residing at 7480 Peconic Bay Blvd.. Laurel N.Y., as
pm of the consideration for the issuance of the Permit does undecstand and prescribe to the fol-
lowing:
I. That the said Board of Trustees and the Town of Southold are released from any and
aR damages, or d~lm~ for d~,-~ges, of suits arising directly or indirectly as a result of any ope~-
ataon performed pursuant to this permit, and the said Pennittee will, at his or her own expense,
defend any and all such suits initiated by third parties, and the said Pesmittee assumes fnl! liability
with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Sottthold
2. That this Permit is valid for a period of 7.4 mos. which is considered to be the
estimated time required re complete the work involved, but should clrcumsomces wasrang request
for an extension may be made to the Board at a later date.
3. That this Permit should be retained inde~iultely, or as long as the said Permittee wishes
to maintain the structure or project involved, to provide evidence to anyone concerned that anth.
orization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or
its agents, and non-compliance with the provisions of the originating applicefion, may be cause for
revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the werk
herein authorized.
6. That there shall be ne interference with the fight of the public to pass and repass aioag
the beach between high and low water marks.
7. That if future operations of the Town of Southold require the removal and/or alterations
in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, ~ae
work shall came unreasonable obstmcUon to free navigation, the said Permit-tee will be requlsed~
upon due notice, to remove or alter this work or project herein stated without expenses to the Town
of SoutholcL
8. That the said Board will be notified by the Parmittee et the completio~ of the work anth-
orized.
9. That the Pecmltten will obtain all other permits and conSesXts that may be tequlrecl sap-
plementai to this permit which may be subject to revoke upon failure to obtain same.

Dear :
The following action was taken by the Board of Town Trustees during
its regular meeting held on January 17, 1991 regarding the above
matter:
WHEREAS, JOHN GABUSI applied to the Southold Town Trustees for a
permit under the provisions of the Wetland Ordinance of the Town of
Southold, application dated December 11, 1990 and,
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and recommendations,
and,
WHEREAS, a public hearing was held by the Town Trustees with respect
to said application on January 17, 1991 at which time all interested
persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar
with the premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation
submitted concerning this application, and,
WHEREAS, the Board has determined that the project as proposed will
not affect the health, safety and general welfare of the people of
the town,
NOW, THEREFORE BE IT
RESOLVED THAT JOHN GABUSI BE AND HEREBY IS GRAI~TED PERMISSION UNDER
THE WETLAND ORDINANCE TO: replace existing storm damaged bulkhead
within 18" of existing bulkhead located on 7480 Peconic Bay Blvd.,
Laurel.
This permit will expire two years from the date it is signed. Fees
must be paid, if applicable, and permit issued within sixmonths
of the date of this notification. Two inspections are required and
the Trustees are to be notified upon completion of said project.
Please return tothe Building Department tora determination on the
need for any other permits which may be required for this project.
Permit will be issued upon payment of the following fees for work to

Dear Mr. Gabusi:
The following action was taken by the Southold Town Board of
Trustees on Thursday, December 20, 1990:
RESOLVED that the Southold Town Board of Trustees grant a
negative declaration on the above mentioned proper~y.
RESOLVED that the Southotd Town Board of Trustees grant the
applicant permission to proceed with this project as there is a
potential for a environmental hazard if the existing bulkhead is
further destroyed.
Please note that the application process will proceed as normal.

RESOLVED that pursuant to Article 8 of the Environmental Conservation
Law, State Environmental Quality Review and 6NYCRR Part 617, ~
Section 617.10 and Chapter 44 of the Code of the Town of Southold,
notice is hereby given that the Southold Town Trustees, as Lead
Agency for the action described below, has determined that the
project will not have a significant effect on the environment.
Please take further notice that this declaration should not be
considered a determination made for any other department or agency
which may also have an application pending for the same or similar
project.
TYPE OF ACTION:
DESCRIPTION OF ACTION: to replace existing storm damaged bulkhead
within 18" of existing bulkhead.

REASONS SUPPORTING THIS DETERMINATION:
1. An on site inspection has been conducted by the Board of
Trustees.
2. An environmental assessment, submitted by the applicant and
reviewed and completed by the Board of Trustees, has indicated that
no significant adverse effects to the environment are likely to occur
should the project be implemented as planned.
