PROPERTY FACTS/DESCRIPTION: The applicant's property consists of 1.7+- acres with a 16. ft.
strip of land fronting along the north side of North Road and 15+- ft. strip of land fronting along
the east side of Sound Road, Greenport. The building area of the property is located in the
Limited Business (LB) Zone District. A 15+- ft. strip of land extending from the North Road was
acquired from an abutting landowner about 1998.
BASIS OF APPLICATION: Building Inspector's June 24, 1999 Notice of Disapproval citing Article
VII, Section 100-82 of the Zoning Code with respect to a proposed 12 ft. setback from the
southerly property line instead of the code requirement of 20 feet for a proposed single-family
dwelling structure.
AREA VARIANCE RELIEF REQUESTED: Applicant is proposing to relocate and connect two
accessory buildings to the existing one-story building while adding a 20.5 x 22.5 addition. The use
of the principal building is proposed to be a single-family dwelling. The variance requested is a
southerly (side) setback at 12 feet instead of 20 feet.
(No other areas are noted in the Notice of Disapproval, which is the basis of applicants' request.)
REASONS FOR BOARD ACTION, DESCRIBED BELOW: Based on the testimony and record before
the Board and personal inspection, the Board makes the following findings:
1. Grant of the area variance will not produce an undesirable change in the character of the
neighborhood or a detriment to nearby properties. The barn has been in its present location with
a side yard setback of 12 feet for more than 30 years with no adverse impacts on the
neighborhood. The proposed addition of the single-family residence to the barn in order to create
one single-family dwelling structure will not alter or increase the existing side yard setback.
2. The benefit sought by applicant cannot be achieved by some method, feasible for appellant to
pursue, other than an area variance. The barn, as it exists, is an accessory structure. However,
when the single-family residence is relocated and attached to the barn, it would become, by code
definition a principal structure. The newly classified principal structure would require a 20 -foot
side yard setback, even though the existing footprint and 12 -foot setback of the barn would not
change. No other alternative is economically feasible since relocation of the barn would be too
costly, as would a lot line change that would require demolition of an existing garage.

3. The requested area variance is not substantial because the existing setback of the barn will not
change after it has been combined with and converted into a principal single-family residence.
4. The proposed variance will not have an adverse effect or impact on the physical or
environmental conditions in the neighborhood or district. The proposed improvements and
renovation of the combined structures will be an attractive benefit to the neighborhood.
5. The difficulty has not been self-created.
In considering this application, the Board finds that the relief requested is the minimum necessary
and adequate for the applicants to enjoy the benefit of a principal single-family dwelling structure,
and that grant of such relief will preserve and protect the character of the neighborhood and the
health, safety, welfare of the community.
RESOLUTION/ACTION: On motion by Member Tortora, seconded by Chairman Goehringer, it was
RESOLVED, to GRANT the variance as applied for.

Pursuant to Town Law section 267b-3 the Southold
Town Zoning Board of Appeals is to analyze and asses the
personal benefits anticipated by the applicant against
the potentially deleterious effects that a grant of the
relief requested would have on the health, safety and
welfare of the effected neighborhood or community. In
performing this balancing test, the Zoning Board is
charged with the responsibility to consider the five
factors enumerated in Town Law Section 267b -3(b). The
variance should be granted for the following reasons:
1. No undesirable change will be produced in the
character of the neighborhood or a detriment to nearby
properties, if the variance is granted.
The property contains a small single family
residence and a large stucco barn. The existing house
would be moved and relocated next to the Barn and
attached as one principal structure.
The Barn was to serve as an office for the adjacent
"Shady Lady" restaurant and B&B. However, the
renovations to the restaurant were delayed by the
building inspector's determination that the residence
over the restaurant was "accessory use" and therefore
required New York State Board of Review hearing. Due to
the delay in renovations, the Barn has been improved and
with the relocation of the residence will be converted
into a single family house.
2. The benefit sought by the applicant can not be
achieved by some method, feasible for the applicant to
pursue, other than an area variance.
We considered two alternatives in addition to the
proposed application. The first alternative was a lot
line change. The lot line change would have resulted in
creation of an undersized lot and would require the
demolition of an existing garage. The second alternative
considered was the relocation of the Barn rather than
the house. However relocation of the barn was
structurally much more difficult and costly. Both
properties are owned by the applicant, the set back of
the Barn does not impact Mrs. Zorn and the simpler and
more practical approach is to seek a variance from the
side yard for the Barn.
3. The area variance is not substantial The
application of the balancing test weighs in favor of the
grant of the variance.
The subject property and adjacent property are owned
by Mrs. Zorn. The Barn is existing and the setback will
not change. The variance is required because the Barn
becomes, by definition, a principal building rather than
an accessory building. The Barn now requires a 20 foot
setback even though the Barn does not change in it's
appearance or location.
4. The variance will have no adverse effect or impact
on the physical or environmental conditions in the
neighborhood or district.
The Barn was located on the property prior to
zoning, the Barn's location will not change. The
relocation of the house will permit the full use of the
Barn as living quarters. The property is commercially
zoned and contains a very small single family residence.
The parcel has been greatly improved with extensive
plantings, painting, and remodeling of all the
structures. The neighborhood has been supportive to
Mrs. Zorn's improvements to the property and her
investment in the community.
5. The alleged difficulty was not self-created.
6. The variance requested is the minimum variance
practicable given the personal benefits anticipated by
the applicant.
The Barn was remodeled, intended to be used as an
office for Shady Lady, but the renovations to the
restaurant have been delayed. The applicant has

directed her attentions to improving the house and Barn.
The zoning code prevents the Barn from being converted
to sleeping quarters since there exists a very small
residence on the property, however, the relocation of
the small residence and attaching it to the Barn is a
creative approach to solving applicant's housing needs.

§ 58-1. Providing notice of public hearings.
[HISTORY: Adopted by the Town Board of the Town of
Southold 12-27-1995 as L.L. No. 25-1995. Amendments
noted where applicable.]
§ 58-1. Providing notice of public hearings.
Whenever the Code calls for a public hearing, this section
shall apply. Upon determining that an application is complete,
the board or commission reviewing the same shall fix a time
and place for a public hearing thereon. The board or commission
reviewing an application shall provide for the giving of notice:
A. By causing a notice giving the time, date, place and
nature of the hearing to be published in the official
newspaper within the period prescribed by law.
B. By requiring the applicant to erect the sign provided by
the town, which shall be prominently displayed on the
premises facing each public or private street which the
property involved in the application abuts, giving notice
of the application, the nature of the approval sought
thereby and the time and place of the public hearing
thereon. The sign shall be set back not more than ten
(10) feet from the property line. The sign shall be
displayed for a period of not less than seven (7) days
immediately preceding the date of the public hearing.
The applicant or his/her agent shall file an affidavit that
s/he has complied with this provision.
C. By requiring the applicant to send notice to the owners
of record of every property which abuts and every
property which is across from any public or private street

Re: Chapter 58 — Public Notice for Wednesday, August 18, 1999 Hearing
Dear Applicant:
Please find enclosed a copy of the Legal Notice describing your recent application. The
Notice will be published in the next issue of the Suffolk Times.
Pursuant to Chapter 58 of the Southold Town Code (copy enclosed), formal notice of your
application and hearing must be mailed and shall include a map or sketch showing the new
location with the setbacks and use noted. Send this Notice CERTIFIED MAIL, RETURN
RECEIPT REQUESTED, as soon as possible, with the map to all owners of land (vacant or
improved) surrounding yours, including land across any street or right-of-way that borders
your property. Use the current addresses shown on the assessment rolls maintained by the
Town Assessors' Office (765-1937) or the County Real Property Office in Riverhead. If you
know of another address for a neighbor, you may want to send the notice to that address
as well.
Please submit your Affidavit of Mailing to us by the Friday before the hearing date, with the
post office receipts postmarked. Later, when the green signature cards are returned to you
by the Post Office, please mail or deliver them to us. If any signature card is not returned,
please advise the Board at the hearing.
You must post the enclosed sign no later than 8/10/99. Post the sign facing the street, no
more than 10 feet from your front property line bordering the street. (If you border more
than one street or roadway, a sign is enclosed for the front yard facing each one.) The
sign(s) must remain in place for at least seven (7) days, and if possible, should remain
posted through the day of the hearing. If you need a replacement sign, please contact us.
After the signs have been in place for seven (7) days, please submit your Affidavit of
Posting to us for the permanent file.
If you do not meet the deadlines stated in this letter, please contact us promptly. It may
be necessary to cancel your hearing if the required steps are not followed.

Wood -I -Beams and LVL products or equal. All Joists, girders and
headers Shall have bears stiffeners installed as per manufacturers
recommendations. Web stiffeners shall be required at all load and
bearing points at a minimum. A single 1 3/4" LVL rim Joists shall be
required at floor perimeters, Handling, storage and erection of
components shall be as per manufacturers recommendations.
