Dear Ms. Ongloni:
The following action was taken by the Board of Town Trustees during
their regular meeting held on October 29, 1987 regarding the above referenced
application.
WHEREAS, Marie Ongioni, Esq. on behalf of Gregory Follari applied to the Southold Town
Trustees for a permit
under the provisions of the Wetland Ordinance of the Town of
Southold, application dated July 27, 1987, and
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a public hearing was held by the Town Trustees with
respect to said application on October 29, 1987 at which time all interested
persons were given an opportunity to be heard, and
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area, and
WHEREAS, the Board has considered all the testimony and documentation
submitted concerning this application, and
WHEREAS, the Board has determined that the project as proposed will
not affect the health, safety and general welfare of the people of
the town,
NOW, THEREFORE, BE IT
RESOLVED that Marie Ongioni, Esq. on behalf of Gregory Follari BE AND HEREBY IS
GRANTED PERMISSION UNDER THE
PROVISIONS OF THE WETLAND ORDINANCE OF THE TOWN OF SOUTHOLD TO:
Remove a natural berm approximately 55 ft. wide, 9 feet high spanning the width of the
subject property. All material will be used to regrade the plot m conformity with the
character of the neighborhood. Property is located on Sound Drive, Greenport.

This permit will expire on October 29, 1989 if work has
not commenced by said date. There are two inspections required and
the Trustees are to be notified upon the completion of the work.
Prior to the issuance of said permit by the Clerk, the applicant
shall file with the Clerk a certificate that he has public liability
insurance policies insuring against any liability which may arise
in the performar~ce of the operations pursuant to such permit in such
amount as shall be fixed by the Trustees, which said policies shall
name the Town as a name insured. Please take further notice that
this declaration should not be considered a determination made for
amy other department or agency which may also have an application
pending for the same or similar project.
Please be advised that there is a $10.00 Wetland Inspection Fee now due.
Upon remittance your permit will be forwarded by mail.
Return to the Building Dept. for a determination on tlie need of any other
town permits that may be required for this project.

that the project will not have a significant effect on the environment.

DESCRIPTION OF ACTION: To remove a natural berm approximately 55 ft. wide, 9

REASONS SUPPORTING THIS DETERMINATION:
1. An environmental assessment form has been submitted which
indicated that there would be no adverse effect to th~
environment should the project be implemented as planned.
2. Because there has been no response in the allotted ~ime from
the Southold Town Building Depn. and the New York Stane D.E.S.
it is assumed that there are no objections nor comments from
thos~ agencies.
3. Conservation Advisory Council recommended approval of the project.

granl the permit so that Mr, Follari can may seek the construction on this property.
As the application states regrading this bluff will be in conformity with the neighborhood
and the surrounding plots.

John Holzapfel: We recommended approval.
Trustee Smith: We didn't find a problem with it when we looked at it. We have to vote
on this, I don~t see a problem. ARe there any other comments? No comments.

Council held Thursday, September 17, 1987 the following
recommendations were made:
No. 561 - Stron§'s Marine Center- Recommend approval with
the stipulation that a 3 to 1 slope is maintained
so there as no undermining of the banks.
No. 562 - Joseph W. Henderson - recommend approval.
No. 563 R~bert Koch - Disapprove. The CAC suggests, that
since it is such a limited area, the applicant
pursue a consistant plan amon9 the 4 or 5 property
owners since they all are facing the same problem.
The environment would be better served with a
