Box 1179 Southold, New York 11971 ZBA Fax (516) 765-9064 Telephone (516) 765-1809 PROPERTY FACTS/DESCRIPTION_ The applicant's property consists of approximately 24,000 sq. ft. in area with 150167.64 ft. frontage along the south side of Peconic Bay Boulevard in Laurel. The property is improved with a two-story wood frame residence with asphalt and gravel driveway areas. BASIS OF APPLICATION: Applicant is requesting a Special Exception pursuant to Article III, Section 100-31, subsection B-13 for approval of an " Accessory Apartment" use within the footprint of applicant's existing principal residence. BOARD FINDINGS: In considering this application, the Board has reviewed the requirements set forth pursuant to Article III, Section 100-31B-13 for the Accessory Apartment and finds that the applicant complies with the requirements for the reasons noted below: 1. The Accessory Apartment is lozated within the footprint of applicant's dwelling. 2. The Accessory Apartment is subject to a Certificate of Compliance issued by the Town Building Inspector with respect to all other rules and regulations pertaining to occupancy, as well as the New York State and local Building and Fire Codes. 3. Ms. Maryellen Whiffet Thomson, the applicant herein, has through her attorney submitted a copy of her current deed indicating that she is owner of this property. The deed was recorded April 7, 1969 in the Office of the Suffolk County Clerk. The owner of the existing dwelling plans to continue occupancy of one of the dwelling units as her principal residence. 4. Applicant has submitted ;tre following information with regard to floor area: (a) the existing principal building contains a total of 2,150 sq. ft.; (b) the Accessory Apartment, presently occupied pursuant to a written M-�rnorandum of Lease, is 712 sq. ft.; (c) the remaining area for the owner's residence is 1,438 sqft. with 1,032+- sq. ft. downstairs and 406 sq. ft. upstairs. 5. The Accessory Apartment n eels the code required 450 minimum livable area and contains 712 sq. ft. of livable floor area. Page 2 - September 30, 1999 ZBA Appl. Accessory Apartment comprises 33% of the total 2,150 sq. ft. area of the existing building and therefore does not exceed the code limitation of 40 percent for an Accessory Apartment. 7. The applicant's plans comply with the on-site parking requirements and provide for a total of three parking spaces as a rninimum: two for the principal use and one for the Accessory Apartment. 8. The applicant meets the requirements for a dwelling unit as defined in 100-13 of the Zoning Code. 9. The plans indicate that exterior entry to the Accessory apartment of the existing building will retain the appearance of a one -family dwelling. 10. The existing building has a valid Certificate of Occupancy issued prior to January 1984 as required. Certificate of Occupancy No. Z-2249 was issued October 11, 1965 for an addition to the dwelling, and the dwelling existed prior thereto. 11. In addition, the applicant has agreed to comply with Section 100-31B g, j, k, I, n, o, p, and q. 12. In addition, the Board has reviewed the General Standards governing Special Exception uses set forth in Section 100-263 and firds that: No special exception approval shall be granted unless the Zoning Board of Appeals specifically finds and determines tl,,e following: A. That the use will not prevent the orderly and reasonable use of adjacent properties or of properties in adjacent use districts. B. That the use will not prevent the orderly and reasonable use of permitted or legally established uses in the district wherein the requested use is located or of permitted or legally established uses in adjacent use districts. C. That the safety, the health, the welfare, the comfort, the convenience or the order of the town will not be adversely affected by the Accessory Apartment use and its location. D. That the use will be in harmony with and promote the general purposes and intent of this chapter. E. That the use will be compatible with its surroundings and with the character of the neighborhood and of the cemrnunity in general, particularly with regard to visibility, scale and overall appearance. The other dwelling unit which is part of this application shall be leased for year-round occupancy, evidenced by a written lease for a term of one or more years, which will be filed annually. 3. The existing one -family dwelling shall contain not less than sixteen -hundred (1,600) sq. ft. of livable floor area. The accessory apartment shall contain not less than four -hundred fifty (450) square feet of livable floor area. 5. The accessory apartment shall not exceed forty (40%) percent of livable floor area of the existing dwelling unit. 6. A minimum of three off-street (on-site) parking spaces shall be provided.. as shown on the attached plan. 7. Not more than one (1) accessory apartment will be on this parcel. 8. The accessory apartment will meet the requirements of a dwelling unit as defined insSection .1 00-13 of the Zoning Code. 9. The ;exterior entry to the accessory apartment has not changed the existing exterior appearance of a one -family dwelling. 10. AiT exterior alterations to the existing building, except for access to the, apartment, is made on the existing foundation as shown on the attached plans. 11. I understand that the Certificate of Occupancy will terminate upon the transfer of title or upon the owner ceasing to occupy one of the dwelling units as the owner's principal residence; and that in the event of the owner's demise, the occupant of the accessory apartment may continue in occupancy until a new owner shall occupy the balance of the dwelling or one (1) year from date of said demise, whichever shall first occur. 12.
