FINDINGS OF fACT
PROPERTY FACTS: The subject property (referred to here as Lot 38.1) is identified as county
Tax Map No. 1000-51-6-38.1. Lot 38.1 is substandard in size in the R-40 Zone, and the Town
Building Department has determined that it has merged with the adjacent lot identified as County
Tax Map No. 1000-51-6-36 (referred to here as Lot 36), which comprises approximately 65,688
square feet in area and 300 ft. frontage along Mill Creek Drive, Southold.
BASIS OF APPEAL: Notice of Disapproval dated December 20, 1996 for a determination of
mer9er, which reads:
Under Article II, Section 100-24A(1). The lots in question SCTM #'s 1000-51-6-36 and
38.1 were created by deed prior to 6/30/1983 and conform to the minimum lot
requiremenks set forth in Bulk Schedule AA as of the date of lot creation. The lots in
question area laated in an R-40 Zone under sedion 500-25A. Lot 1000-51-6-38 area of
29,661 sq. ft. has merged with adjacentlot 5000-51-6-36, area of 1.6 acres as they have
been held in common ownership since July 1, 1983.
RELIEF REOUESTED: Applicant requests a Waiver, pursuant to Section 300-26 of the Zoning
Code, of Merger of nonconforming Lot 38.1 with conforming Lot 36.
REASONS FOR BOARD ACTION. DESCRIBED BELOW: On the basis of testimony presented,
materials submitted and personal inspection, the Board makes the following findings:
(1) Lot 38.1 was purchased in 1968 by Applicant's parents, Hans and Elizabeth Strauss,
who purchased an additional strip at the east side in 1970 and merged same into Lot
38.1. Lot 36 was purchased by Mr. and Mrs. Strauss in 1971. Each Lot was held in
common ownership by husband and wife.
(2) Mr. Strauss died in 1977 and Mrs. Strauss in 1996. Applicant has inherited both Lots
and now wishes to dispose of them separately in her own will. This cannot be done
because the Lots have merged.
(3) The two Lots have been treated physically as separate properties. Lot 36, the large,
unimproved property, has been left entirely in its natural state and is in no way
related visually to Lot 38.1.
(4) Waiver of the merger will not result in a significant increase in the density of the
neighborhood because it allows the potential for the construction of only one single-
family home.

(5) Waiver of the merger will recognize lots that are consistent with the size of lots in
the neighborhood. The unimproved Lot 36 is the second largest on Mill Creek Drive,
and the improved Lot 38.1 is among the largest.
(6) Waiver of the merger will recognize the original lot lines set forth in the deeds
conveying the properdes to Mr. and Mrs. Strauss.
(7) The vacant Lot 36 comprises 1.6 acres of rough woods abutting Arshamomaque
Pond. The Board understands that any future construction will be subject to
environmental review by appropriate authority.
(8) If the merger is not waived, the testamentary intentions of ApplicanYs parents, and
Applicant's own estate planning, will be frustrated.

2255 Mill Creek Drive, Southold, NY (SCTM # 1000-51-6-38.1) - HOUSE LOT
The western portion of the house lot (SCTM # 1000-51-6-38.1) was purchased from
Anskar M. & Ivy G. Flak by Hans Strauss and Elizabeth D. Strauss, his wife, by deed dated
November 2, 1968. A triangular strip of land to the east was added to the house lot by a purchase
from Madeline R. Armstrong by Hans Strauss and Elizabeth D. Strauss, his wife, by deed dated
September 21, 1970. With the merger of the triangular strip, the area of the house lot is 32,840±
square feet (or 0.9 of an acre per Southold Town Property Card).
1935 Mill Creek Drive, Southold, NY (SCTM # 1000-51-6-36) - VACANT LOT
The adjoining vacant lot (SCTM # 1000-51-6-36) was purchased from Madeline R.
Armstrong by Hans Strauss and Elizabeth D. Strauss, his wife, by deed dated May 22, 1971.
That lot is approximately 65,688 square feet (or 1.6 of an acre per Southold Town Property Card)
including a "gutter" containing storm water run off along the eastern side of the vacant lot.
Dr. Hans Strauss died on May 9, 1977. Dr. Elizabeth Strauss died at age 92 on March 4,
1996. Maryann S. Sewell is the Strauss' only child and the legatee of the property under Elizabeth
Strauss' Last Will & Testament.
MERGER ANAI,Y5IS
Pursuant to §100-25, the non-conforming house lot merged with the adjacent i.e., sharing
a common course of 50 feet or more) conforming vacant lot because:
1. the nonconforming house lot has an area of less than 40,000 square feet; or
2. there is no ZBA lot size variance; or
3. the lots were held in common ownership since 1971; or
4. the lots are not on the maps described in former §100-12; or
5. each lot is not currently developed (only the house lot is developed).
APPLICANT'S REA50NS
1. For almost 25 years, the owners maintained the parcels as two separate entities. Two
separate tax bills were received and paid twice each year.
The owners did not build any accessory structure on the vacant lot. Rather, the vacant lot
was left in its natural. The parcel is overgrown with natural vegetation. No landscaping or lawn
was installed in order to link visually the vacant land with the house lot. Instead, the parcel was
treated by the owners as a separate and distinct entity.
Nonetheless and unbeknownst to the elderly owners, the properties merged into a lot of
more than 98,000 square feet (or more than 2 1/a± acres).

Maryann Sewell, who resides in Washington, DC, is requesting a waiver of inerger in
order to re-establish what her parents thought they had -two separate lots. In connection with her
estate planning, Mrs. Sewell wishes to be able to bequeath a parcel to each of her two children.'
2. Of the approximately 16 lots on Mill Creek Drive, only 4 lots are vacant; to wit: the
applicant's vacant lot #36 and lots #4, #7 and #23. The other 12 lots already are developed.
Inasmuch as the neighborhood is almost completely developed, the waiver would not result in a
significant increase in density.
Using the acreage reflected on Southold Town Assessors rolls, applicant's vacant lot as a
separate lot is the 2nd largest lot on the street with only the vacant parcel #23 on the northwest
corner of Richmond Road being larger. After improved lot #31.4, the house lot is the 4'' largest
lot on the street.

The size of the two subject lots as separate parcels is wholly consistent with the size of the other
� lots in the neighborhood.
It is not envisioned that there will be any significant change or alteration of the natural details and
character of the contours and slopes of the lot. There would be no substantial filling of land
affecting nearby environmental or flood areas.

of local, county, state and federal regulations with respect to setbacks, etc.

NOTICE IS HEREBY GIVEN, pursuant to Section 267 of the Town Law and Chapter 100 (Zoning), Code
of the Town of Southold, the following application wrill be held for public hearing by the SOUTHOLD TOWN �
BOARD OF APPEALS at the Town Hall, 53095 Main Road, Southold, New York 11971, on THURSDAY,
, NOVEMBER 18, 1999 at the time noted�below (or as soon thereafter is possible):
6:35 p.m. Appl. No. 4759 - MARYANN SEWELL. This is a request for approval of 1Naiver of
Lot Merger under Article II, Section 100-26 of the Zoning Code. The December 20, 1996 Building
Department Notice of Disapproval states that: "under Section 100-24A(1) the lots in question SCTM
#1000-51-6-36 and 38.1 were created by deed prior to 6/30/1983 and conform to the minimum lot
� requirements set forth in Bulk Schedule AA as of the date of lot creation. The lots in question are
located in an R-40 Zone. Under Section 100-25A, Lot 1000-51-6-38, area of 29,661 sq. ft., has
merged with adjacent lot 1000-51-6-36, area of 1.6 acres as they have been held in common
ownership at some time since July 1, 1983. Street Location: 1935 and 2255 Mill Creek Drive,
Southold, NY. '
The Board of Appeals will at same time and place hear all persons or their representative desiring to be heard in the
above application or to submit written statements before the hearing is concluded. Each hearing will not start earlier

Dear Applicants:
Please find enclosed a copy of the Legal Notice describing your recent application. The
Notice will be published in the next issue of the Suffolk Times.
Pursuant to Chapter 58 of the Southold Town Code (copy enclosed), formal notice of your
� application and hearing must be mailed and shall include a map or sketch showing the new
location with the setbacks and use noted. Send this Notice CERTIFIED MAIL, RETURN
RECEIPT REQUESTED, as soon as possible, with a copy of the map to all owners of land
(vacant or improved) surrounding yours, including land across any street or right-of-way
that borders your property. Use the current addresses shown on the assessment rolls
maintained by the Town Assessors' Office (765-1937) or the County Real Properly Office in
Riverhead. If you know of another address for a neighbor, you may want to send the
notice to that address as well.
Please submit your Affidavit of Mailina to us by the Friday before the hearing date, with the
post office receipts postmarked. Later, when the green signature cards are returned to you
by the Post Office, please mail or deliver them to us. If any signature card is not returned,
please advise the Board at the hearing.
You must post the enclosed.siQn no later than 11/11/99. Post the sign facing the street,
no more than 10 feet from your front property line bordering the street. (If you border
more than one street or roadway, a sign is enclosed for the front yard facing each one.)
The sign(s) must remain in place for at least seven (7) days, and if possible, should remain
posted through the day of the hearing. If you need a replacement sign, please contact us.
After the signs have been in place for seven (7) days, please submit your Affidavit of
Postina to us for the permanent filea
If you do not meet the deadlines stated in this letter, please contact us promptly. It may
be necessary to cancel your hearing if,the required steps are not followed.
