The following action was taken by the Board of Town Trus=ees during
their regular meeting held on June 25, 1987 regarding the above matter.
RESOLVED that the Southold Town Trustees WAIVER the need of a Wetland
Permit for the construction of a 20' x 40' in-ground pool and a 8' diameter
Jacuzzi with an 8 sided Gazebo above the Jacuzzi as requested by Ferucio Frankola
for property located at 269 Glenn Road, Southold. Ail discharge from the pool is to
be kept out of the creek. During excavation the fill muse be contained so that it
does not wash into the creek.
Please remit $25.00 to this office for the Waiver granted.

Trustee office for review.

The following action was taken by the Board of Trustees during
their regular meeting held on Sept. 25, 1986 regarding the above
captioned matter.
WHEREAS, The Ladd Use Company on behalf of Frank Frankola has heretofore
applied to the Southold Town Trustees, pursuant to Chapter 44 of the Code
of the Town of Southold for permission to construct approximately 300 lin.
ft. of timber bulkhead which will include a 20' x 30' boat basin and a 30'
return. Applicant also proposes to dredge said boat basin to 3' at MLW with
this approx. 20 cu. yds. of spoil shall be removed from below MHW and approx.
93 cu. yds. from above. MHW. Said spoil shall then be used as backfill for
bulkheading. Property is located on Glenn Road, Southold.
NOW, THEREFORE IT IS RESOLVED AS FOLLOWS:
1. That pursuant to the provisions of Article 8 of
the
Environmental Conservation Law; Part 617 of Title 6 of
the New York State Code, the Southold Town Trustees, as
Lead Agency, does hereby determine that the action proposed
is a Type 1 Action and is likely to have a significant effect
on the environment.
That the secretary to the Trustees shall file and circulate such
determination as required by the aforementioned law, rules and c~de.
That the Secretary to the Trustees shall immediately notify the
applicant, The Land Use Company on behalf of Frank Frankola and
further request said applicant to prepare a Draft Environmental
Impact Statement, all in accordance with said law, rules and code.

NOTICE OF SIGNIFICANT EFFECT ON THE ENVIRONMENT
Pursuant to the provisions of Article 8 of the Environmental
Conservation Law, Part 617, of Title 6 of the New York State Codes,
Rules and Regulations and Chapter 44 of the Southold Town Code, the
Southold Town Trustees, as lead agency, does hereby determine that the
action described below is a Type i Action and is likely to have a
Significant Effect on the Environment.

Please be advised that the undersigned represents Ferucio Frankola
with reference to the aforedescribed applicatien. Please be
further advised as.follows:
1. The applicant will be unable to attend the hearing
scheduled for December 30~ 1986 and requests an adjournment of the
application until the January, 1987 meeting.
2. With reference to the issue concerning construction of
the bulk head,~ please be advised that the Zoning Board of Appeals
on January 30, 1966 grant~d! an application to maintain a boat
basin for the dockage of more than 6 non-comraercial boats on the
subject premises. A copy of the Zoning Board of Appeals Resolution
is enclosed. In light of the foregoing, the applicant hereby
requests permission for the construction of the bulkhead 6 feet
westerly of the existing bulkhead. The proposal of the Board of
Trustees concerning construction of the bulkhead 16 feet west of the
existing bulkhead is impracticable and would render the proposed
bulkhead useless. To impose the construction of a useless bulkhead

would be in direct contravention of the Board of Standards and
Appeals' decision.
We would appreciate your reconsideration concerning the construction

During the month of january 1987, 21 Individual Department ofthe Army
Permit Authorizations and 7 Authorizations for work under a RegionaI General
Permit were issued for work in waters of the United States, pursuant to Section
10 Of the River and Harbor Act of 1899 (33 U.S. 403); Section 404 of the Clean
Water Act [U.S.C. 1344 et. seq.) and Section 103 of the Marine Protection,
Research and S~nctuaries Act of 1972 (86. Stat. 1052, P.L. 92-532), as
appropriate, to the permittees listed on the attached enclosure. During this
month, no applications were denied, 21 applications were considered withdrawn and
45 applications did not require Department of. the Army approval or the proposed
work is authorized byaNationwide General Permit.
Prior to issuance of the individual permit authorizations, evaluation was
made on factors affecting the public interest, including, but not limited to,
conservation, economics, aesthetics, general environmental concerns, historic
values, fish and wildlife values, flood damage prevention, land use, navigatIon,
recreation, water supply, water quality, energy needs, safety, food production,
and in general, the needs and welfare of the people.

x 4' fixed platform off bulkhead; 3' x 16' hinged ramp; (2) 6'
x 24' float secured by (3) 8" diameter pilings. 'Approval is with
the stipulation that the applicant properly contains the spoils
and cover with appropriate marsh plants.
On a motion made by Heather~Cusack, seconded by Jeanne Marriner,

REQUEST BY FERUCIO FRANKOLA TO A14END WETLAND APPLICATION NO. 431.
Please review the attached application submitted by Ferucio Frankola
which has been scaled down by deletion of the dredging. The bulkhead
proposed will now be a retaining wall. Please note as proposed the house
and the pool does non lie within the Trustees jurisdiction.
Mr. Frankola has advised that the property is staked if someone could
look at this site przor the the meeting on Oct. 30. 1986 perhaps the
Board could rescind the Significant Environmental Assessment and
amend the application 431 and possibly do a negative assessment based
on the mitigated proposal?

At this time I? Ferucio Frankola, would like to ask the Board to kindly
reconsider to amend my application # 431.
The' application under # 431 has been ~ompletly changed. There has been all
modifications made in the new request.
My present request is as follows:
1. I would like to build a new house on lot # 18. This house would be a
private one fs~ily dwelling.
2. I would like to build a pool wire-the house on lot P 18.
3. On the South side of lot # 1.8 I would like to build retaining walls
of approximatly ~40 feet in %angth.
4. O~ the East side of lot # 18 I would like to build a retaining wall of
approximatly 240 feet in ien~th'
Ail items and sizes of 1 to 4 are shown in the diagram.attached labeled sheet # 3.
My contractor will be Patrick Carrig.
I have attached the permit granted by the. Trustees in 1981 to build a retaining
wall in lot # 19. Lot # 19 is where I have my present house.
At this time I would l~ke to thank the Board of.Trustees for r~considering my
application in view of the changes.
I assure you that it is my intention to improve the ~roperty both for myself
