GENERAL CONDITIONS
Inspections
1. The permitted site or facility, including relevant records, is subject to inspection at reasonable hours
and intervals by an authorized reeresentative of the Department of Environmental Conservation (the
Department) to determine whether the permittee is complying with this permit and the ECL. Such
representative may order the work suspended pursuant to ECL 71-0301 and SAPA 401(3). A copy of
this permit, including el referenced maps, drawings and special conditions, must be available for
nsDection by the Department at all times at the project site. Failure to produce a copy of the permit
upon request by a Department representative is a violation of this permit.
Permit Changes and Renewals
2. The Departmen! reserves the right to modify, suspend or revoke this permit when:
a) the scope of the permitted activity is exceeded or a violation of any condition of the permit
or provisions of the ECL and pertinent regulations is found;
b) the permit was obtained by misrepresentation or failure to disclose relevant facts;
c~ new material information is discovered: or
d) environmental conditions, relevant technology, or applicable law or regulation have materially
changed since the permit was issued.
3. The permittee must submit a separate written application to the Department for renewal, modifica-
tion or transfer of this permit. Such application must include any forms, fees or supplemental infor-
mation the Department rec uires. Any renewal, modification or transfer granted by the Department
must be in writing.
4. The permittee must submit a renewal application at least:
a) 180 days before expiration of permits for State Pollutant Discharge Elimination System (SPDES),
Hazardous Waste Management Facilities (HWMF), major Air Pollution Control (APC) and Solid
Waste Management Facilities (SWMF); and
b) 30 days before expiration of all other permit types.
5. Unless expressly provided for by the Department. issuance of this permit does not modify, supersede
or rescind any order or determination previously issued by the Department or any of the terms con-
ditions or requirements contained in such order or determination.
Other Legal Obligations of Permittee
6. The permittee has accepted expressly, by the execution of the application, the full legal responsibili-
ty for all damages, direct or indirect, of whatever nature and by whomever suffered, arising out of
the project described in this permit and has agreed to indemnify and save harmless the State from
suits, actions, damages and costs of every name and description resulting from this project.
7. This oermit does not convey to the permittee any right to trespass upon the lands or interfere with
the riparian nc~ hts of others in order to perform the permitted work nor does it authorize the impair-
ment of any rights, title, or interest in real or personal property held or vested in a person not a party
to the permit.
8. The permittee is responsible for obtaining any other permits, approvals, lands, easements and rights-
of-way that may be required for this project.

Any material dredged in the prosecution of the work herein ~ermKted
shall be removed evenly, without leaving large refuse piles, ridges across
the bed of a waterway or floodplain or deep holes that may have a
tendency to cause damage to navigable channels or to the banks of
a wateDA/a¥,
There shall be no unreasonable interference with navigation by the work
herein authorized.
If upon the expirauon or revocation of this permit, the project hereby
authorized has not been completed, the applicant shall, without exoense
to the State and to such extent and in such time and manner as the
Department of Environmental Conservation may require, remove all or
any portion of the uncompleted structure or fill and restore the site
to its former condition. No d~im shall be made against the State of
New York on account of any such removal or alteration.
If granted under Article 36. this oermit does not signify in any way
that the project will be free from flooding
If granted under 6 NYCRR Part 608. the NYS Department of Enviro~-
mental Conservation hereby certifies that the subject proie, ct will not

SPECIAL CONDITIONS
The permittee shall require that any contractor, project engineer, or other person
responsible for the overall supervision of this pro3ect reads, understands, and com-
plies with this permit and all its general, special, and supplementary special
conditions.
The permittee, or authorized representative, shall complete and return the top portii
of the enclosed form notifying the Bureau of Environmental Protection of project
co~uencement. Upon completion of the permitted proDect, complete and return the
bottom portion of the form, along with photos, notifying the Bureau of Environmental
Protection of pro3ect completion.
Markers used by this Department to delineate/define the boundary of the wetland or
the extent of the permitted structures shall be left in place and shall r~main un-
disturbed for 1 year following completion of the permitted pro3ect.
4. ~y work, disturbance, and/or storage of construction equipment and materials shall
% /be confined to within the "contract limit line" shown on the approved plan and/or to
~/ upland (non-wetland) areas more than 100 feet landward of the wetland boundary.
A snow fence or other temporary, project-limiting fence shall be erected prior to the
comuencement of any construction activities. "contract limit line", northeast of the
new maintenance building in order to prevent the inadvertent intrusion of equipment
into the protected area. The fence shall be maintained until project completion.
6. Prior to commencement of any constr~ction activities, a continuous row of straw bale~
shall be staked end to end along the base of the snow fence (or other temporary,

SPECIAL CONDITIONS
For Article 24 ( Freshwater Wetlands
The bales shall be maintained in place until all disturbed areas are permanently
vegetated. Trapped sediments shall be removed to an approx~ upland site before the
bales themselves are removed. Silt screen fencing is also acceptable.
Any debris , excess construction materials, or excess excavated materials shall be
i~mediately and completely disposed of on an approved uplav~ site more than 100feet
landward of any regulated wetland or waterbody. The materials in question shall be
suitably stabilized so that they cannot re-enter any regulate~, water body, wetland,
or wetland adjacent area.
All fill shall consist of soil, sand and/or gravel that is free Of %he following sub~
stances: asphalt, slag, flyash, broken concrete, d~nolition debris, garbage, house-
hold refuse, tires, woody materials including tree debris, metal objects. Zntr~o-
duction of materials toxic to aquatic life is ex%vressly prohibited.

new maintenance building t
10. All areas of soil disturbance resulting frc~ this project shall be seeded with an
appropriate perennial grass and mulched with straw immediately upon completion of th~
project, within two days of final grading, or by the expiration of the permit, which-
ever is first. Mulch shall be maintained until a suitable vegetative cover is
established. If seeding is i~practicable due to the time of year, a temporary mulch
shall be applied and final seeding shall be performed as soon as weather conditions
favor germination and growth.
11. Irrigation well pumpaqe is limited to less than 45 gallons per minute. Pumpage of
45 gpm or more will require a NYSDEC Long Island Wells permit.

SUPPLEMENTARY SPECIAL CONDITIONS
The following conditions apply to all permits:
A. If any of the permit conditions are unclear,the permitt~e shall con-
tact the Division of Regulatory Affairs at the address [nd telephone
noted below.
B. A copy of this permit with supplementary conditions andlappr?ved
plans shall be available at the project site whenever ahthorlzed
work is in progress.
C. The permit sign enclosed with the permit or a copy of l~tter of
approval shall,be protected fro~ the w~ather and posted~in a ~on-
spicuous location at the work sfte until completion of ~uthorlzed work.
D. At least 48 hours prior to commencement of the project,~the permittee
shall complete and return the t6p portion of the enclosed receipt form
certifying that he is fully awar:e of and understands all provisions and
conditions of this permit. Within one week of completi6n of the
permitted work, the bottom portion of that form shall also be com-
pleted and returned.
E. For projects involving activities to be accomplished over a period of
more than one year, the permittee shall notify the RegiOnal Permit
Administrator zn writing at least 48 hours prior to the commencement
of resumption of work each year.
F. If project design modifications take place after permif{issuance, the
per~itte~ shall submit the appropriate plan changes.for~approval by
thp Regional Permit Administratdr prior to undertaking ~ny such modi-
fications. The perm~ttee is advised that substantial m~dification
may require submission of a new:application for permit.I
G. Ail necessary precautions shall be taken to preclude cohtamination of
any wetlands or waterway by suspended solids, sediment,~fuels,
solvents, lubricants, epoxy coatings, paints, concrete,~leachate or
any other environmentally deleterious materials associated with the
project work.
H. Any failure to comply precisely with all of the terms a~d conditions
of this permit, unless authorized in writing, shall be ~reated as a
violation of the Environmental Conservation Law.
I. The permittee is advised to obtJin any permits or approvals that may
be r~uired from the U.S. Department of Army Corps of E~gineers, NY
District, 26 Federal Plaza, NewlYork, NY 10278, (Attention: Regulatory
Functions Branch), prior to commencement of work author%zed herein.
J. The granting of this permit does' not relieve the permit~ee of the
responsibility of obtaining a grant, easement, or o~her~necessary
approval from the Division of Land Utilization, Office ~f General
Services, Tower Building, Empire State Plaza, Albany, N~ 12242, which
may be required for any encroachment upon State-owned l~nds underwater.
