The validity of this permit is or may be subject to the approval of.other governmental or municipal
authorities. The Town accepts no responsibility in applying for or obtaining SUCh aoproval. In the
event that such approval is necessary, tine holde¢ of this permit shah not commence operations here-
un~er until such approval has been obtained in writing. The failure to obtain such other aooroval when
required shall subject this permit to immediate revocation by the Trustees ueon receipt by the
Trustees- of written notice from such other governmental or municipal authorities of its refusal or
disapproval.
The applicant does by the acceptance of this permit, assume ali responsibility for operations u nder-
taken pursuant to this perm[t, and shall take ail precautions for the prevention of injuries to persons
and property resulting from such ooerations. By such acceptance, the applicant also agrees to indemni-
f~ and save harmless the Town, and its officers, agents and employees from any and all claims arising
from operations under this permit and any and all acts or omissions of applicant, his agent and
employees.
The applicant and the owner and occu oants of the premises upon which the operations authorized by
mis permit are being conducted, do, by the acceptance of this permit, give consent to the Town, and
[ts officers and employees to enter upon the premises where such operations are being conducted to
make such inspections as the Town may deem necessary to insure that such operations are being con-
ducted in conformity with this permit.
This operation will not substantially:
A. Adversely affect the wetlands of the town.
B. Cause damage from erosion, turbidity or siltation.
C. Cause saltwater intrusion into the fresh water resources of the town.
D. Adversely affect fish, shellfish or other beneficial marine organisms, aquatic wildlife and vege-
tation or the natural habitat thereof.
E. ncrease the danger of flood and storm-tide damage.
F. Adversely affect navigation on tidal waters or the tidal flow of the tida~ waters of the town.
G. Change the course of any channel or the natural movement or flow of any waters.
H. Weaken or undermine the latera~ support of other lands in the vicinity.
I. Otherwise adversely affect the health, safety and genera~ welfare of the peoo]e of the town,

Please be advised that the Board of Trustees took the
following action at a regular meeting held on October 30, 1985
regarding the application of Anthony Forosich:
Moved by Trustee Kujawski seconded by Trustee Bredemeyer
WHEREAS, Eh-Consultants, Inc. on behalf of Anthony Forosich
applied to the Southold Town Trustees for a permit under the
provisions of the Wetland Ordinance of the town of Southold,
application dated July 31, 1985 and
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and recommendations
and
WHEREAS, a public hearing was held by the Town Trustees with respect
to said application on October 30, 1985 at which time all interested
persons were given an opportunity to be heard,
NOW, THEREFORE, BE IT
RESOLVED that Eh-Consultants, Inc. on behalf of Anthony Forosich
be granted permission under the provisions of the wetland ordinance
of the Town of Southold~ New York, all in accordance with the
application and subject to the ability of the Association to
remove the covenants and restrictions that may affect the ±loatlng
docks. This permit will expire on October 30, 1986 if worx nas
not commenced by said date. There shall be two inspections
required; and the Trustees shall be notified when the project is
complete.
A $5.00 wetland inspection fee is now due.

Pursuant to Article 8 of the Environmental Conservation Law
State Environmental Quality Review and 6NYCRR Part 617, Section
617.10 and Chapter 44 of qbe Code of the Town of Southold, notice
is hereby given that the Southold Town Trustees, as lead agency
for the action described below, has determined that the project,
which is unlisted will not have a significant effect on the
environment.
DESCRIPTION OF ACTION: Eh-Consultants, Inc. on behalf of Anthony
Forosich to maintenance dredge an irregular area to .~' below ML~.
Approx. 50 cu. yds. will be removed to upland site. Install hinged
ramp, float secured by pilings on property located ~t 1405 Anchor Lane,
Southold.
The project has been determined not to have a significant
effect on the environment for the following reasons:
An environmental assessment has been submitted which
indicated that no significant adverse effect to' the environment
are likely to occur should the project be implemented as planned.
Because there has been a response from'the Southold Town
Conservation Advisory Council indicating that this project would
not have a significant effect to the environment.
Because there has been no response in the allotted time from
the New York State Department of Environmental Conservation and the
Southold Town Building department, it is assumed that there are no
objections nor comments from those agencies.

NOTICE IS HEREBY GIVEN that public hearings will be held by
The Board of Town Trustees of the Town of Southold, at the Southold
Town Hall, main Road, Southold, New York on WEDNESDAY, OCTOBER 30,
1985 on the following application for a permit under the provision
o~ the wetland ordinance to commence at 8:14 P.M. :
In the matter of the application of Anthony Forosich submitted
by En-Consultants, Inc. for a wetland permit to maintenance
dredge an irregular area to 4' below MLW. Approximately 50cu. yds.
wili'be removed to upland site. Install hinged ramp, float secured
by pilings on property located at 1405 Anchor Lane, Southoldo
President Smith opened the meeting and asked if there were any //
comments for or against the application. /
Roy Haje Eh-Consultants, Inc.: This is one I'm sure you will /
have discussion on. The pro3ect is to maintenance dredge and
installation of a small dock. The dredging is to allow this
section of the bulkhead to be constructed and the dock. It is 'a
small project, and I urge your approval.
Trustee Smith: Does anyone have anything to say for this application.
Mr. Hiltz: Doesn't the covenants and restrictions on the
~arbor Lighys Estates restrict the docks. - Anchor Lane, Southold.
Trustee Smith: I think it is in certain areas. It was my
understanding in the basin area it does not p.'~.rohibit it.
On the North Bulkheaded side.
Mr. Hiltz: The only thing I will say for Mr. Forosich is that
it does not protrude out. He did recess the bulkhead.
Trustee Smith: Will it protrude out? Roy will you answer that.
Roy Haje: About two or three feet.
Trustea Smith: How far is it indented?
Trustee Kujawski: Personally I donnt know if it is our
responsibility to get involved with covenants and restrictions.
I don't see how we can approve the application, unless you want
to split the application.
Trustee Smith: I think the project is indented into the bulkhead.
Trustee Kujawski: That's not what the covenants and restrictions
sa~. If they are indented or otherwise it is not our business.
Am I correct that the covenants and restrictions prohibit the
floating docks wheteher they are indented or otherwise.
Roy Haje: If it ms your determination to deny the dock
portion of the ~J dock
application because of the covenants and restrictions i would ask
your to split it. So that we can do the dredging portion of the
project. So he can tie his bot to the bulkhead.
Trustee Kujawski: Has this ever been dredged out.
Trustee SMith: Wasn't this dredged out.
Mr. Kramer: It is entirely man made.
Trustee Smith: This will be the first maintenance permit, since
it was build.
Mr. Kramer: The covenants say that no owner is allowed to construct
or maintain docks or other structures that extend out into the
canal. IF you don't look at the 19~6 map you don't know where the
canal is. If you look at the basin there ms a canal down the
middle of the basin.
Roy Haje: If this needs more interpertation, later on there is
another application for Mr. Schiparo, If some of these people are
not allowed to but mn a dock, then there alternative is to dredge
or put mn a boat slip so that they can dock their boat. It is
an involved situation. You don't want them to impede and block off
neighbors, but the people themselves want to use their property.
Trustee Kujawski: We do not have a problem with them. We do ot
want to get involved with the legal ramification.of the neighborhood
s that set up certain covenants and restrictions 20 years ago. We
would like to see the removeable floats and docks for access to
boats rather than dredging. It is not environmentally a sound
project up to bulkheads. Why wcouldint the neighborhood workde
this out. Or go back to the survey, to find out where the canals
are. and where the property ends.
Roy Haje: It is my understanting that the Association has to change
the covenants and restrictions.
Trusteee Smith: They I have to go along with Frank. they have to
change the restrictions.

the probable i~act including cumulagive impacts of the activity on the

protection and utilization of important resources. The benefit which

Pursuant to Section 7 of the Bndangered Species Act (16 U.S.C. 1531) and
based upon a review of the latest published version of the threatened and
endangered species listing, a preliminary determination is that the
activity under consideration will not affect those species listed or their
critical habitat.
Based uPon a review of the latest published version of the National
Register of Historic Places, there are no known sites eligible for or
included in the Register within the permit area. Presently unknown
archeological, scientific, prehistorical or historical data may be lost by
wark accomplished under the required permit.
Reviews of activities pursuant to Section 404 of ~he Clean Water Act will
include-application of the guidelines promulgated by the Administrator,
U.S. Environmental Protection Agency~ under authority of Section 404(b) of
the Clean Water Act and the applicant will obtain a water quality
certificate or waiver from the appropriate state agency in accordance with
Section 401 of the Clean Water Act prior to a permit decision.
Pursuant to Section 307(c) of the Coastal Zone Management Act of 1972 as
amended (16'U.S.C. 1456(e)), for activities under consideration that are
located within the coastal zone of a state which has a federally approved
coastal zone management program, the applicant has certified in the permit
application that the activity complies with and wfi1 be conducted in a
manner that is consistent with the approved state coastal zone management
program. By this publ$c notice, we are requesting the state's concurrence
with, objection to, or waiver of the applicant's certification. No permit
decision will be mede until one of these actions occur. For activities
within the coastal zone of New York State, the applicant's certification

DESCRIPTION OF WORK
The a~plica~t, Anthony Forosich, requests Department of the Army
~u~hor~zation to dredge withlO year maih~enance off an existing bulkhead
~nd install a'floating dock assembly in acanal off Southold Bay, Shelter
Island Sound, Suffolk County, New York.
The~ work e~tails dredging an irregular shaped area roughly 50 feet by
20 ~feet tO 4 feet below mean low Water. All dredged material
approximatet~ 50 cubi~ ya~ds~ w~.t) be~ d~sposed of at the Town Dump or
other suitable upland s~te.
In addition, it is proposed to install a floating dock assembly consisting
of a 4 foot by 12 foot hinged ramp and a 6 foot by 16 foot float secured
by {2) 8 inch diameter timber pilings.
The stated purpose of the proposed work is to provide safe mooring for
two pleasure craft.
The applicant estimates that maintenance dredging will be required 3-4
~imes during the ~ext ten years.

I am reminding the Board of Town Trustees that the above properties
are located in Harbor Lights Estates at Bayview and so being are
covered by Harbor Lights convenants and restrictions(map of Harbor
Lights Estates section one, filed June 8, 1965, map ~4~82, recorded
Suffolk County Clerks office, libor 5771, pages 28S-288). The ninth
restriction states thor: No owner shall have the right to construct
or maintain docks or other structures extending out and into the
canals.
The towm cannot approve the above applications for floating docks,
h~nged docks,~p~tforms, r8~mps, finger decks or any other structures.
The Board of Trustees have a copy of the covenants and restrictions
which I let t~em copy in August 1985, which are in effect until
June 1, 1995.
Eh-Consultants might try vo fight the Board because of the following:
The property of Howard Shapiro(lot 14 of Harbor Lights Estates) was
previously owned by George Koch, who in ~98~ applied to the To~ Board
for ~ocks and finger docks similar to Mr. Shapiro's requesv and I believe
it was approved by the Town. But the property was sold by Mr. Koch
Mr. Shapiro and the docks were never built by Mr. Koch, was a
established? I think no~. It was only e~ error madeeby the Board
because they were unaware they the Harbor Lights co~g~and resvric-
tions e×isted. This time around the same error should nov be made.
A suggestion would be to ask on ~.~Ua~p~p~ons if covenants ~nd
restrictions exist in the area's of the applicants and if so a copy
of same be presented with the application to be examined by the Board.
