Box 1179 Southold, New York 11971 ZBA Fax (516) 765-9064 Telephone (516) 765-1809 PROPERTY FACTS/DESCRIPTION: The applicant's property is a corner lot located on the southerly side of the Main Road (State Route 25) and the westerly side of Truman's Path, in East Marion. The property consists of a total lot area of approximately one-half acre with 98.50+- ft. frontage along the Main Road, and 221.90 ft. along Truman's Path (a private, traveled right-of-way). BASIS OF APPLICATION: Building Inspector's January 21, 1999 Notice of Disapproval citing Article )XIII, Section 100-232B of the Zoning Code with respect to a berm constructed under Building Permit #24893Z, for the reason that the berm exceeds the maximum height requirement for a front yard and for a corner lot of two intersecting roadways. Article )XIII, Section 100-232B states: B. On all corner lots, berms, walls, fences and hedges or any other potential obstruction to vision shall not exceed a height of two and one-half (2 112) feet above the average street level within an isosceles triangle having thirty-foot sides along each street to preserve sight lines for traffic. AREA VARIANCE RELIEF REQUESTED: Applicant requests a Variance for the berm at approximately 36" from ground, in the area restricted at 30 ft. from the intersecting corner of the property, in both directions. Applicant stated that the remaining portions of the berm will meet the code's height limitation of 48" (maximum) within front yard areas on this corner lot. INFORMATION AND EVIDENCE CONSIDERED BY THE BOARD: 1. Applicant has testified that although he originally constructed the berm in accordance with the Town Code requirement, the Suffolk County Water Authority rebuilt the berm as part of a water main installation project. The rebuilt berm altered its original dimensions and height, which exceed the height limit and are the subject of this variance request. 2. The Zoning Board Chairman met at the site with the applicant to reach a compromise that would take into consideration visual and safety factors. The applicant has agreed to reduce/amend his request, and the Zoning Board of Appeals finds that the amended request is acceptable and reasonable. REASONS FOR BOARD ACTION. DESCRIBED BELOW: Based on the testimony and record before the Board and personal inspection, the Board makes the following findings: 1. Grant of the area variance, as amended, will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties because the revised/reduced berm will not have a negative visual impact on the neighborhood or create unsafe traffic conditions. . ,, a v Page 2 - June 7, 1999 ZBA Appl. The benefit sought by applicant cannot be achieved by some method, feasible for appellant to pursue, other than an area variance because after the berm was reconstructed by the Suffolk County Water Authority, it exceeded the Town Code's height requirement. 3. The requested area variance is not substantial and exceeds the height limit by not more than 12 inches. 4. No evidence has been submitted or presented to indicate that the grant of an area variance will have an adverse impact on the physical or environmental conditions in the neighborhood or district. 5. The difficulty has not been self-created and is due to improper reconstruction of the berm by the Suffolk County Water Authority. In considering this application, the Board deems this action to be the minimum necessary and adequate to enable the applicants to enjoy the benefit of a berm, while preserving and protecting the character of the neighborhood and the health, safety, welfare of the community. RESOLUTION/ACTION: On motion by Member Tortora, seconded by, it was RESOLVED, to GRANT the variance, as amended by applicant and described below: 1. The berm shall be reduced to a maximum height of 30 inches for the first 16 feet of distance (commencing from the northeast corner of the property at the intersection) in both directions; and 2. The berm shall be limited to its existing height for next 12 ft. (within the 30 ft. long restricted area) at a maximum of 42 it 3. The remaining portions of the berm shall not exceed the cod( requirement at 48 inches along or within front property lines rn h 4. Wiggii Cc: Southold Town Building Department ATTACHMENT # 1: The berm was originally constructed in accordance with the provisions of 100-232-B, or more specifically, with the corner at the 2 % foot height. When my wife and I were on vacation in Northern New York during the Columbus Day weekend, an official of the Suffolk County Water Authority located me and asked permission for them to remove the eastern most section of the berm and use a portion of my front lawn as a temporary roadway for Trumans Path traffic during water main installation with the understanding that they would rebuild it to the original dimensions. Being a public minded citizen, I gave my approval. When we returned that portion of the berm had been rebuilt at the same height as the other portion, and top soil applied, and shrubs provided by the landscaper. When the Suffolk County Water Authority was asked to correct their work, "it was not in their contract", and the contractor had left the job and would not be back. "Sorry." Because of the distance back from the highway, I am of the opinion that going to the personal expense of lowering the corner of the berm would in no way improve sight lines. (See enclosed series of pictures.) 4 - //1/i6: V ATTACHMENT # 2: Pictures taken in sequence from drivers side of vehicle as it proceeds from South to North on Trumans Path and approaching Route 25: # 1 — Approaching the corner of the berm. # 2 — Opposite the corner of the berm. Please note lowering the near section does not increase visibility. # 3 — Slightly past the corner of the berm. Again, please note that lowering the not increase visibility. # 4 — Past the end of the berm — corner section opposite rear of vehicle. # 5 — Front of vehicle at edge of pavement well back, of travel lane; berm behind vehicle and has no impact of driver's visibility. I have had Peter Harris of the New York State Highway Department inspect the site and he stated, "The berm as presently constructed is so far back from the highway that it does not interfere with visibility of State highway traffic approaching from either the East or the West". The Notice will be published in the next issue of the Suffolk Times. Pursuant to Chapter 58 of the Southold Town Code (copy enclosed), formal notice of your application and hearing must be mailed and shall include a map or sketch showing the new location with the setbacks and use noted. Send this Notice, as soon as possible, with the map to all owners of land (vacant or improved) surrounding yours, including land across any street or right-of-way that borders your property. Use the current addresses shown on the assessment rolls maintained by the Town Assessors' Office (765-1937) or the County Real Property Office in Riverhead. If you know of another address for a neighbor, you may want to send the notice to that address as well. Please submit your Affidavit of Mailing to us by the Friday before the hearing date, with the post office receipts postmarked.
