TERMS and CONDITIONS

of the consideration for the issuance of the Permit does understand a~d to the roi-

lowing:
1. That the said Board of Traste~s and the Town of Southold are released from any and
ail damages, or cl~imi for damages, of suits arising directly or indirectly as a result of any oper-
ation performed pursuant to this permit, and the said Permi~cee will, at his ot her own eXlmme~
defend any and all such suits initiated by third parties, and the said Permitt~e assumes full liability
with respect thereto, ro the complete exclusion of the Board of Trustees of the Town of Sonthold
2. That this Parmk is valid for a period of 24 mos. which is conslder~ ro be the
estimated rime required m complete the work involved, but should circumstances warrant, request
for an extension may be made to the Board at a later date.
5. That this Permit should be retained indefinitely, or as long as the said Permim~e wishes
to maintain the structure or project involved, to provide evidence to anyone concerned that anth-

upon due notice, to remove or alter this work or project herein stated without ~ to the Town
of Sonthold.
8. That the said Board will be notified by the Permittee ot the completion of the work anth-
orized.
9. That the Permirtee will obtain all other permits and consents that may be required ~
plemental ro this permit which may be Subject to revoke upon £allure to obtain same.

Dear Mr. Costello:
The following action was taken by the Board of Town Trustees during
its regular meeting held on July 11,1991 regarding the above matter:
WHEREAS, COSTELLO MARINE IH BEHALF OF RICHARD FPJd{ER applied to the
Southold Town Trustees for a permit under the provisions of the
Wetland Ordinance of the Town of Southold, application dated May 29,
1991 and,
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and recommendations,
and,
WHEREAS, a public hearing was held by the Town Trustees with respect
to said application on July 11, 1991 at which time all interested
persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar
with the premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and docUmentation
submitted concerning this application, and,
WHEREAS, the Board has determined that the project as proposed will
not affect the health, safety and general welfare of the people of
the town,
NOW, THEREFORE BE IT
RESOLVED THAT COSTELLO MARINE ON BEHALF OF RICHARD FRAKER BE AND
HEREBY IS GRANTED PEP/~ISSION UNDER THE WETLAND ORDINANCE TO:
Construct 4' X 90' timber dock, 30' X 20' alUminum ramp, 8' X 24'
timber floating dock, (2) 2-pile dolphins. Located Knollwood Lane,
Mattituck.
This permit will expire two years from the date it is signed. Fees
must be paid, if applicable, and permit issued within six months
of the date of this notification. Two inspecnions are required and
the Trustees are to be notified upon completion of said project.
Please return to the Building Department for a determination on the
need for any other permits which may be required for this project.
Permit will be issued upon payment of the following fees for work to
be done below Mean High Water Mark:
Dock 4' X 40' = 160 sq ft = 320.00
Ramp 30" X 20' = 50 sq ft = 100.00
Float 8' X 24' = 192 sq ft = 384.00

Agency for the action described below, has determined that the
project will not have a significant effect on the environment.
Please take further notice that this declaration should not be
considered a determination made for any other department or agency
which may also have an application pending for the same or similar
project.

DESCRIPTION OF ACTION: To construct 4' X 90' timber dock, 30' X 20'

REASONS SUPPORTING THIS DETERMINATION:
1. An on site inspection has been conducted by the Board of
Trustees.
2. An environmental assessment, submitted by the applicant and
reviewed and completed by the Board of Trustees, has indicated that
no significant adverse effects to the environment are likely to occur
should the project be implemented as planned.

Re: Recommendation of Wetland Applications
At its meeting held June 24, 1991 the Southold Town Conservation
Advisory Council made the following recommendations:
RESOLVED to recommend to the Southold Town Trustees approval with
stipulations Wetland Application No. 107-6-I of Richard Fraker to construct
4' x 90' timber dock; 30" x 20' ramp; 8' x 24' float dock and two pile
dolphins. The CAC recommends approval provided the Trustees grant
the permit only for the length required to reach minimum depth needed
l'or the applicant's boat.

As this work is minor in nature, authorization may be by Letter of
Permission. This is in accordance with current Federal Regulations governing
work in navigable wavers of the United States. To accomplish the
coordination required, prior to the issuance of a Letter of Permmssion,
your review of the enclosed drawings is requested.
Pursuant to Secvon B07 (c] of the Coastal Zone Management Act of 1972
as amended [16 U.S.C. 1456(c)], the applicant has certified-that the activity
complies with and will be conducted in a manner that is consistent with
the approved Coasval Zone Management Program of the State of New York.
