19~7~ between TOWN OF SOUTHOLD~ in the County of Suffolk and
State of New York, by a majority of its duly elected Trustees
and by virtue of Chapter 615 of the Laws of the state of New
York, passed in 1893~ and pursuant to a written resolution
adopted by a majority of the Boar~ of Trustees of said Town
of Southold~ at a meeting held purwuant to notice duly given
to all the members thereof~ on the 2~th day of September~ 19~7~
party of the first party and
1697 Corporation~ S. Roy French. President~ party of
the second part~
WITNESSETH~ the party of the first part in consideration
of the sum of $10~00~ duly paid to the party of the first
part before the delivery hereof~ the receipt whereof'is here-
by duly acknowledged~ has granted and does hereby grant unto
the said party of the second part~ the heirs~ successors~ and
assigns of the parties of the second part forever~ permission
to dredge in Haywater Cove about three feet in depth at
Cutchogue, in the Town of Southold~ Suffolk County~ New York~
in accordance with the plans submitted.
Subject~ however, to the public right ~f navigation and
subject also to the right of the public to pass and repass
along that portion of the beach between low and high wtter
mark. On condition~ however, that the parties of the second
part will hold the said Trustees and the Town of Southold
harmless and free from any and all daFages an8 claims arising
under or by virtue of said dredging~
IN WI~NESS WHEREOF, the said To%m of Southold~ party
of the first part~ has by a vote of a majority of the Board
of Trustees of said To%m~ caused its corporate seal to be
hereunto affixed~ and these presents to be subscribed by a
majority of the said Board of Trustees~ the d~y and year
above written.
