Dear Mr. Frey:
The following action was taken by the Board of Town Trustees during
their regular meeting held on September 24, I987 regarding the above
referenced property.
WHEREAS, Robert H. Frey requested a Waiver of the Wetland Ordinance for
the construction of deck addition to an existing dwelling located on
Windjammer Drive, Southold, and
WHEREAS, the Board made the following findings of fact:
1. By this request appellant requests permission to construct an open deck
to be constructed 35~ landward of an existing bulkhead.
2. The subject property is located on Windjammer Drive, Southotd.
3. The project will not affect the health, safety and general welfare of the
people of the Town,
Now, therefore, be it
RESOLVED that Robert H. Frey be and hereby is granted a Waiver of the
Wetland Ordinance as requested to construct an open deck to be constructed
35' landward of an existing bulkhead on property located on Windjammer Drive,
Sonthold, all in accordance with the plan submitted.
Please return to the Building Dept. for a determination on the need of any other
town permits that may be required for this project.

Therefore, no permit under Article 25 (Tidal WetL%nds of the Envircramental
Conservation Law) is required at this time since the current proposal is beyond
State mamdated jurisdiction pursuant to this act. However, any additional work
or modifications to the project may requize a permit. It is your responsibility
to notify this office, in writing, if such additional work of modifications are
comtemplated.
