PROPERTY FACTS/DESCRIPTION: The applicant's property consists of 4,485 sq. ft. with
43.0 ft. along Village Lane (Main Street), in Orient. A two-story frame house has been
demolished and is being replaced with a 2 -story house in the same footprint. There is a
accessory garage in the rear yard measuring 12 x 20 feet.
BASIS OF APPLICATION: The Building Inspector's Notice of Disapproval dated September
23, 1999 denied authorization for a balcony addition to the house, and for a garage
expansion, because these elements would increase lot coverage from the existing 25% to
29.9%. Code section 100-30A.3 limits coverage to 20%. The denial also states that the
garage expansion violates the 3 -foot lot line setback requirement of Code Section 100-
30A.4, which refers to Section 100-33(B)(1), and that the house violates the 10 -foot side yard
setback of Code Section 100-244(B).
AREA VARIANCE RELIEF REQUESTED: Applicant requests authorization to build a new
house in the footprint of the demolished house, with addition of a rear balcony, and to
expand the garage width by 8.5 feet to 20.5 feet. Existing lot coverage (former house
footprint plus garage) is 25%. The proposed balcony of 50 sq. ft. adds 1.1% to lot coverage,
and the proposed garage expansion of 170 sq. ft. adds 3.8% to coverage. Applicant
therefore requests a variance authorizing total lot coverage of 29.9%.
Applicant's plans show that the existing garage is 2 feet from the rear lot line, and
that the expanded portion will also be 2 feet from the line. Code section 100-242(A) allows
enlargement of a nonconforming building (i.e., one with nonconforming setbacks) provided
the degree of nonconformance is not increased. The Board therefore concludes that no
variance is needed for the 2 -foot setback of the garage addition from the rear lot line.
Applicant has obtained a building permit to erect a new house in the footprint of the
demolished structure.
REASONS FOR BOARD ACTION, DESCRIBED BELOW: On the basis of testimony
presented, materials submitted and personal inspection, the Board makes the following
findings:

(1) Village Lane was built up in the 18th and 19th centuries. The lots are small and
many have high percentages of lot coverage generally as a result of construction which
occurred long before the adoption of a zoning law in Southold Town.
(2) Applicant purchased a property on which coverage, at 25%, is already high.
Because the lot is one of the smallest in the neighborhood, 25% coverage results in a
significantly crowded appearance. (In this connection, the Board notes that members were
able to view the property before the former house was demolished.)
(3) Applicant has created his current difficulty by proposing an expansion. Even
though coverage is already at 25%, Code section 100-242(A) would allow repair and
renovation of the structures so long as the degree of nonconformance (i.e., excess
coverage) was not increased; however, any expansion requires a variance.
(4) The requested variance allowing 29.9% coverage is substantial, in terms both of
the increase in the coverage percentage and of the proposed actual amount of coverage.
On a Town -wide basis, the Board has been generally reluctant to authorize lot coverage
much above 25%. In previous cases where applicants on Village Lane have sought to
increase lot coverage, the highest coverage percentage the Board has authorized is 26%.
(5) Grant of the relief set forth below will enable applicant to make some changes in
the house and garage. The relief will not produce an undesirable change in the character of
the neighborhood or detriment to nearby properties because the resulting increase in
coverage will be very limited, and because the applicant's project is expected to improve
the appearance of the property, to the benefit of the neighborhood.
(6) There is no evidence that grant of the relief set forth below will have an adverse
effect or impact on physical or environmental conditions.
(7) The action set forth below is the minimum necessary and adequate to enable
applicant to enjoy the benefit of a new house and renovated accessory garage on his
property while preserving and protecting the character of the neighborhood and the health,
safety and welfare of the community.
RESOLUTION/ACTION: On motion by Chairman Goehringer, seconded by Member Collins, it
was
RESOLVED, to DENY the variance applied for and ALTERNATIVELY to GRANT
a variance authorizing total lot coverage not to exceed 27.0% of the total lot area, subject to
the following CONDITIONS:
(1) The renovated garage shall be an accessory use of the owner as permitted by
Code and shall under no circumstances be used as sleeping or habitable quarters.

(2) The renovated accessory garage shall be set back at least two (2) feet from the
rear property line, as set forth in applicant's architectural drawing dated August 10, 1999.
(3) If woodworking facilities, accessory to the owner's residence on the property, are
installed in the renovated garage as applicant has stated will be done, the garage shall be
insulated in a manner that protects the neighborhood from excessive workshop noise.
(4) The height of the renovated garage shall comply with the requirements of the
Code in the manner set forth in the letter of November 30, 1999 from applicant's attorney.

I have reviewed your letter dated June 8, 2015 requesting a de minimus determination in the above
referenced ZBA decision. The bathroom originally proposed in the 1999 application was removed in
relationship to proposed habitable space in the accessory garage which was also eliminated. Since half
baths are permitted in accessory structures by code, the addition of same is not in conflict with the 1999
decision.
Based upon the information provided above, I have determined that your requested modification is de
minimus in nature because no additional nonconformity will be created, and the intent of the original
ZBA decision will not be altered. Please also note that the applicant must comply with Chapter 236 of the
Town's drainage code.

Dear Ms. Weisman and Board members:
The building department recommended that I submit this letter to the Board
regarding the above property.
I filed a building permit application for an "as built" '/Z bathroom in the existing
garage. In 1999 Mr. and Mrs. Poggi received a variance to construct the garage,
Enclosed for your convenience is Appeal #4761 together with a letter made part of that
file, Mr. Poggi was permitted to use his garage as a "work shop", provided he insulated
the garage to mitigate possible noise from his work shop. During the hearing, the
Zoning Board requested a letter from me, his attorney, stating that the garage would not
be used as sleeping quarters and in my letter I stated that no bathroom was proposed.
At the time Mr. Poggi did not intend to have a bathroom in the garage.
Sometime after 2010, the owners added a Y2 bathroom on the first floor of the
garage adjacent to the workshop.
The building department suggested that I submit this letter because 1/2
bathrooms are permitted and are customary in accessory structures. It is my
understanding that they would issue a building permit for the 'h bathroom.
Please advise if the Board will require my client to amend #4761 variance in
order to obtain a building permit.

Pursuant to Town Law section 267b-3 the Southold
Town Zoning Board of Appeals is to analyze and asses the
personal benefits anticipated by the applicant against
the potentially deleterious effects that a grant of the
relief requested would have on the health, safety and
welfare of the effected neighborhood or community. In
performing this balancing test, the Zoning Board is
charged with the responsibility to consider the five
factors enumerated in Town Law Section 267b -3(b). The
variance should be granted for the following reasons:
1. No undesirable change will be produced in the
character of the neighborhood or a detriment to nearby
properties, if the variance is granted.
The property is located in the Hamlet of Orient on
Village Lane, this home as well as the homes in the
surrounding area are very small on very small lots. The
Poggi parcel is only 4,485 square feet, being only 50.53
feet wide by less than 100 feet in depth. The property
contains an old house which is awaiting a building
permit for a complete renovation. The permit for the
renovation will not require any variances. However,due
to the size of the property any addition to the
footprint will increase the lot coverage. The subject
application is for a SO square foot balcony added onto
the House. The balcony will increase the lot coverage
by 50 square feet.
In addition, the owner, Mr. Poggi, will be
undertaking the renovations of the house. He intends to
make this his project/Hobby which may take him several
months if not years. The existing garage will be
renovated and expanded to provide the work shop for the
renovation of the House as well as sleeping quarters
while his house is torn apart and gutted. The garage
will not contain a Kitchen.
The renovation of the Orient House will be in
keeping with the character of the area. This home will
add to the beauty and character of Orient.

renovation is undertaken and ultimately provide a second

5. The alleged difficulty was not self-created
The existing residence and structures are already at

established. The setback of the existing garage is
already at 2 feet from the rear property line. We would
respectfully request that the Zoning Board consider the
historic interpretation of the setback requirements,
that provided the existing setbacks (21) are not
increased, construction may be up to the pre-existing
nonconforming setback of existing structures. As of
recently, the building department recognized the
existing setbacks as the established setbacks.
6. The variance requested is the minimum variance
practicable given the personal benefits anticipated by
the applicant. The existing residence is very small,
the lot is undersized, and the variance requested is
minimal (only 4.90), given the limitations of the
property and the existing structures, the variance

which reflect the above. I will forward a copy of this
letter and plans to the building department for their
review. Because the garage has been revised to eliminate
the living space, I do not believe that the notice of
disapproval needs to be amended.

I write to you again concerning the accessory building under construction at 1740 Village Lane in Orient.
To remind you of the case: Mr. Poggi, who had been asking for a 29.9% lot coverage, was granted a 27%
variance by your board. In your deliberations concerning this variance you indicated that the increase from
25.5% to 27% on a lot of this size would entitle Mr Poggi to an additional 90 square feet of space To
date the construction on site has added an addition of five feet by ten feet to the accessory structure, and
a balcony of six and a half feet by eight feet to the main house. By my calculations this adds up to 102
square feet or more than is allowed by the variance granted. Please see the attached documentation,
supplied for your reference.
Before any additional building is allowed we have asked the building department to explain to us, as the
immediate neighbors affected by the overbuilding of this lot, how the structure that is currently being
erected by Mr. Poggi conforms to the variance issued by the Zoning Board of Appeals. However we also
would appreciate it if you would review the case and confer with the building department to make sure
that your ruling is being complied with.
Specifically we are concerned that in addition to what has already been built, a staircase that is proposed
for the rear of the accessory building (and which has not yet been constructed) would add significantly to
non-compliance on this lot. You will recall that Mr Poggi indicated to you in his presentation that the
second floor of this accessory building is intended to be used for storage only We have consistently
pointed out to you, and to the building department that his intention is to use it as a second bedroom

We, the undersigned, wish to welcome Mr Poggi and his family to the community of Orient, and wish to
encourage him in his restoration of the property at 1740 Village Lane. As he indicated in the Landmark
Preservation Commission hearing (November 14th,1999) into the demolition of the existing building, his
intention is to restore the property exactly as it was.
We are concerned that the current application for a variance will result in the construction of an
"accessory" building which will immediately, or at some point in the future be used as a second habitable
structure. We urge you to consider carefully the detrimental effect that allowing Mr. Poggi to build this
two story "accessory' structure will have on our community, and we ask that you reject the application.

7:15 p.m. Appl. No. 4765 - FRANK FIELD REALTY. In this proposal to locate a new dwelling in
addition to other dwellings on this 22,526+- sq. ft. lot, applicant requests Variances from the Zoning
Ordinance: (1) under Article III -A, Section 100-30A, to add another dwelling on this 22,526+- sq. ft.
parcel; (2) under Article III -A, Section 100-30A, to remove prior ZBA Conditions set forth in Appeal No.

nonconforming (22,524+- sq. ft.). Article XXIV, Section 100-244B requires a 40 feet minimum front yard
setback and a fifteen ft.,minimum side yard setback."
The setbacks proposed for an additional dwelling on this 22,524 sq. ft. lot are less than 25 feet for both
sides, and one side yard at less than 15 feet. (This notice is based on the original application filed with

NOTICE OF PUBLIC HEARING
§ 58-1. Providing notice of public hearings.
[HISTORY: Adopted by the Town Board of the Town of
Southold 12-27-1995 as L.L. No. 25-1995. Amendments
noted where applicable.]
§ 58-1. Providing notice of public hearings.
Whenever the Code calls for a public hearing, this section
shall apply. Upon determining that an application is complete,
the board or commission reviewing the same shall fix a time
and place for a, public hearing thereon. The board or commission
reviewing an application shall provide for the giving of notice:
A. By causing a notice giving the time, date, place and
nature of the hearing to be published in the official
newspaper within the period prescribed by law.
B. By requiring the applicant to erect the sign provided by
the town, which shall be prominently displayed on the
premises facing each public or private street which the
property involved in the application abuts, giving notice
of the application, the nature of the approval sought
thereby and the time and place of the public hearing
thereon. The sign shall be set back not more than ten
(10) feet from the property line. The sign shall be
displayed for a period of not less than seven (7) days
immediately preceding the date of the public hearing.
The applicant or his/her agent shall file an affidavit that
s/he has complied with this provision.

of record of every property which abuts and every

NOTICE IS HEREBY GIVEN, pursuant to Section 267 of the Town Law and Chapter 100 (Zoning), Code
of the Town of Southold, the following application will be held for public hearing by the SOUTHOLD TOWN
BOARD OF APPEALS at the Town Hall, 53095 Main Road, Southold, New York 11971, on THURSDAY,
NOVEMBER 18, 1999 at the time noted below (or as soon thereafter is possible):
7:20 p.m. Appl. No. 4761 - RICHARD POGGI. This is an application requesting Variances based upon
the Building Department's September 23, 1999 Notice of Disapproval, under Article XXIV, Section 100-242A,
Article III -A, Section 100-33A.4; Article XXIV, Section 100-2446, and Article III, Section 100-33B.1, for the
reason that "...Existing structures are nonconforming on this lot in an R-40 Zone by virtue of the existing
setbacks and present lot coverage. The lot coverage is proposed to exceed the present lot coverage
nonconformity (increase from 25% to 29.9%); the setback for the proposed addition to the principal building is
one foot, more or less (instead of the code requirement of ten (10) feet); the setback proposed for the addition
to the accessory structure is two feet (instead of the code requirement of three (3) feet). Location of Property:

Dear Applicants:
Please find enclosed a copy of the Legal Notice describing your recent application. The
Notice will be published in the .next issue of the Suffolk Times.
Pursuant to Chapter 58 of the Southold Town Code (copy enclosed), formal notice of your
application and hearing must be mailed and shall include a map or sketch showing the new
location with the setbacks and use noted. - Send this Notice CERTIFIED MAIL, RETURN
RECEIPT REQUESTED, as soon as possible, with a copy of the map to all owners of land
(vacant or improved) surrounding yours, including land across any street or right-of-way
that borders your property. Use the current addresses shown on the assessment rolls
maintained by the Town Assessors' Office (765-1937) or the County Real Property Office in
Riverhead. If you know of another address for a neighbor, you may want to send the
notice to that address as well.
Please submit your Affidavit of Mailing to us by the Friday before the hearing date, with the
post office receipts postmarked. Later, when the green signature cards are returned to you
by the .Post Office, please mail or deliver them to us. If any signature card is not returned,
please advise the Board at the hearing.
You must post the enclosed sign no later than 11/11/99. Post the sign facing the street,
no more than 10 feet from your front property line bordering the street. (If you border
more than one street or roadway, a sign is enclosed for the front yard facing each one.)
