PROPERTY FACTS: The applicants' property consists of 40,000 sq. ft. in area and is known as
Lot #37 on the Map of Harbor Farm Estates, in Mattituck. The lot has 153.54 ft. frontage along
Meadow Beach Lane and variable depth of 292.42 ft. (west side) and 235 ft. (east side). The lot is
improved with a single-family, two-story dwelling as shown on the September 28, 1998 "final
survey."
BASIS OF APPLICATION: Building Inspector's September 7, 1999 Notice of Disapproval under
Article III, Section 100-33 for the reason that the accessory building is not proposed in a required
rear yard.
AREA VARIANCE RELIEF REQUESTED: Applicant requests a variance authorizing the proposed
location of a 24 ft. by 28 ft. two -car garage at the end of the driveway, ten (10) feet from the east
side property line and 130 feet from the front property line. The garage will face the side of the
house.
REASONS FOR BOARD ACTION, DESCRIBED BELOW: On the basis of testimony presented,
materials submitted and personal inspection, the Board makes the following findings:
(1) Grant of the area variance will not produce an undesirable change in the character of the
neighborhood or detriment to nearby properties because the garage is proposed in an area which
gives the appearance of a rear yard with a setback distance 130 feet from the road (front property
line) and the garage entrance doors will face the side of the house.
(2) The benefit sought by applicant cannot be achieved by some method, feasible for appellant to
pursue, other than an area variance because the garage is used for storage of owners' vehicles
and if placed at the rear of the house there would not be convenience and easy access.
(3) The requested area variance is not substantial.
(4) There is no evidence that grant of the variance will have an adverse effect or impact on the
physical or environmental conditions in the neighborhood or district.

adequate to enable applicants to enjoy the benefit of an accessory garage, while preserving and
protecting the character of the neighborhood and the health, safety and welfare of the community.
RESOLUTION/ACTION: On motion by Member Dinizio, seconded by Member Tortora, it was

NOTICE IS HEREBY GIVEN, pursuant to Section 267 of the Town Law and Chapter 100 (Zoning), Code
of the Town of Southold, the following application will be held for public hearing by the SOUTHOLD TOWN
BOARD OF APPEALS at the Town Hall, 53095 Main Road, Southold, New York 11971, on THURSDAY,
NOVEMBER 18, 1999 at the time noted below (or as soon thereafter is possible):
6:45 p.m. Appl. No. 4760 - S. and S. VITOLANO. This is a request for a Variance under Article III, Section
100-33 based upon the September 7, 1999 Building Department Notice of Disapproval, for the location of a

Dear Applicants:
Please find enclosed a copy of the Legal Notice describing your recent application. The
Notice will be published in the next issue of the Suffolk Times.
Pursuant to Chapter 58 of the Southold Town Code (copy enclosed), formal notice of your
application and hearing must be mailed and shall include a map or sketch showing the new
location with the setbacks and use noted. Send this Notice CERTIFIED MAIL, RETURN
RECEIPT REQUESTED, as soon as possible, with a copy of the map to all owners of land
(vacant or improved) surrounding yours, including land across any street or right-of-way
that borders your property. Use the current addresses shown on the assessment rolls
maintained by the Town Assessors' Office (765-1937) or the County Real Property Office in
Riverhead. If you know of another address for a neighbor, you may want to send the
notice to that address as well.
Please submit your Affidavit of Mailing to us by the Friday before the hearing date, with the
post office receipts postmarked. Later, when the green signature cards are returned to you
by the Post Office, please mail or deliver them to us. If any signature card is not returned,
please advise the Board at the hearing.
You must post the enclosed sign no later than 11/11/99. Post the sign facing the street,
no more than 10 feet from your front property line bordering the street. (If you border
more than one street or roadway, a sign is enclosed for the front yard facing each one.)
The sign(s) must remain in place for at least seven (7) days, and if possible, should remain
posted through the day of the hearing. If you need a replacement sign, please contact us.
After the signs have been in place for seven (7) days, please submit your Affidavit of
Posting to us for the permanent file.

Mr. Vitolano indicated that the garage is being moved back 12 feet - and the plan he submitted is
not the location he is requesting.
Applicant's question to us was: Where does the building need to be staked, at the location on the
map or the location where he is going to place it? The answer given was it should be staked at the
location being requested - and the map and the staking should be the same.
There was some difficulty when we requested the applicant send a confirmation of the requested
location - the applicant thought we were trying to refuse the application. ZBA office then took the
application documents and confirmed that they will be reviewed by the Chairman and Board, and
confirmed that a letter would follow as to the next step and if any other information was required.
The applicant is awaiting a letter from the Chairman after review of the papers.
