The follOWing action was taken by the Board of Tow~Trustees ~uring
its regular meeting held on Thursday, January 17, 1991 regarding the
above matter:
WHEREAS, F/q-CONSULTANTS IN BEHALF OF FRANCES FRISBIE applied to the
Southold Town Trustees for a permit under the provisions of the
Wetland Ordinance of the Town of Southold, application dated November
30, 1990 and,
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and recommendations,
and,
WHEREAS, a public hearing was held by the Town Trustees with respect
to said application on January 17, 1991 at which time all interested
persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar
with the premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation
submitted concerning this application, and,
WHEREAS, the Board has determined that the project as proposed will
not affect the health, safety and general welfare of the people of
the town,

The CAC discussed the Larry Tuthill application for two bulkheads and
recommend that the Trustees disapprove the project. The Council
is still opposed because the project would destroy the spartina.
On a motion by John Holzapfel, seconded by Margaret Feeney, it was
RESOVLED to recommend to the Southold Town Trustees approval of
Wetland Application of Joseph Fukjinski revised application, amended
to construciton of a catwalk ramp/float assembly with no dredging.

Motion carried.
On a motion by Bruce Loucka, seconded by John Holzapfel it was
RESOLVED to recommend to the Southold Town Trustees approval of
Wetland Application No. 11-1-90-57-2-20 of John Milazzo to build an
addition to an existing house. The CAC recommends approval of the
project only as it was written on the submitted appplication, any revisions
the owner may consider must be resubmitted before the CAC would
approve. Recommend approval only for the second story.

4, If the permittee intends to undertake any project design modifications

permit.
5. Those portions of docks, catwalks and ramps which ex%eno over vegetated
tidal wetlands shall nave a maximum surface width of a feet and shall be
a minimum of 3 1/£ ~eet above grade, as measured from tne ground surface
to the bottom of the planking. Floating docks shall not rest on
vegetated tidal wetlands at any tidal stage.

facilities.
8. Installation of additional docks at marinas, boat basins, or other
commercial facilities is not authorized by this permit.

SUPPLEMENTARY SPECIAL CONDITIONS
The following conditions apply to all permits:
A. If any of the permit conditions are unclear,the permittee shall con-
tact the Division of Regulatory Affairs at the address and tetephose
noted below.
B. A copy of this permit with supplementary conditions and approved
plans shall be available ar the project site whenever authorized
work is in progress.
C. The permit sign enclosed with the permit or a copy Of letter Of
approval shall be protected from the weather and posted in a con-
sp~cuous location at the work sire until completion of authorized work.
Do :At least 48 hours prior to commencement of the project, the permittee
shall complete and return the top portion of the enclosed receipt form
certifying that he is fully aware of and understands all provisions and
conditions of this permit. Within one week of completion of the
p~rm~tted work, ~ne bottom portion of that form shall also be com-
pleted and returned.
E. For projects involving activities no be accomplished over a period of
more thai] one year, the permittee shall notify the Regional Permit
Administranor in writing at least 48 hours prior to the commencement
~f resumption of work each year.
F. If project design modifications take place after permit issuance, the
permittee shall submit the appropriate plan changes for approval by
the Regional Permit Administrator prior to undertaking any such modi-
fications. The permittee is advised that substantial modification
may ~equire submission of a new application for permit.
All necessary precautions shall be taken to preclude contamination of
any wetla~nds or waterway by suspended solids, sediment, fuels,
solvents, lubricants, epoxy coatings, paints, concrete, leachate or
any other environmentally deleterious materials associated with the
project work.
H. Amy failure to comply precisely with all o~ the terms and conditions
of this permit, unless authorized in writing, shall be treated as a
violaticn of the Environmental Conservation Law.
I. The permittee ~s advised [o obtain any permits or approvals that msy
be required from the U.S. Department of Army Corps of Engineers, NY
District, 26 Federal Plaza, New York, NY 10278, (Attention: Regulatory
~unctions Branch), prior to commencement of work authbrized herein.
J. The granting of this permit does not relieve the permittee of the
responsibility of obtaining a grant, easement, or other necessary
approval from the Division of Land Utilization, Office of General
Services, Tower Building, Empire State Plaza, Albany, NY 12242, which
may be required for any encroachment upon State-owned lands underwater.
