No. 4717 -ANTHONY and CHERYL SCLAFANI 1000-52-2-29 STREET & LOCALITY: 790 Ruch Lane, Southold DATE OF PUBLIC HEARING: July 22,1999 FINDINGS OF FACT PROPERTY 'FACTS/DESCRIPTION: The applicants' propertyconsists of 12,145+ sq:. ft. in area with 75 ft. 'frontage along the easterly side of Ruch Lane (a private road), in Southold. The property is improved with a single-family dwelling, occupied by the applicants as their residence. Also existing is an accessory concrete- block garage building shown on the July 10, 1998 survey map prepared by Anthony W. Lewandowski, L.S. situated approximately 11 feet from the dwelling (at its closest point) and 3.4' ft. from the northerly side property' line. The existing garage has a bathroom, hot water heater and electric service (Certificate of Occupancy No. Z6764 dated November 3 1975). BASIS OF APPLICATION: Building Department's April 29, 1999 Notice of Disapproval citing Article III, Section' 100-31A(1) of the Zoning Code, stating that in applicant's request to add family quarters, "the proposed renovation in accessory garage would be a second dwelling on same rot. Pursuant to Article III, Section 100-31A(1), use regulabons,'one family detached dwellings not to exceed one dwelling on each lot. VARIANCE RELIEF REQUESTED: Applicants request permission to extend: family living quarters into the accessory building for`, applicant's elder parent (mother) during her :remaining years. The renovations -proposed are interior changes only, such as adding carpets, cabinets,' furniture, and extending lighting and other facilities for habitable quarters. There is a full bathroom as evidenced by Certificate of Occupancy No. Z6764 and Building Permit No 79322. No changes are proposed in the overhead doors or other exterior character of this accessory garage building. REASONS FOR BOARD ACTION, DESCRIBED BELOW: Based on the testimony and record before the Board and personal inspection, the Board makes the following findings: 1. Applicant purchased this property in. 1998 and intends shortly to.make it his full-time residence:. His 87 -year old ailing mother lives with him and his wife at his current full' -lime residence. The dwelling`on the subject parcel is small, and applicant contends that" withoutextensive structural changes; it is unsuitable for housing his mother along with himself and his wife. Applicant states that he has looked widely for suitable living accommodations in Southold for his mother. Because he has been unsuccessful, he proposes to renovate the garage into living quarters, and contends that this is less intrusive and less permanent than a structural addition to his house. 3. At the hearing on July 22, applicant stated that he is willing to accept restrictions that will allow no one other than his mother to occupy the renovated garage at any time. 4. Grant of the requested variance will not produce an undesirable change in the character of the neighborhood or detriment to nearby properties because the appearance of the garage will not change and the use of the garage as living quarters will be limited to applicant's elderly mother. 5. There .are no factors present to suggest that grant of the requested variance will have an adverse effect or impact on physical or environmental conditions. 6, The grant of the relief set forth below is the minimum action necessary and adequate to enable applicant to provide suitable living quarters for his mother while preserving ,and protecting the character of the neighborhood and, the health, safety, and welfare of the community. in considering this application, the Board deems this action to be the minimum necessary and adequate to enable the applicants to enjoy the benefit of temporary living quarters for applicants' parent, while preserving and protecting the character of the neighborhood and the health, -safety, welfare of the community. RESOLUTIONIACTION: On motion by Member Collins, seconded by Member Tortora, it was RESOLVED, to GRANT the variance, as applied for, SUBJECT TO THE FOLLOWING CONDITIONS: 1. The exterior,structural appearance of the garage shall not be altered. 2. At no time shall any person other than applicants' moth eroccupy the living quarters in the garage, and this authorization shall terminate upon termination of her occupancy. 3. Upon termination of the elder Mrs. Sdafani's occupancy, the kitchen facilities shall be removed in their entirety. - 4. If not earlier terminated in accordance with Condition 2 above, this authorization will terminate on the fifth anniversary of the date of this Re solotia provided, however, that if applicants' mother is stili in occupancy at that time, applicant shall advise the Board each r in writing, of the status of the occupancy for a possible extension of time RECEIVED r u ancy y applicants' mother. As is common in former summer cottages, the dwelling contains a living room, kitchen, three l lxl2 bedrooms and one small bathroom. The amenities in the garage include a full bathroom, hot water heater, and electric service with fuse box and breakers. Applicants have made no changes to the garage since the purchase. The neighborhood consists of small rectangular lots. There are many small summer cottages as well as cottages•converted to year-round occupancy. The subject parcel is .125 of an acre and fronts on Arshamomque Pond. It is among the largest waterfront lots on Ruch Lane, a private road. This summer, Mr. Sclafani will retire after 30+ years as a Suffolk County police officer. He and his wife intend to move to the premises as full-time residents of Southold. Mr. Sclafani's 87 -year- old mother currently resides with them in Ridge and also will be moving to Southold as a full-time resident. Although applicants have attempted to find other quarters for the elder Mrs. Sclafani, they have been unable to locate suitable housing as a result of the tight real estate market. Moreover, for medical reasons, it is advisable for the elder Mrs. Sclafani to be located close to her only child - Mr. Sclafani, And, because of her frequently severe bouts with colitis, Mrs. Sclafani needs the privacy of a separate bathroom. Accordingly, the applicants seek the Board's permission to covert the garage into family quarters for Mr. Sclafani's mother. They request permission to renovate the garage in order to create family quarters while retaining but renovating the existing bathroom. The work would, of course, be done to Code. The applicants intend to discontinue the use after the elder Mrs. Sclafani vacates the premises. 1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unnecessary hardship because (a) The tiny one-story dwelling is not conducive to occupancy by an extended family. (b) Applicants have been unable to locate other suitable off-site housing for the elder Mrs. Sclafani. (c) Adding a second story to the dwelling would not provide private quarters for the applicants or the elder Mrs. Sclafani, who will have difficulty in climbing stairs. 2. The hardship created is UNIQUE and is not shared by all of the properties alike in the immediate vicinity of this property and in this use district because the change of use sought is temporary and limited to the applicants and the elder Mrs. Sclafani. 3. With regards to variance relief requested, the last line states there is to be no changes in the overhead doors of the garage. I am in need of your permission to take one foot off the block wall, which is on each side of the existing garage door, so I may be able to put two new garage doors with a center column and a longer header for better support. All this in keeping with the character of the garage building, which are the wishes of the Zoning Board of Appeals. The existing fiberglass door installed in 1970, has two holes and is not a good insulation to help with the project I am about to undertake to provide living quarters for my Mom. The dwelling as exists is shown to be set back approximately eight feet from the top of the bank near Peconic Bay highwater mark and approximately 656 feet from the most northerly (front) property .line. The accessory building utilized for sleeping quarters is located 650+- feet from the northerly (front) property line; 24+- feet from the westerly (side) property line, and 83+- feet from the top of the bank near the Peconic Bay highwwater mark The accessory storage building was converted by Building Permit No. 12904Z to a three -car garage and is located north of the existing principal dwelling structure. 4. For the record, the following data is noted for reference and consideration: (a) approval was found indicated that this parcel is known as Lot #3 and a part of a minor subdivision approved by the Southold Town Planning Board on April 16, 1973 in the name -of Andrew Hahn - during the period of one -acre residential zoning. One of the requirements set by the Planning Board at that time was a filed covenant that there be'no further subdivision; (b) subsequently, on July 29, 1982, an application was made and conditionally approved by the Southold Town Board of Appeals under Appl. No® 2986 for approval of the conversion of one of the existing accessory buildings permitting two bedrooms as sleeping quarters for the applicant's mother-in-law (family) and guest use; (c) the premises continued, up until May 1983, to be zoned one -acre residential; (d) during,october 1987, the applicants asked the Planning Board to consider lifting its requirement that there be "` no subdivision in order to apply further to set off a 40,000 sq. ft. area for the guest cottage use, which minimum lot area was to be applied for the guest cottage use as conditioned by the Board of Appeals in its 1982 variance determination. {The requirement during 1982 was 40,000 sq. ft. of land area for each principal use, requiring compliance should a further subdivision be sought. 5. Article III, Section.100-31A, and Bulk/.Area/Parking Schedule of the Zoning Code, requires a minimum,of 80,000 sq. ft. of land area to be applied to each residential use. Thus, the total lot area of this parcel is 2.979 acres (129,765+- sq. ft.), which will not meet today's requirement for two residential uses on a single parcel of land. The Southold Town Zoning Code does not permit more than one dwelling on a parcel, -and the conversion of the accessory_ sleeping quarters for cooking facilities defines 4 Southold Town Bou of Appeals -12- (Appl. In considering this application, the Board finds: (a) the relief requested is limited to the installation of a cooking unit, which in the Board's opinion is not substantial in relation -,to the existing use of this accessory structure {as sleeping quarters for family member); (b) the practical difficulties claimed are not uniquely related to the property, although it is related to the the effects of zoning over the last 10+ years {see Paragraph 4, supra); (c) the intent of the owner during the prior variance was and still is to permit occupancy of the accessory building by an immediate family member {88 -yr. old mother-in-law of the owner}; (d) the placement of a cooking unit for occasional use may be placed without requiring major structural alterations and it should be further noted that there are counter -top cabinets and a sink existing in the accessory building (first entry room or living room/den area); (e) since the owner/applicant has agreed to limit the size of the accessory building, without further expansion or enlargement, the grant of the relief as requested will be,only inside the existing accessory building, without obvious aesthetic or other visible changes to the outside of the building or the surrounding property area; (f) it is the position of this Board that since the accessory building has always been,intended for family use, that the,Board has no objection to the use continuing,, provided its use is without profits from rents or leases in the future by non -family members, and that any change in this owner -family occupancy will require further consideration and approval from the Board of Appeals in the form of a use variance; (g), in view of all the above, the interests of justice will be served by limited, minimal relief as conditionally noted below.
