PROPERTY FACTS/DESCRIPTION: The subject property is located along the northerly side of Paradise Point
Road, Southold. The May 22, 1998 survey map shows that the subject premises contains a total area of
approximately 25,000 sq. ft. and is improved with the following buildings: (1) one-story single-family dwelling
37.5 feet from Robinson Road, at its closest point; (2) 16' by 32' inground swimmingpool with wood deck, all
shown at 20 feet from the westerly side property line; (3) 10' by 12' (approx.) accessory shed "as built" north
of the existing swimming pool, and (4) to the north of all buildings, a brick patio and wooden bulkhead.
BASIS OF APPEAL: The Building Inspector's July 23, 1998 Notice of Disapproval, under Article XXIII, Section
100-239.4B which states that all buildings located on lots upon which a bulkhead exists and which are
adjacent to tidal water bodies other than sounds shall be set back not less than 75 feet from the bulkhead.
AREA VARIANCE RELIEF REQUESTED: By survey amended February 2, 1999, prepared by Anthony W.
Lewandowski, applicant is requesting a variance for a portion of a proposed new deck addition at 52.8+- feet
from the bulkhead at its closest point. (The accessory shed "as built," which was the subject of a denial by
the Board on 9-30-1998, is to be removed and therefore a variance is not being requested for a location
within 75 feet of the bulkhead.)
No other variances are requested.
REASONS FOR BOARD ACTION. DESCRIBED BELOW:
1. Grant of the area variance will not produce an undesirable change in character of neighborhood or a
detriment to nearby properties because the deck is not a fully enclosed addition and is open to the sky.
2. The benefit sought by the applicant cannot be achieved by some method, feasible for applicant to pursue,
other than an area variance because the lot is small.
3. The relief as requested in this application is not substantial. Only a small portion of the deck at the
northeast corner will need a variance, representing approximately 32 square feet of building area.
4. No factors are present to suggest that grant of the relief set forth below will have an adverse effect or
impact on the physical or environmental conditions in the neighborhood or district.

5. Grant of the relief set forth below is the minimum necessary and adequate to enable applicant to construct
a deck on his property while preserving and protecting the character of the neighborhood, and the health,
safety, welfare of the community.
RESOLUTION/ACTION: On motion by Member Collins, seconded by Member Tortora, it was
RESOLVED, to GRANT the variance as applied for, SUBJECT to the CONDITION that the deck shall remain
unroofed and 'open to the sky."

the Town of Southold, the following application will be held for public hearing_ by the
SOUTHOLD TOWN BOARD OF APPEALS, at the Southold TownHall, 53095 Main Road,
Southold, New York 11971, on THURSDAY, NOVEMBER 19, 199 at the time4 noted below (or
as soon thereafter as possible):

is requested for the reason that a shed be permitted 45' from existing bulkhead
and an attached deck 52' from bulkhead.

improved properties; the deck is also sheilded and encroaches no .

Based on the information you have submitted, the New York State Department of Environmental Conservation has
dewrntined that;
The property landward of the 10 foot elevation contour as shown on the survey prepared by Anthony W.
Lewandowski dated 5/4/98, last revised 3/2/99, is beyond the jurisdiction of Article 25 (Tidal Wetlands).
Therefore, in accordance with the current Tidal Wetlands Land Use Regulations (6NYCRR Part 66 1) no permit is
required under the Tidal Wetlands Act. Please be advised, however, that no construction, sedimentation, or
distwbance of any kind may take place seaward of the tidal wetlands jurisdictional Boundary, as indicated above, .
without a permit. Itis your responsibility to ensure that all necessary precautions are taken to prevent any
sedimentation or other alwation or disturbance p the ground surface or vegetation within Tidal Wetlands
jurisdiction which may result from your project. Such precautions tray include walnta,'r+ � adequate work area
between the tidal wetland jurisdictional boundary and your project (i.e. a IS' to 20' wide construction area) or.

Transmitted herewith please find NYSDEC Letter of Non -Jurisdiction relating to the
proposed attached deck which is the subject of an active Building Permit Application
before your Department for the property referenced above. I am unsure as to which
Building Inspector is reviewing this application although 1 am advised by Ms. Moore, Esq•
that a Building Permit would be issued immediately upon receipt of this approval.
'Kindly, admit this approval into the appropriate Building File and direct the issuance of the

Notwithstanding the preceding it is without .dispute that Mr.
Mortimer has a beautiful view to the North from his home and
that he deserves -an outside deck to maximize his enjoyment of
same'. My specific concerns 'about such a deck are twofold:
1) That the proposed encroachment of this deck
into .the statutory setback area will establish a pre—
cedent which will affect the future -placement of struc—
tures on the presently undeveloped lots surrounding the
basin and will change the rustic character of the area.
2) That the construction of this deck will be only
a prelude to some future application or applications for
a roof, t -hen -for screens or for sliding glass doors and
finally for a full year—round addition to the house.
In closing, let me state.that Mr. Mortimer would probably have
had his deck -in place to enjoy for all of last summer had he
simply discussed his plans with his immediate neighbors rather
than forging ahead on what appears to have been suspect infor—
mation concerning his rights to develop his property. I believe
that Mr. Mortimer should have his deck, but that it should be
reduced in size to eliminate the "area of non—conformity" and
that a strict condition be attached to prohibit any future
roofing over or other enclosure of the deck area.

FINDINGS OF FACT
PROPERTY FACTS/ DESCRIPTION: The subject property is located on the
northerly side of Paradise Point Road, Southold. The May 22, 1998 survey map shows
that the subject premises contains a total area of approximately 25,000 sq. ft. and is
improved with the following buildings: (1) one-story single-family dwelling 37.5 feet from
Robinson Road, at its closest point; (2) 16' by 32' in -ground swimming pool with wood
deck, all shown at 20 feet from the westerly side property line; (3) 10' by 12' (approx.)
accessory shed "as built" north of the existing swimming pool, and (4) to the north of all
buildings, a brick patio and wooden bulkhead.
BASIS OF APPEAL: Building Inspector's July 23, 1998 Action of Disapproval with respect
to Section 100-239.48 and the required 75 ft. setback from bulkheads adjacent to tidal
water bodies.
AREA VARIANCE RELIEF REQUESTED BY APPLICANT: The request made by
applicant is for (1) approval of the "as built" shed as located in the rear yard at
approximately 48 feet from the bulkhead; and for (2) permission to locate a proposed
raised deck addition at the rear of the dwelling at approximately 48 feet from the
bulkhead, at the closest points.
REASONS:
(1) An undesirable change will not be produced in the character of neighborhood or a
detriment to nearby properties because the new deck and shed will be located in
the rear of the house not visible from the street.
(2) The benefit sought by the applicant cannot be achieved some method, feasible for
applicant to pursue, other - than an area variance, because this lot is small.
Applicant has declined any suggestion of alternate relief and therefore altemative

My name is Peter A. Cooper, and I write to oppose the
granting of this application. I previously opposed this
application by letter of September of 24, 1998, and I would like
to include that letter in this one.
Enclosed is a letter from Douglas Barnard who lives
directly across the street from the applicant, and he joins me in
opposing the application.
The proposed deck will be 48.6 feet from the bulkhead
by the boat basin, down from the 52.8 feet of the existing
building. This reduction will create a precedent for the four
adjoining lots which are currently vacant. If they were similarly
developed with a 48.6 foot setback, the basin would be ringed
with houses, just like similar developments to the west and
down south, a result which would be out of character for the
surrounding area.
The problem is one of proportions.' The lot has 20,113
square feet of buildable area, a very small lot by Paradise Point
standards. The maximum allowable lot coverage is 4,023
square feet. The house is 1,645 feet according to the tax
assessors records. The adjoining pool and patio complex is
2,363 feet and the proposed deck is -695 feet.
The existing pool and patio form an integrated structure
which begins at grade level on the street side and ends up
substantially above grade as the land slopes down toward the
water. The enclosed picture shows the corner of it several feet
off the ground between the house and the shed. I'm not sure
how this stucture is counted when measuring lot coverage, but it
goes right up to the property line in disregard of 100-230 C(1).
The picture also shows where the shrubbery has been
removed from the house, and the sliding doors have been
installed to provide access to the proposed deck. The deck
would extend almost a third of the way toward the water, and it
would soar up over the land on tall supports, closing in on the
basin. If the other lots were similarly developed, it would not be
a pretty picture from the basin.
The house is modest in size, hardly big enough for the
Brady bunch. In contrast, the proposed deck and pool/patio
complex are almost twice as big and would do justice to a small
country club. If you add in all the other ground level walks,
stairs and patios, almost one third of the ground would be
covered. This result could not help but to reduce my enjoyment
of the basin and the value of my property.
Accordingly, I urge you to require that the proposed deck
be substantially scaled back to more acceptable proportions,
particularly where it reduces the setback below 52.8 feet and
that you restrict it to a deck only, without a fixed -pipe framework
for an awning or other roof, screens, windows or winterization.

My name is Peter A. Cooper, and I write to oppose the granting of this
application. I live three doors away from this property, and I make extensive use
of the boat basin on which the property fronts.
The Paradise Point area has 33 lots fronting on the private road part of
Paradise Point Road. This road was previously known as Robinson Road. Eight
lots are undeveloped. Three are south of the road, at the entrance, and are
more than two acres each. One will be developed within a few months. The
remaining five lots are all located around the boat basin. Two other lots have
been developed at the basin: one is the subject of this application, and the other
is two lots away and sits back from the water on a 1.19 acre parcel.
The Mortimer parcel was established in a major subdivision in 1963, and
the 1,645 square foot house was built in 1966 on the 20,000+ square foot
upland area. Prior owners enclosed the porch on the northeast corner in 1988
and built the pool in 1995. An application to build a 400 square foot garage in
the front yard facing the street was denied last Fall. This application is for a
variance to build a 750 square foot deck in the front yard facing the water and to
approve the prior placement of a shed between the pool patio and the water.
The deck would be half again as big as the house.
Another issue noted by the inspector is the fact that the brick pool patio
was built right to the fence on the side property line.
The enclosed porch in the main structure already is less than 75 feet from
the water. To allow the shed and deck to come even closer, to within 48 feet, will
make it extemely difficult to keep the development of the other lots on the basin
from getting that close as well. The Mortimer property would then become the
rule rather than the exception, and that would be contrary to the established
character of Paradise Point.
Mr. Mortimer has owned this property for only a few months and probably
has not learned what the rest of us have found out about our decks and patios.
There is a large wetland two lots away which breeds world-class mosquitos,
which, together with the black flies, make most decks uninhabitable much of the
time. I believe that the absence of strong breeze in the basin area to inhibit the
bugs and the prior owner's destruction of many of the trees on the lot will
inevitably lead to a request to erect an awning and screens. It is then just a short
step to making this arrangement permanent so that it can be used in the winter.
This has already happened with the porch on the northeast corner, and the size
of the proposed deck makes it about the right proportions for an enclosed
addition.
The nomads in the Sahara Desert have learned that, once the camel gets
his nose in the tent, the whole camel will inevitably follow. As I pointed out at the
hearing on the garage, this lot is already fully developed when compared to other
homes in the area. The addition of the pool in 1995 simply used up all the space
on this small lot, and I urge you to turn down the current application.
If you are inclined to allow a small deck along the water side of the house,
for access to the pool, I hope you will make it clear that it has to remain just a
deck, without awnings or screens or any other structure that will make it appear
to be an addition to the house.
Similarly, the shed should be relocated so that it becomes part of the
house. It sticks out like a sore thumb where it is, particularly without any
landscaping.
Finally, the pool patio needs to end short of the property line as required
by the Code, and the intervening space needs to be landscaped. This will
provide privacy for the Mortimers and make the pool blend into its surroundings.

An application for a variance was submitted by Suffolk
Environmental Consultants. The amended application is for a deck
width of 14.5' and 13' as shown on the enclosed survey. The
existing setback of the corner of the house, closest to the
bulkhead, is 52.81, the deck has been designed to substantially
conform to the existing setback. The proposed deck only encroaches
by 28 sq.ft. Please note, Mr. Mortimer will remove the existing
shed.
It is my understanding that you requested a survey showing the
proposed deck and setback to bulkhead.
Enclosed please find survey (3 prints) prepared by Anthony
Lewandowski last amended February 2, 1999. The surveyor has shown
the exact dimensions of the proposed deck and the area of non-
conformity of 28 sq.ft. The last dimension which you requested is
from the corner of the proposed deck (area of nonconformity) to the
bulkhead. Measured on the survey it is approximately 451. 1- -have
requested this information from Mr. Lewandowski but I do not know
the status of my request because he is not answering his telephone.
We would ask that the board proceed with the application and
schedule a hearing.

at Town Hall with regard to the Mortimer's variance request, I wish for you to have this corre-
spondence as a matter of authorization.
We will be departing for Florida this weekend, hence I will not be able to attend any upcoming
meeting(s). Therefore, I will , by this letter, be joining you in objecting to the requested vari-
ance.
This must be understood that my action in no way is to be regarded as one of confrontation with
the Mortimers, but rather a matter of following the guidelines established by the founding mem-
bers of the Paradise Point Association .
I can well recall that when Jessica & I first became members back in 1967 the Messrs. Sinning,
Hallenbeck, Shaw, Elfers, Rimmler etc. made it very clear that the zoning precepts were to be
followed religiously. They emphasized that it was not so much the request of a current owner
that concerned them but, rather what a subsequent owner of the property might do. That is, for
example, would granting a variance on a deck today become an enclose area in the future by a
following owner?
Also, does a precedent become established on one lot that could effect other adjacent lots in the
future thus creating a domino effect in breaking down zoning regulations? This crosses my mind
when you consider that around the Boat Basin there are Lots 17 & 1, plus the Elfer & Boyd lots
on which structures most probably will be built in years ahead.
Therefore,only in consideration of the Association's future welfare in this regard, I join you in
citing that this variance request not be granted.

JOHN ANDREJACK: We went to great lengths to keep it inside and
outside of the 75' wetlands setback. However, we feel due to
the cost of construction when they dig the foundation probably
because it is so close to that water we will be in the
wetlands. Also upon looking in the 75' wetlands setback there's
been some significant dumping in there. There are weeds and
Christmas trees and other garbage. We'd like to clear out some
of the leaves and the garbage in the middle area.there and
actually plant a lawn.
TRUSTEE KRUPSKI: Our standard procedure on these is that we
don't have a problem with most of what you are saying but.we
-would want a 10' non -turf area between the top of the bank and
the upland. So during construction we are gonna require you'to

NOTICE IS HEREBY GIVEN, pursuant to Section 267 of the Town Law and the Code of
the Town of Southold, the following application will be held for public hearing by the
SOUTHOLD TOWN BOARD OF APPEALS, at the Southold Town Hall, 53095 Main Road,
Southold, New York 11971, on THURSDAY, APRIL 22, 1999 at the time noted below (or as
soon thereafter as possible):
8:10 p.m. Appl. No. 4636 - PATRICK MORTIMER. A Variance under
Article XXIII, Section 100-239.4B is requested for a deck addition, as shown on
survey amended by March 2, 1999 and March 18, 1999, to be located at less
than 75 feet from the existing bulkhead at 3895 Paradise Point Road, Southold,
NY; Parcel 1000-81-1-8.
The Board of Appeals will at said time and place hear any and all persons or
representative desiring to be heard in the above application or desiring to submit
written statements before concluding the hearing. Each hearing will not start earlier

Re: Chapter 58 - Public Notice for Thursday, April 22, 1999 Hearing
Dear Applicant:
Please find enclosed a copy of the Legal Notice describing your recent application. The
Notice will be published in the next issue of the Suffolk Times newspaper, the Town's
official newspaper for 2/1999-2/2000.
Pursuant to Chapter 58 of the Southold Town Code (copy enclosed), formal notice of your
application and hearing must be mailed and shall include a map or sketch showing the new
location with the setbacks and use noted. Send this Notice, as soon as possible, with the
map to all owners of land (vacant or improved) surrounding yours, including land across
any street or right-of-way that borders your property. Use the current addresses shown on
the assessment rolls maintained by the Town Assessors' Office (765-1937) or the County
Real Property Office in Riverhead. If you know of another address for a neighbor, you may
want to send the notice to that address as well.
Please submit your Affidavit of Mailing to us by the Friday before the hearing date, with the
post office receipts postmarked. Later, when the green signature cards are returned to you
by the Post Office, please mail or deliver them to us. If any signature card is not returned,
please advise the Board at the hearing.
You must post the enclosed sign no later than. 4/14/99. Post the sign facing the street, no
more than 10 feet from your front property line bordering the street. (If you border more
than one street or roadway, a sign is enclosed for the front yard facing each one.) The
sign(s) must remain in place for at least seven (7) days, and if possible, should remain
posted through the day of the hearing. If you need a replacement sign, please contact us.
After the signs have been in place for seven (7) days, please submit your Affidavit of
Posting to us for the permanent file.
If you do not meet the deadlines stated in this letter, please contact us promptly. It may
be necessary to postpone your hearing if the required steps are not followed.
