Box 1179 Southold, New York 11971 ZBA Fax (516) 765-9064 Telephone (516) 765-1809 PROPERTY FACTS/DESCRIPTION: The subject land is vacant and comprises approximately 1.67 acres of total lot area. The property has two front yard areas and a large portion of the property contains freshwater wetland areas which may not be disturbed. This property officially has two road frontages. It is bordered to the south by a well -traveled, paved East End Road, which is a privately owned extension of the Town Road named Oriental Avenue. The property is bordered on the east by another well -traveled but unnamed hard scrabble, dirt private road. The applicant's property is bordered on the west by CTM Lot 1000-4- 5-17.2 (Dietrick & ano), whose northerly property line also abuts the right-of-way mentioned below and is the road cited by the Notice of Disapproval. In addition, the subject lot is bordered on the north by a gravel and dirt dead-end right-of-way which serves as a private driveway for both the immediate northerly neighbor on the developed 2.5+- acre parcel (CTM 1000-4-5-19.5) and for the adjacent developed 1.7+ acre parcel (CTM 1000-4-5-10). The driveway for Parcel 1000-4-5-19.5 begins 150+- feet from the easterly beginning point of the right-of-way, and this neighbor's house is located 150+- feet south of said right-of-way. The other neighbor's driveway on Parcel 1000-4-5-10 begins 500+- feet from the aforementioned beginning point of this right-of-way, at what is now the westerly end of the right-of-way. BASIS OF APPEAL: The Building Inspector's February 9, 1999 Notice of Disapproval (updated February 25, 1999), which states that under Article XXIV, Section 100-244, nonconforming lots with areas between 60,000 and 79,999 sq. ft. shall have a minimum front yard setback of fifty- five (55) feet. Zone: R-120 Residential. AREA VARIANCE RELIEF REQUESTED: Applicant is requesting a variance from the Zoning Code to reduce the setback of a proposed dwelling from 55 feet to 32 feet, as a minimum, from one of the private roads on which this property abuts. REASONS FOR BOARD ACTION. DESCRIBED BELOW: After consideration of the entire record, testimony at the public hearing and other evidence, the Board finds the following facts to be true and relevant: The uneven topography of the applicant's parcel greatly restricts the ability to properly site a building because the property contains a large pocket of low elevation and wetlands, particularly Page 2 -'May 20, 1999 Re: 1000-4-5-18 at F.I. These constraints have become the basis for the applicant's request for a variance since the three front yards and substantial wetland areas create two separate hardships which impact development of this property. This situation, however, does not make this parcel unusable for a single-family residence, as is reflected by the applicant's successful acquisition of a valid D.E.C. permit and the Town Trustees' approval of this project. 1) The granting of the setback variance will not produce an undesirable change in character of neighborhood or detriment to nearby properties because this is a preexisting parcel of 1.67+ - acres in an R-120 Residential Zone District, and the construction of a single-family dwelling on this site will not change the nature of the sparsely developed, privately owned exclusive neighborhood located on eastern Fishers Island. 2) The benefit sought by the applicant cannot be achieved by some method, feasible for applicant to pursue, other than an area variance because the topography of the parcel includes a large wetland area and does not allow for much flexibility in selecting a building site. 3) The requested area variance is not substantial because the variance is necessary because of the third front yard. The applicant conforms to the zoning requirements for the other two front yards, which are more consequential. 4) There is no evidence that the grant of the variance will have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district. The grant of the variance will allow for the least possible environmental impact to this property and to neighboring properties. 5) The alleged difficulty has not been self-created because it is related directly to the existing wetland areas, and the uneven topography and related characteristics of the land. In considering this application, the Board deems the grant of the setback variance to be the minimum necessary and adequate to preserve and protect the character of the neighborhood, and the health, safety, welfare of the community. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces- soryllARD511IP because the existence of what are effectively three front yards and wetlands on the property make it impossible for the owners to conform to the Zoning Code. 2. Tire hardship created is UNIQUE and is not shored by all properties alike in the irnrnediate vicirnity of this property and in this use district because of the abundance of wetland areas and the fact that the property is bordered by streets for much of the perimeter thereby producing several required front yard ;setbacks. 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CIIARACTER OF THE DISTRICT because all butoneof the front yard setbacks well exceed# the minimum requirement and the only one which does not, the one for which the Variance is 'requested, is: not part of the main FIDCO road system on the East End. An undesirables change will NOT be produced in, the character of the neighborhood or a detriment to nearby properties, if granted BECAUSE: the proposed dwelling is set back a great distance (well in excess of the minimum required) from the only streets which are substantially used. The benefit sought by the. applicant CANNOT be achieved by some, method, feasible for the applicant to, pursue, other than an area variance BECAUSE: if the applicant were to conform to the required 55-foot front yard setback, the structure would beimpermissiblyclose to existing wetlands on property. 3. The amount of relief requested is not substantial BECAUSE although there are several front yards, only one is nonconforming and the owner reduced the degree of nonconformity from 30 feet (60 feet less 30 feet) to 23 feet (55 feet less 32 feet). 4. The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district BECAUSE by encroaching to some extent on only one front yard, the owners can locate their proposed dwelling at an environmentally safe distance from the wetlands. 5. Ham, III April 22, 1999 Application of Stephen Scace and Jennifer Scace (SCTM # 1000-4-5-18) This Memorandum is being submitted in support of the application of Stephen and Jennifer Scace (Application No. 4677) for a variance relating to premises owned by them at East End Road, Fishers Island, New York (SCTM # 1000-4-5-18). VARIANCE REQUESTED The applicants are requesting a variance to the Southold Town Zoning Code (the "Zoning Code") to permit the construction of a single-family residence at their 1.67 - acre parcel as shown on the Site Plan for Stephen and Jennifer Scace prepared by Chandler, Palmer & King, dated May 15, 1991, last revised February 22, 1999. Under the proposed plan, the Scaces are requesting a variance to permit the proposed dwelling to be located at a minimum distance of 32 feet from one of the private roads on which their property abuts. This variance relates to the requirements under Section 100-244.13 of the Zoning Code pursuant to which lots with an area of 1 60,000-79,999 square feet are required to have a front yard of 55 feet. Since the use of the single-family dwelling with a deck is a permitted use in this R-120 Zone District and the relief sought relates to the dimensional and physical requirements of the Zoning Code, the requested variance is an area variance. Town Law § 267.1. Therefore, the standards of Town Law §267-b(3)(b) apply. The factors to be considered by a zoning board of appeals in making a determination regarding an area variance under Town Law § 267-b(3)(b) are as follows: (1) the benefit to the applicant as weighed against the detriment to the health, safety and welfare of the neighborhood; (2) whether an undesirable change will be produced in the character of the neighborhood or to nearby properties; (3) whether the benefit sought can be achieved in another manner; (4) whether the variance is substantial; (5) whether the variance will have an adverse effect on physical or environmental characteristics; and (6) whether the alleged difficulty was self-created. An examination of the circumstances present in the instant matter in light of the foregoing factors follows. 1. Relative Benefit and Detriment. The Scaces intend to build a moderately- sized home (less than 1,500 square feet) with no accessory structures on a 1.67 -acre parcel in a residential zone. The parcel is considered a separate building lot (Block 16 - Lot 8) on the Map of Fishers Island Development Corporation (the "FIDCO Map") that has been approved by the Town Planning Board and Suffolk County Department of Health Services ("SCDHS") and filed with the Suffolk County Clerk. An excerpt from the FIDCO Map showing the subject premises is attached hereto as Exhibit A.. If the property cannot be improved with a use consistent with the Zoning Code, it has no utility. Under these 2 U circumstances it is not'unreasonable for the applicants to obtain the benefit of a dwelling, a use that is obviously consistent with many other properties in the area. There should be no detriment to the health, safety or welfare of the neighborhood by the granting of the requested variance. Approvals of the FIDCO Map by the Planning Board and SCDHS contemplate the future existence of a dwelling on this parcel. There will be no significant increase in noise or traffic. The applicants or their predecessor, Anthony M. Petrilli, have gone through extensive review procedures by the Southold Town Trustees, the SCDHS and the New York State Department of Environmental Conservation ("NYSDEC"). Conditions to the approvals assure environmental protection. While there will be some change to the physical characteristics at the site, the overall impact should be slight as discussed in Sections 2 and 5 below. 2. Character of the Neighborhood. The addition of a single-family dwelling in the proposed location will not result in an undesirable change in the neighborhood or to nearby properties. That location was negotiated with and suggested by NYSDEC with input from the Town Trustees. The "road"from which the dwelling would be set back is essentially a driveway which serves just one or two homes. According to surveyor Richard Strouse and permit expediter Glenn Just, both of whom have visited the site on numerous occasions, in sharp contrast to the visual impact it would have were it -located in the only other feasible site on this property, the dwelling would not even be visible from the main East End Road if it is built in the proposed location. Moreover, if it were moved to the south to satisfy the 55 -foot setback requirement, the dwelling would not only be visible from the main East End Road, it would have a greater impact on the 3 wetlands as well. There are other factors that suggest the new dwelling would have little impact on the neighborhood. As shown by the cross -hatching on the excerpt from the FIDCO Map attached as Exhibit A, the closest adjoining real estate (designated as FIDCO Lots 16-7A and 7B) is not even a building lot. (FIDCO Lots 16-7A and 7B are actually merged with the old FIDCO road and FIDCO Lot 16-1, all of which comprise the parcel designated on the Suffolk County Tax Map as number 1000-4-5-19.5.) Furthermore, while FIDCO has already approved the applicants' building plans, it will still require a landscaping plan which will undoubtedly provide further isolation of the new dwelling. (See letter from FIDCO attached as Exhibit B.) 3. Alternatives. Due to the existence of substantial wetland areas, the proposed site for the house is the only feasible one. While the dwelling could conceivably be built farther to the south or even within the required building envelope off East End Road (possibly reducing the extent of required zoning relief), not only would those locations likely result in even smaller setbacks from the wetlands, they would produce a dwelling that would be much closer to East End Road and therefore more visible by neighborhood residents and others. Due to these practical difficulties of constructing a single-family dwelling at this site, the benefit sought cannot possibly be achieved in another manner. There is simply not a location on this parcel where the dwelling could be built without the owners coming into conflict either with the Zoning Code or the applicable laws and regulations governing construction near wetlands. The circumstances giving rise to the difficulties are clearly unique to the property and not the result of some personal whim of the owners. 4 4. Substantial Nature of Variance. Requesting a reduction of the minimum setback by about forty percent, the applicants do not contend that the requested variance would be insubstantial. However, the substantial nature of the variance is far outweighed by the presence of other factors, including the size and configuration of the subject parcel, its extensive front yards, the existence of wetlands, the absence of an adverse impact on the neighborhood and community, and the lack of a feasible alternative. Also, as previously noted, while the dwelling would be only 32 feet from the property line, the "road" on which it fronts is essentially a driveway for one or two homes and the adjoining property to which it would be closest cannot be lawfully improved with an additional single-family dwelling. Therefore, the impact would in fact be less severe than it might otherwise appear. 5. Impact on Physical and Environmental Conditions. The project is designed so that he impact on physical and environmental conditions at the site will be slight. Only a small portion of this 1.67 -acre parcel will be disturbed. Mrs. Scace has informed me that all intended clearing has already been performed. There will be minimal grading and no removal of fill from the site. The boulders will be used in the landscaping scheme. Furthermore, the applications to the Town Trustees, the SCDHS and NYSDEC relating to this site have undergone substantial and time-consuming review by those agencies that have the authority and the expertise to impose environmental safeguards. I am advised by Mr. Strouse of Chandler, Palmer & King that the proposed location was preferred by those agencies so that there would be maximum separation from 5 the septic system which would then also slope away from the wetlands at such location. All the relevant agencies have required numerous conditions to their approvals. For example, NYSDEC has required the installation and maintenance of staked straw bales along the base of a project -limiting fence. (Copies of the NYSDEC and Town Trustees Permits are attached hereto as Exhibits C and D, respectively.) 6. Self -Created Hardship. Self-created hardship is not an issue in this case. The proper permits have been obtained prior to construction; the applicants are not seeking to legitimize .an illegally built structure. In fact, the agencies charged with protecting the environment have gone through an extensive and time-consuming review process resulting in severe limitations on the use of this property, limitations over which the applicants have had no control. By the time the Scaces purchased the property in May 1998, the relevant environmental permits were in place. But even if they had acquired property knowing'there were possible environmental and zoning issues that had to be resolved, their rights to a variance would still depend on the circumstances peculiar to this property. Those rights are the same rights as any prior owners had and any future owners would have. CONCLUSION For the foregoing reasons and in the interests of justice, the variance requested in order to permit Mr. and Mrs. Scace to construct a single-family dwelling should be granted. N. Doherty, Jr. Manager In mid-December, after our meeting at Connecticut -Valley Homes, I met with your contractor, Tom Shillo from Z & S Contracting at the site. After touring the property a few times, we concluded the following. ' 1. The driveway should continue to follow the plan as submitted, meaning the route should go from the garage directly out to the dirt/paved road. The sight lines are more than adequate for safe passage. 2. During excavation for the,foundation, the material (rocks and fill) should be relocated to the low contour to the north. This accomplishes_ two things; the apparent number of large boulders can be used as a "retainer" for fill from the foundation. The fill then can be located behind (to the south) of the boulders raising the contour several feet. In effect this would break up the sight line from the "dirt road" to the new structure. Landscaping could then be employed to "plant out" the impact of the new structure. 3. The material from the driveway excavation should also be used to further enhance the new contour to the north of the house site. Tom Shillo indicated that this is a reasonable plan considering the rocks and fill would have to be disposed of off the site if not employed in this manner. Regarding landscaping, the Committee will need to approve a landscaping plan which should be finalized after the "rough" work is finished.
