Generally, the only tidal wetland areas considered jursidictional on Fishers Island are those of West and Hay Harbors. All open sound areas and unprotected/non-vegetated coves are considered non-jurisdictional. Shortly, when the "Sound" areas are returned to the wetlands ordinance and we implement the recently approved Town Coastal Erosion Hazard Act the owners may wish to grandfather their structures. Brede~neyer: This letter is to notify you of the project status of the maintenance dredging of the channel into the Fishers Island terminal at Silver Eel Cove on Fishers Island and the new off-loading site for the disposal of dredged materials. The pro3ect has been advertised and a iow bidder determined. The low bidder has suggested that the east end of the wood timber pier be utilized for off-loading since it will be more accessible, and therefore ~re efficient, cleaner and less costly. Accordingly it is anticipated that this site will be used; attached you will find a copy of the plan for this site and the sediment controls which will be used during off-loading. We are providing simultaneous notification to the NYS DEC and the Corps of Engineers of this proposal; I have already spoken with Mr. Chuck Hamilton, of the DEC Marine Habitat Protection Section, and he had no objection to the proposal. I understand that there may be scme circumstances which make implementation of this proposal complex, however in view of the overall good of the public, and on behalf of the Fishers Island Ferry District, I respectfully request that you approve the concept, subject to whatever stipulations are necessary to assure conformance with State regulations. Please consider the following: -The channel into Silver Eel Pond must be dredged of acretlng sand soon in order to allow continued access by the Fishers Island Ferry. Approximately 3,500 CY of sand is to be r~noved. The sand is uniformly fine grained, clean~ lacking aRpreciable organics and, after two weeks of storage at the lab, ~mersed samples emit only a relatively slight oder; dry portions of the sample were basically oderless. In view of the location of the acreting bar, being in a high energy environment due to waves, currants and propellar turbulence, these characteristics are to be expected. -It is our understanding that capping material and a capping plan is needed for the daily operations of the landfill and, although the anticipated volume would only cover an acre or so, this material could ccme at a pre~i~ if other (including off-island) sources must be relied on. -I have spoken with the Fishers Island Conservancy and they support the proposed project, so long as bulk sediment and leaching characteristics are within prescribed guidelines, a concern which we all share. -There are options to this proposal, however it is felt that this is the most beneficial alternative. To use the sand as be~ch nourishment may render it susceptable to being redeposited in the channel, and if no other options are available, the Connecticut DEP may allow its disposal at the New London Dumping Grounds to no ones real benefit. I feel that this is an opportunity for many to benifit frc~ a job which must be done anyway and might otherwise be less productive. Your favorable consideration is respectfully requested. There shall be no unreasonable interference with navigation by the work herein authorized. 7. The Department reserves the right to reconsider this approval at any time and after due notice and hearing to con- tinue, rescind or modify this permit in such a manner as may be found to be just and equitable. If upon the expiration or revocation of this permit, the modificatio~ of the tidal wetland hereby authorized has not been completed, the Applicant shall, without expense to the State, and to such extent and in such time and manner as the Department of Environmental Conservation may require, remove all or any portion of the uncompleted structure or fill and restore the site to its former condition. No claim shall be made against the State o~ New York on account of any such removal or alteration. 8.
