Box 1179 Southold, New York 11971 ZBA Fax (516) 765-9064 Telephone (516) 765-1809 PROPERTY FACTS/ DESCRIPTION: The applicant's 34,531 sq. ft. lot is located along Sleepy Hollow Lane with frontage along Goose Creek, Southold. The February 10, 1998 survey prepared by Peconic Surveyors, P.C. shows an existing single-family dwelling with a northerly side yard at 15 feet from the dwelling, and the "as built" porch and step area which is the subject of this variance request. The size of the porch and step area is shown on the building permit application to be 6 ft. by 11 ft., leaving a setback distance of 9+- feet from the northerly side property line. A survey prepared by Peconic Surveyors revised 2/20/99 confirms the exact size of the raised stoop to be 5.5 ft. by 12.3 ft, plus the 30 sq. ft. (easterly side) step area. BASIS OF APPLICATION: Building Inspector's November 20, 1998 Notice of Disapproval, Article IIIA, Section 100-30A.3. The "as built" entry stoop addition does not meet the 15 ft. setback for an R-40 Zone District and encroaches six (6) feet into the side yard. CODE EXCEPTION: Section 100-230C(2) provides an exemption for a roofed over but unenclosed project in the nature of an entry or portico, not more than six feet wide and extending not more than five feet out from the front wall of the building. AREA VARIANCE RELIEF REQUESTED: Applicant requests a reduction in the required side yard setback from 15 feet to 9 feet for a 5.5 ft. x 12.3 ft. "as built' entry stoop addition (plus the 30 sq. ft. easterly step area which is exempt from the setback requirements). OPPOSITION: It is noted that the attorney for the neighbor of land to the north of the stoop area submitted objections, all of which have been fully considered by the Board. REASONS FOR BOARD ACTION. DESCRIBED BELOW: Based on the testimony and record before the Board, and personal inspection, the Board makes the following findings: • Page 2- Appl. Grant of the area variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties because the 98 (total) sq. ft. stoop area meets the same setback which is allowed under section 100-230D. 2. The benefit sought by applicant cannot be achieved by some method, feasible for appellant to pursue, other than an area variance because there is a ramp constructed for handicap access and the stoop allows safe turning area at the top of the ramp before entering/exiting the dwelling. 3. The requested area variance is not substantial representing approximately 98 sq. ft. of additional access area. 4. There is no evidence that grant of the variance will have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district. In considering this application, the Board deems the grant of this variance to be the minimum necessary and adequate to enable applicant to enjoy the benefit of a new handicap entry, while preserving and protecting the character of the neighborhood and the health, safety, welfare of the community. RESOLUTION /ACTION: On motion by Member Dinizio, seconded by Member Collins, it was RESOLVED, to GRANT the variance, as applied for, SUBJECT TO THE FOLLOWING CONDITION: That a row of 3 ft. to 5 ft. high trees be olanted along the northerly side property line for a length of 24 feet, to wit: 6 ft. before sten area. plus 12 ft. for step length, plus 6 ft. after. B. Exceptions to lot depth requirements. The minimum lot depth at any point may be decreased to 75% of the minimum requirement if the average depth conforms to the minimum requirement. C. Exceptions to yard requirements. (1) Permitted obstructions. Cornices or cantilevered roofs may project not more than two feet into a required yard. Belt courses, windowsills and other ornamental features may project not more than six inches into a required yard. Fences or walls not over four feet in height may be erected anywhere on the lot, except as set forth in § 100-232 herein. Paved terraces, steps and walks (other than such as are needed for access to the buildings on the lot) shall not project within 15 feet of a street line or four feet of a property line. (2) Entries and porticos. A roofed -over but unenclosed projection in the nature of an entry or portico, not more than six feet wide and extending not more than five feet out from the front wall of the building, shall be exempt from the requirements of this 10133 2-10-98 § 100-230 SOUTHOLD CODE § 100-230 section when the building otherwise complies with the regulations of this section. B. Exceptions to lot depth requirements. The minimum lot depth at any point may be decreased to 75% of the minimum requirement if the average depth conforms to the minimum requirement. C. Exceptions to yard requirements (1) Permitted obstructions. Cornices or cantilevered roofs may project not more than two feet into a required yard. Belt courses, windowsills and other ornamental features may project not more than six inches into a required yard. Fences or walls not over four feet in height may be erected anywhere on the lot, except as set forth in § 100-232 herein. Paved terraces, steps and walks (other than such as are needed for access to the buildings on the lot) shall not project within 15 feet of a street line or four feet of a property line. (2) Entries and porticos. A roofed -over but unenclosed projection in the nature of an entry or portico, not more than six feet wide and extending not more than five feet out from the front wall of the building, shall be exempt from the requirements of this 10133 2-10-98 § 100-230 SOUTHOLD CODE § 100-230 section when the building otherwise complies with the regulations of this section.
