Dear Mr. J~st,
The following action was taken by the Board of Town Trustees
during its regular meeting held on June 29, 1995 regarding the
above matter:
WHEREAS, J.M.O. Consulting, on behalf of FISHERS ISLAND
DEVELOPF~qT CORPORATION, applied to the So~thold Town Trustees
for a permit under the provisions of the Wetland Ordinance of
the Town of Southold, application dated April 4, i995, and,
WHEREAS, said application was referred to the Southold Tow~
Conservation Advisory Coullcil for their findings and
recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on June 29, 1995, at which time all
interested persons were given an opportunity to ~e heard, and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WR]~.REAS, the Board has considered all the testimony and
documentation submitted concerning this applications and,
WHEREAS, the structure eomplies with the standard set forth in
Chapter 37-18 of the Southold Town Code,
WHEtbEAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approves the application of
FISHERS ISLAND DEVELOPMENT CORPORATION to install 2- I0' X 16'
floats, 4- 10' X 16' floats, 4~ 6' X 18' floats, replace open
pile lost in 12/94 storm, relooate 2 existing piles and install
4 new spring piles at existing yacht clUb all as per s~rve¥
dated April 5, 1995.
Permit to construct project will expire two years from the date
it is signed. Fees must be paidf if applicable, and permit
issued within six months of the date of this notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.

RESOLVED that pursuant to Article 8 of the Environmental Conservation
Law, State Environmental Quality Review and 6NYCRR Part 617,
Section 617.10 and Chapter 44 of the Code of the Town of Southold,
notice is hereby given that the Southold Town Trustees, as Lead
Agency for the action described below, has determined that the
project will not have a significant effect on the environment.
Please take further notice that this declaration should not be
considered a determination made for any other department or agency
which may also have an application pending for the same or similar
project.
TYPE OF ACTION: Type I
DESCRIPTION OF ACTION: Applicant requests a Wetland Permit to
install two 10' X 16' floats, four 10' X 16' floats, four 6' X 18'
floats, to replace open pile lost in 12/94 storm, to relocate two
existing piles and to install four new spring piles at existing yacht
club. As per survey dated April 5, 1995

1. An on site inspection has been conducted by the Board of
Trustees.
2. An environmental assessment, submitted by the applicant and
reviewed and completed by the Board of Trustees, has indicated that
no significant adverse effects to the environment are likely to occur
should the project be implemented as planned.

Purpose: The full EAF is designed to help applicants and agencies determine, in an orderly manner, whether a project
or action may be significant. The C uestion of whether an action may be significant is no[ always easy to answer. Frequent-
Iv. there are aspects of a project that are subjective or unmeasureable. It is also understood that those who determine
significance may have little or no formal knowledge of [he environm_ent or may not be technically expert in environmental

A~ the*~present time, ~e are requesting to modify this
project. I would like to address the actual namer Fishers
Islaud Yacht Club. Although it is the Yacht Club the
property is actually owned by the Fishers Island Development
Corporation (FIDCo). ] have been instructed by FIDCo to have
the correct name shown. The mailing add~oss remains the
sa=e. lqe are also requesting to modify this project to allow
for tho following:
1. That the (2) approved 10'x 16' floats shall be
installed in a slightly different configuration.
2. That tho (4) approved 12~x 16' floats have been
reduced In size to 10'x !6-£1oats.
3. That the (4) at!l~roved t'x 18' floats have been
increasod in size to 6'i 18' floats.

of the site plan which has been modified to depict these

The permitted site or facility, including relevant records, is subject to in-
spection at reasonable hours and intervals by an authorized representative of
the Deparl~unt of Enviro~,','untal Conservation (the Deparb~'unt} to determine
whether the permittee is c~'plying with this permit and the ECL. Such represen-
tative tray order the v~rk suspended pursuant to ECL 71-0301 and S&PA 401(3). A
copy of this permit, including all referenced rraps, drawings and special
conditions, must be available for inspection by the Depari,unt at all tirms at
the project site. Failure to produce a copy of the permit upon request by a
Deparb~unt representative is a violation of this permit.
Permit Changes and Pene~als
2. The Deparb~'ent reserves the right to rn~ify, suspend or revoke this permit v~en:
a) the scope of the permitted activity is exceeded or a violation of any
condition of the permit or provisions of the ECL and pertinent regula-
t ions i s found;
b) the-permit was obtained by misrepresentation or failure to disclose
relevant facts;
c) nevvrraterial info.~ution is discovered; or
d) environ'~ental conditions, relevant technology, or applicable law or
regulation have rraterial ly changed since the permit v~s issued.
The permittee rrust sul~nit a separate written application to the Depar~unt for
renewal, rr~ification or transfer of this permit. Such application rrust include
any forms, fees .or supplu~untal information the Deparlment requires. Any
renewal, n-edificatmn or transfer granted by the Depari. unt trust be in writing.
The permittee rrust sub-nit a renewal application at least:
a) 180 days before expiration of permits for State Pollutant Discharge
El iminat ion System (SFDES), Hazardous V~ste Managu~unt Facilities
(PI/I~), major Air Poi lution Control (AFC) and Sol id ~ste IVbnaga~unt
Facilities (ECF~F); and
b) 30 days before expiration of all other permit types.
Unless expressly provided for by the Deparb~unt. issuance of this permit does
not rrodify, supersede or rescind any order or determin~.tion perviously issued by
the Deparb~ent or any of the te,~. conditions or requlru~unts contained in such
order or determination.

Legal Cbligations of Pe~ittee
The permittee has accepted expressly, by the execution of the application, the
full legal responsibility for all da~uges, direct or indirect, of ~atever
nature and by ,~hu~uver suffered, arismg out of the project described in this~
permit and has agreed to indumify and save harmless the State frcrn suits,
actions, damages and costs of every na~u and description resulting fro-n this:
project.
This permit does not convey to the permittee any right to trespass upon th~
ands or interfere with the riparian rights of others in order to perform the
permitted work nor does it authorize the impaiment of any rights, title, or
interest in real or personal property held or vested in a person not a party to
the permit.
8. The permittee is responsible for obtaining any other permits, approvals, lands

If granted under 6 NYCRR Part 608. the NYS Deoartment of Environ-
mental Conservation hereby certifies that the sublect promct will
contravene effluent limitations or other limitations or standards under
Sections 301. 302 303. 306 and 307 of the Clean Water Act of 1977
(PL 95-217) urovided that all of the conditions listed herein are met.
All activities authorized by this permit must be in strict conformance
with the approved plans submitted by the applicant or his agent as part
of the permit application.
Such approved plans were prepared by Chandler ~ Palmer
& King on 3/22/95 .
SPECIALCONDITION$
Floats and ramps may not rest on or be stored in any
vegetated tidal wetland.
No permanent structures may be installed on
dock/catwalk/float without first obtaining written
Department approval (permit, modification or amendment).
Docks/catwalks/floats may not (a) extend laterally beyond
property lines, (b) be placed so that docked boats extend
over adjacent property line, (c) interfere with navigation,
(d) interfere with other landowners riparian rights.

SUPPLEMENTARY SPECIAL CONDITIONS
The following conditions apply to all Tidal wetlands; Freshwater
Wetlands; Coastal Erosion Management; and Wild, Scenic, and
Recreational Rivers Permits=
A copy of this permit, including all conditions and
approved plans, shall be available at the project site
whenever authorized work is in progress. The permit
sign enclosed with the permit shall be protected from
the weather and posted in a conspicuous location at the
work site until all authorized work has been completed.
The permittee shall require that any contractor,
project engineer, or other person responsible for the
overall supervision of this project reads, understands,
and complies with this permit and all its general,
special, and supplementary special conditions. Any
failure to comply precisely with all of the terms and
conditions of this permit, unless authorized in
writing, shall he treated as a violation of the
E~vironmental Conservation Law. If any of the permit
conditions are unclear, the permittee shall contact the
Division of Regulatory Affairs at the address on page
one or telephone (516) 444-0365.
If project design modifications become necessary after
permit issuance, the permittee shall submit the
appropriate plan changes for approval by the Regional
Permit Administrator prior to undertaking any such
modifications. The permittee is advised that
substantial modification may require submission of a
new application for permit.
At least 48 hours prior to commencement of the project,
the permittee and contractor shall sign and return the
top portion of the enclosed notification form
certifying that they are fully aware of and understand
all =erms and conditions of this permit. Within 30
days of completion of the permitted work, the bottom
portion of that form shall also be signed and returned,
along with photographs of the completed work and, if
required, a survey.
For projects involving activities to be undertaken in
phases over a period of more than one year, the
permittee shall notify the Regional Permit
Administrator in writing a= least 48 hours prior =o
recommencing work in subsequen= years.
The granting of this permit does not relieve the permittee
of the responsibility of obtaining a grant, easement, or
other necessary approval from the Division of Land
Utilization, office of General Services~ Tower Building,
Empire State Plaza, Albany, NY 12242 (516) 474-2195, which
may be required ~or any encroachment upon State-owned lands
undel~water.
