Sanders,Trustee ,� ��� Fax(631) 765-6641 BOARD OF TOWN TRUSTEES TOWN OF SOUTHOLD February 18, 2015 Mr. Leonard Rosenbaum 965 Osprey Nest Road Greenport, NY 11944 RE: LEONARD ROSENBAUM 965 OSPREY NEST ROAD, GREENPORT SCTM# 35-6-24.1 Dear Mr. Rosenbaum: The following action was taken by the Southold Town Board of Trustees at their Regular Meeting held on Wednesday, February 18, 2015: WHEREAS, LEONARD ROSENBAUM applied to the Southold Town Trustees for an Amendment to Wetland Permit#1704 under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated January 30, 2015, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the application be found to be Consistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, • 2 • NOW THEREFORE BE IT, RESOLVED, that the Southold Town Board of Trustees APPROVES the Amendment to Wetland Permit#1704 to install approximately 254 linear feet of vinyl sheathing against the landward side of existing bulkhead with sheathing height to match existing bulkhead height; and place approximately 270 cubic yards of clean sand backfill; and as depicted on the site plan prepared by Leonard Rosenbaum, last dated November 19, 2010, and stamped approved on February 18, 2015. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. Inspections are required at a fee of $50.00 per inspection. (See attached schedule.) Located: 965 Osprey Nest Rd., Greenport. I visited the site, it is washed out in two locations. It would be silting up the waterway in front of their home, so that a repair is in order. The transfer of the permit seems to be proper and orderly. The only thing I would do is to request, as a condition of the permit, that they block two six-inch diameter plastic pipes which are overflows from a lawn drywell, so that the drywell is not discharging into the creek. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed actions are CONSISTENT with the Policy Standards and therefore are CONSISTENT with the LWRP subject to the permit conditions issued in the 2010 Wetland Permit: 1. This "application is to be completely filled in by typewriter or ink and submitted to the Town Clerk in quadruplicate, accompanied by written permission from the owner of the property if not the same as the applicant. B. Pilot Plan must be drawn to scale on the reverse side of this application showing the location of property, the names and locations of owners.of adjoining properties, and a detailed description of proposed project. (Note: Copies of the Pilot Plan may be made by a copy machine and attached to the Permit Application.) C. Nooperation shall be initiated by the applicant until all permits that ore required are issued. D. A detailed statement of the rehabilitation and proposed condition of the premises after the work is completed must be given, including a survey if required. E. If permit is being sought for a more sizeable excavation than the construction of a private single dock or jetty, then this application must be accompanied by a survey and topographical map certified by a registered land survey or Professional Engineer. The horizontal control of survey shall be based upon an approval local coordinate system. The vertical control for elevation and sound- ings shall be based upon United States Coast and Geodetic Survey and/or United States Geological Survey datum. F. A statement must accompany the application describing any known prior operations conducted on the premises in question and whether any prior licenses or permits have been issued to erect structures or to dredge or deposit fill on said premises and whether any such permits or licenses were ever revoked or suspended by a governmental agency. G. A filing fee of $25.00 shall accompany the application. This filing fee includes one inspection. there is a $5.00 fee for each additional inspection. H. The Town Board upon request al ttbe applicant for a permit, may waive in whole or in part, the provisions of Article II, Section' , 'subdivisions (L and 0-where it finds that nature of the proposed operations are such that the requirements of such provisions are not necessary for a proper consideration of a permit application.
