1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or
unnecessary hardship because it would preclude Mr. Torre from pursuing his artistic talents
for profit and thus enabling him to supplement his retirement income. If he is not able to use
the existing barn on the property as a studio and gallery, the cost of access to suitable
facilities elsewhere would be prohibitive, and the perfectly good barn would stand unused..
2. The hard.qhip created is UNIQUE and is not shared by all properties alike in the immediate
vicinity of this property and in this use district because there is only one other residence in
the immediate vicinity and to the best of our knowledge the owner has no interest in the
making or retail sale of art at that location. Other properties in the area are either open land or
have farm buildings and associated facilities; the entrance to a LIPA right-of-way is across
Sound Avenue.
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE
THE CHARACTER OF THE DISTRICT because the only observable change would be the
addition of a sign near the road announcing the presence of the art studio and gallery. The
sign would be tasteful and appropriate. The surrounding properties are, with one exception
which is directly across Sound Avenue, non-residential. An active farm building complex is
in the immediate area; the remaining properties are open land.

been merged with the neighboring residential lot, these lots were separated by ZBA in
Appeal #2104 dated March 26, 1976 and have not merged."
6:45 p.m. Appl. No. 4740 - GEORGE and 3EAN BRAUN. This is a request, based upon the
July 22, 1999 Building inspector's Notice of Disapproval, for a Variance under Article III-A,
Section 100-30A.4 for approval of a side yard location of the existing accessory garage due to the
proposed construction of an addition to dwelling. · Existing garage is currently in the rear yard,

This Notice is issued pursuant to Part 617 of the implementing
regulations pertaining to Article 8 of the N.Y.S. Environmental Quality
Review Act of the Environmental Conservation Law and Local Law #44-4 of
the Town of Southold.

Dear Applicants:
Please find enclosed a copy of the Legal Notice describing your recent application. The
Notice will be published in the next issue of the Suffolk limes.
Pursuant to Chapter 58 of the Southold Town Code (copy enclosed), formal notice of your
application and heating must be mailed and shall include a map or sketch showing the new
IocaUon with the setbacks and use noted. Send this Notice CERTIFIED MAIL, RETURN
RECEIPT REQUESTED, as soon as possible, with the map to all owners of land (vacant or
improved) surrounding yours, including land across any street or right-of-way that borders
your property. Use the current addresses shown on the assessment rolls maintained by the
Town Assessors' Office (765-1937) or the County Real Property Office in Riverhead. If you
know of another address for a neighbor, you may want to send the notice to that address
as well.
Please submit your Affidavit of Mailing to us by the Friday before the hearing date, with the
post office receipts postmarked. Later, when the green signature cards are returned to you
by the Post Office, please mail or deliver them to us. If any signature card is not returned,
please advise the Board at the hearing.
You must oost the enclosed sign no later than 9/23/99. Post the sign facing the street, no
more than 10 feet from your front property line bordering the street. (If you border more
than one street or roadway, a sign is enclosed for the front yard facing each one.) The
sign(s) must remain in place for at least seven (7) days, and if possible, should remain
posted through the day of the hearing. If you need a replacement sign, please contact us.
After the signs have been in place for seven (7) days, please submit your Affidavit of
Posting to us for the permanent file.
If you do not meet the deadlines stated in this letter, please contact us promptly. It may
be necessary to cancel your hearing if the required steps are not followed.

Dear Applicant:
Please find enclosed a copy of the Legal Notice describing your recent application. The
Notice will be published in the next issue of the Suffolk Times.
Pursuant to Chapter 58 of the Southold Town Code (copy enclosed), formal notice of your
application and hearing must be mailed and shall include a map or sketch showing the new
location with the setbacks and use noted. Send this Notice, as soon as possible, with the
map to all owners of land (vacant or improved) surrounding yours, including land across
any street or right-of-way that borders your property. Use the current addresses shown on
the assessment rolls maintained by the Town Assessors' Office (765-1937) or the County
Real Property Office in Riverhead. l'f you know of another address for a neighbor, you may
want to send the notice to that address as well.
Please submit your Affidavit of Mailing to us by the Friday before the hearing date, with the
post office receipts postmarked. Later, when the green signature cards are returned to you
by the Post Office, please mail or deliver them to us. If any signature card is not returned,
please advise the Board at the hearing.
You must DOSt the enclosed sion no later than 5/12/99. Post the sign facing the street, no
more than 10 feet from your front property line bordering the street. (If you border more
than one street or roadway, a sign is enclosed for the front yard facing each one.) The
sign(s) must remain in place for at least seven (7) days, and if possible, should remain
posted through the day of the hearing. If you need a replacement sign, please contact us.
