the barn would be too costly, as would a lot line change that would require demolition of an existing garage. The requested area variance is not substantial because the existing setback of the barn will not change after it has been combined with and converted into a principal single-family residence. 4. The proposed variance will not have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district. The proposed improvements and renovation of the combined structures will be an attractive benefit to the neighborhood. 5. The difficulty has not been self-created. In considering this application, the Board finds that the relief requested is the minimum necessary and adequate for the applicants to enjoy the benefit of a principal single-family dwelling structure, and that grant of such relief will preserve and protect the character of the neighborhood and the health, safety, welfare of the community. RESOLUTION/ACTION: On motion by Member Tortora, seconded by Chairman Goehringer, it was RESOLVED, to GRANT the variance as applied for. REASON FOR APPEAL ( ) A Variance to Section 280A Subsection, 3 ( x) A Variance to the Zoning Ordinance Is requested for the reason that APplicant.:i5 converting existing barn to single family residence,by attaching the existing residence to the barn. conn Zni (Continue on other side) Reason for Appeal Continued Zoning Board of Appeals re: Bobbie Zorn Pursuant to Town Law section 267b-3 the Southold Town Zoning Board of Appeals is to analyze and asses the personal benefits anticipated by the applicant against the potentially deleterious effects that a grant of the relief requested would have on the health, safety and welfare of the effected neighborhood or community. In performing this balancing test, the Zoning Board is charged with the responsibility to consider the five factors enumerated in Town Law Section 267b -3(b). The variance should be granted for the following reasons: 1. No undesirable change will be produced in the character of the neighborhood or a detriment to nearby properties, if the variance is granted. The property contains a small single family residence and a large stucco barn. The existing house would be moved and relocated next to the Barn and attached as one principal structure. The Barn was to serve as an office for the adjacent "Shady Lady" restaurant and B&B. However, the renovations to the restaurant were delayed by the building inspector's determination that the residence over the restaurant was "accessory use" and therefore required New York State Board of Review hearing. Due to the delay in renovations, the Barn has been improved and with the relocation of the residence will be converted into a single family house. 2. The benefit sought by the applicant can not be achieved by some method, feasible for the applicant to pursue, other than an area variance. We considered two alternatives in addition to the proposed application. The first alternative was a lot line change. The lot line change would have resulted in creation of an undersized lot and would require the demolition of an existing garage. The second alternative considered was the relocation of the Barn rather than the house. However relocation of the barn was structurally much more difficult and costly. Both properties are owned by the applicant, the set back of the Barn does not impact Mrs. Zorn and the simpler and more practical approach is to seek a variance from the side yard for the Barn. 3. The area variance is not substantial The application of the balancing test weighs in favor of the grant of the variance. The subject property and adjacent property are owned by Mrs. Zorn. The Barn is existing and the setback will not change. The variance is required because the Barn becomes, by definition, a principal building rather than an accessory building. The Barn now requires a 20 foot setback even though the Barn does not change in it's appearance or location. 4. The variance will have no adverse effect or impact on the physical or environmental conditions in the neighborhood or district. The Barn was located on the property prior to zoning, the Barn's location will not change. The relocation of the house will permit the full use of the Barn as living quarters. The property is commercially zoned and contains a very small single family residence. The parcel has been greatly improved with extensive plantings, painting, and remodeling of all the structures. The neighborhood has been supportive to Mrs. Zorn's improvements to the property and her investment in the community. 5. The alleged difficulty was not self-created. 6. The variance requested is the minimum variance practicable given the personal benefits anticipated by the applicant. The Barn was remodeled, intended to be used as an office for Shady Lady, but the renovations to the restaurant have been delayed. The zoning code prevents the Barn from being converted to sleeping quarters since there exists a very small residence on the property, however, the relocation of the small residence and attaching it to the Barn is a creative approach to solving applicant's housing needs.
