PROPERTY FACTS/DESCRIPTION: The applicants' property consists of 40,000+- sq. ft. with
350+- ft. frontage along the east side of Stephenson Road (Private Road #1), 449 ft. along the
west side of a Private Road located at the easterly side of applicants' property, and 130 ft. lot
depth, at Orient. This lot is located in an R-40 Low -Density Residential Zone District and is
improved with a single-family dwelling, swimming pool and accessory storage building.
BASIS OF APPEAL: The Building Inspector's July 15, 1999 Notice of Disapproval, under Article
III -A, Section 100-30A.4 (and Section 100-33) for a double shed structure in a side yard (and
front yard). The shed which exists is 12 ft. wide by 10 ft. and is situate 20 feet from the west
properly line at its closest point and at least 100 feet from the southerly property line. This shed
is proposed to be doubled in size, for a 24'6" wide by 10' deep shed and would be located at the
edge of the driveway.
AREA VARIANCE RELIEF REQUESTED: Location of storage shed in an area other than a rear
yard. The location is mostly side yard area.
REASONS FOR BOARD ACTION, DESCRIBED BELOW: On the basis of testimony presented and
personal inspection, the Board made the following findings:
1. Grant of the area variance will not produce an undesirable change in the character of the
neighborhood or a detriment to nearby properties. The property contains two front yards as
defined in the Southold Town Code because it is situated between two private rights-of-way.
The proposed storage shed will be located in approximately the same area as the existing 12 ft.
by 10 ft. shed and setback a minimum of 20 feet at its closest point from Stephenson Road. A
large tree will help to provide natural screening for the shed.
2. The benefit sought by applicant cannot be achieved by some method, feasible for appellant to
pursue, other than an area variance because the provisions of the Town Code which were
applied to determine that applicants' property has two front yards, have left the applicants'
property with no discernible rear yard area, which is the only conforming area in which an
accessory structure could be located without a variance.
3. The requested area variance is not substantial.

4. The proposed variance will not have an adverse effect or impact on the physical or
environmental conditions in the neighborhood or district because the accessory shed location
conforms to the code -required setbacks for accessory structures in what would typically be
considered a large conforming rear yard area.
In considering this application, the Board deems this action to be the minimum necessary and
adequate to preserve and protect the character of the neighborhood, and the health, safety,
welfare of the community.
RESOLUTION/ACTION: On motion by Member Tortora, seconded by Member Horning, it was
RESOLVED, to GRANT the variance, as applied.
Vote of the Board: Ayes: Goehringer, Dinizio, Tortora, Horning, Collins. This Resolution was
duly ADOPTED by unanimous (5-0) vote of ft�.

'REASONS ;FOR AREA VARIANCE ONLY (to be_ completed_ by applicant
Do not use these standards for "use variance" or "special
exception." (Also attach sheets if necessary, with signatures.)
1. An undesirable change will NOT be produced in the character of
the neighborhood or a detriment to nearby properties, if granted
BECAUSE: our property adjoins two private rights-of-way,'one to
the east of our house and the other along our west property line.
The shed is proposed to be in the yard which appears to be
a natural "rear yard" at the end of the existing driveway,. as an
enlargement of the existing shed (which is approx. sq. ft.)
2. The benefit sought, by the applicant CANNOT be achieved by some
method, feasible .for the applicant to pursue, other than an area
variance BECAUSE: this lot does not have a rear yard under the
definitions of the Zoning Code. The southerly yard area, -,is the
usable area for not only the existing accessory pool but also
for an accessory storage building.'
3. The amount of relief requested 'is. not'substantial BECAUSE
it is less than 200 sq. ft. in size, and a 100 sq. ft. shed
would not require a building permit under the new regulations.
4. The variance will NOT have an adverse effect or impact on the
physical or environmental conditions in the neighborhood or district
BECAUSE this is the most "natural" area considering the level of
the land and the garage -driveway areas presently.used by residents.
No disturbance to the land will be necessary in this location.
5. Has the alleged difficulty been self-created?
( ) Yes.
(X ) NO. The code does not define a usable rear yard without
a variance procedure.
6. This is the minimum that is necessary and adequate, and at the
same time preserve and protect the character of the neighborhood and

Please find enclosed a copy of the Legal Notice describing your recent application. The
Notice will be published in the next issue of the Suffolk Times.
Pursuant to Chapter 58 of the Southold Town Code (copy enclosed), formal notice of your
application and hearing must be mailed and shall include a map or sketch showing the new
location with the setbacks and use noted.' Send this Notice CERTIFIED MAIL, RETURN
RECEIPT REQUESTED, as soon as possible, with the map to all owners of land (vacant or
improved) surrounding yours, including land across any street or right-of-way that borders
your property. Use the current addresses shown on the assessment rolls maintained by the
Town Assessors' Office (765-1937) or the County Real Property Office in Riverhead. If you
know of another address for a neighbor, you may want to send the notice to that address .

Please submit your Affidavit of Mailing to us by the Friday before the hearing date, with the
post office receipts postmarked. Later, when the green signature cards are returned to you
by the Post Office, please mail or deliver them to us. If any signature card is not returned,

BASIS OF APPEAL'. . Notice of Disapproval issued by the Building;

PROVISIONS APPEALED FROM: Article XXIII, Section 100-231 and
Article IIIA, Section 100-30A.4 (ref. Article III, Section 100-33).
RELIEF REQUESTED: Proposed swimmingpool in a yard technically
defined by the zoning code as a front yard location, and proposed
fence, as built, at six feet in height along a front' yard. Proposed
pool is shown to be 10 feet from the easterly property line and more
than 200 feet from the Main Road.

REASONS/FINDINGS: Requested location is not unreasonable since it

better suited to this type of construction. Fence heights up to 6-1/2
