PROPERTY FACTS/ DESCRIPTION: The subject lot is 9,470 sq. ft. in size and is
located along the southerly side of Minnehaha Boulevard, Southold. The lot is improved
with a single-family, one-story frame dwelling built about 1971.
BASIS OF APPLICATION: Building Inspector's September 18, 1998 Notice of
Disapproval, citing Article IIIA, Section 100-30A.3, for the reason that the proposed
additions and accessory shed will exceed the allowable lot coverage of 20%. The
proposed lot coverage of approximately 2895 sq. ft. (instead of the maximum 1894 sq. ft.)
would be approximately 30.6% lot coverage. Also, the addition will reduce the required
total side yard setback from the required 25 feet to 20.9 feet.
RELIEF REQUESTED: Applicant's original request was for variances to allow: (1)
construction of additions totaling 1,001 sq. ft., bring lot coverage from 20% to 30.6%, and
(2) a setback of 11 feet in the easterly side yard, reducing the total side yard setbacks
from the required 25 feet to 20.9 feet; and (3) a setback of 11 feet in the easterly side
yard instead of the required 15 feet. In a letter dated January 4, 1999 applicants reduced
the size of the proposed deck, bring the total additions to 479 sq. ft. and lot coverage to
25%; no change was made in the proposed side yard setbacks. Applicants stated at the
hearing on January 21, 1999 that they would accept alternative relief.
The current lot coverage and proposed additions, as revised by applicants, are as follows:

REASONS FOR BOARD ACTION, DESCRIBED BELOW: On the basis of testimony
presented and personal inspection, the Board makes the following findings:
1) Applicants' lot is less than one-quarter acre in size. Because the
neighborhood is comprised of small lots, excessive lot coverage is particularly detrimental
to neighborhood character because it creates a crowded appearance and reduction of
privacy. Even as revised to 25%, applicants' proposed lot coverage is excessive for the
neighborhood.
2) The existing setback on the westerly side of applicants' house if only 9.9
feet; the existing easterly setback is 15.8 feet at its closest point to the property line.
Applicants' proposal for an easterly setback of only 11 feet, at the closest point of the
enclosed porch to the property line, would require a substantial variance.
3) The current lot coverage is exactly 20%. Consequently, applicants need a
variance to make any additions at all. The Board has considered alternatives to the relief
originally sought, including the alternative presented by applicants, and has determined to
deny the application as originally submitted and as revised, and to grant alternative relief
as set forth below.
4) There are no factors present to suggest that grant of the relief set forth
below will have an adverse effect or impact on the physical or environmental conditions.
5) The grant of the relief set forth below is the minimum necessary and adequate to
enable applicants to make desired improvements in their property while preserving and
protecting the character of the neighborhood, and the health, safety, and welfare of the
community.
RESOLUTION/ACTION: On motion by Member Dinizio, seconded by Chairman
Goehringer, it was
RESOLVED, to DENY the relief original requested and revised by applicants, and BE IT
FURTHER
RESOLVED, to GRANT ALTERNATIVE RELIEF authorizing variances with the following
limitations:
1) Proposed enclosed porch shall be 13.5 feet from the easterly property line at

its closest point (size 28.4 ft. x 12 ft. for a porch).
2) Proposed front stoop addition of 40 sq. ft.
3) Proposed rear deck, open to the sky, of up to 144 sq. ft. as provided by
applicants' letter dated January 4, 1999, WITH THE CONDITION that the deck shall
remain open to the sky and be no closer than 15 feet to the easterly property line at its
closest point.
4) A storage shed of no more than 72 sq. ft. in a required rear yard location as per Code
setbacks.
5) The above authorizations will bring the total lot coverage to 24.2% (or
2,289 sq. ft.).
6) The front porch addition or size of the shed may be modified only to the
extent that it complies with the 24.2% lot coverage limitation, and will not exceed the
same.

NOTICE IS HEREBY GIVEN,', pursuant to Section 267 of the Town Law and the Code of
the Town of Southold, the following application will be held for public hearing by the
SOUTHOLD TOWN BOARD OF APPEALS, at the Southold Town Hall, 53095 Main Road,
Southold, New York 11971, on THURSDAY, JANUARY 21, 1999 at the time noted below (or as
soon thereafter as possible):
8:05 p.m. Appl. No. 4633 — WILLIAM AND ROSE MAURY. This is a
request fora Variance under Article IIIA, Section 100-30A.3 and Article XXIV,
Section 100-244B, based upon the Building Inspector's September 18, 1998
Notice of Disapproval for a Building Permit to construct additions and accessory
shed, with a total building area at 20% over the code limitation. An alternative
plan for a smaller deck was submitted by applicants as a follow-up to the
December 10, 1998 hearing and discussions. Location of Property: 3145
Minnehaha Boulevard, Southold, NY; Parcel 1000-87-3-35.
The Board of Appeals will at said time and place hear any and all persons or
representatives desiring to be heard regarding this application or desiring to submit written
statements before the end the hearing. The hearing will not start earlier than designated.

We are in receipt of your letter dated February 4, 1999 containing the details of your decision
for alternative relief adopted at the Board's January 27, 1999 meeting. We would like to take
this opportunity to thank you and the other board members for your time and consideration on
our behalf.
As you are well aware that we are "nevi' to this process, we, consequently, have three
questions pertaining to the interpretation of the documented decision:
Point #1 - "proposed enclosed porch shall be 13.5 feet from the easterly property line at its
closest point (size 28.4 ft x 12 ft for a porch)" Since we must obtain significant alterations
made to our building plans to accommodate a change in roof pitch and dimension, are we
at liberty to reduce the dimension of the room from 28.4' x 12' to approximately 18' x
14.5', (a dimension resulting from a conversation with Peconic Surveyors), which
would reduce lot coverage by an additional 80 square feet, while simultaneously at
NO POINT going beyond the established 13.5 feet from the easterly property line ? It
has been suggested that from a design and architectural perspective, we might benefit
from a smaller, more square space than a long narrow space, and in doing so might even
be able to retain the existing roofline of the main house, thereby making less costly
alterations, and affecting the roof pitch of the garage instead of the primary house.
Point #3 - "proposed rear deck, open to the sky, of up to 144 square feet" (12' x 12'). If we
make the proposed porch smaller as outlined above, can we alter the location and
square footage of the ground level deck while at no point coming closer than 13.5
feet to the easterly property line at any closest point? In conjunction with the
contemplated smaller porch discussed above, we are wondering if we may to consider a
ground level deck in place of the remaining length of enclosed porch, that we would not be
building if we can adopt the first point above. The document you mailed to us specifies the
deck being in the rear, as was submitted in our prior correspondence; this deck would be
in place of the rear -most portion of the porch that we would be eliminating, (a dimension of
approximately 10.4' x 12') and would reduce the total deck area from 144 sq. ft to 125 sq.
ft, a reduction of 19 square feet, and would totally be open to the sky.
Point #6 - `the front porch addition or size of the shed may be modified only to the extent
that it complies with the 24.2% lot coverage limitation, and will not exceed the same" If we
design a smaller porch and smaller deck as outlined above, could we incorporate the
above proposed savings of approximately 99 sq. ft into a revised shed or front porch

document?

On December 10, 1998, we had the opportunity to stand before your board in request of a
variance for a side yard setback and a total lot coverage in excess of 20%. In addition, we
discussed a concern of privacy by a neighbor, Mr. & Mrs. Tisbo.
During the public hearing; we were made aware of your concerns that 30% lot coverage would
be excessive. As you suggested, we have developed an alternative, described below, that we
feel addresses this issue. In addition, and in accordance with your personal recommendation,
on Saturday, December 12, 1998, I. phoned and spoke to Mrs. Tisbo to address her concerns.
I was able to better explain the design and use sof the proposed enclosure and offered our
opinion thatthis would actually.provide increased privacy for each of us as compared to the
current open patio furniture and BBQ set-up. To demonstrate. our desire notta upset_the
Tisbo's and to be neighborly, we also made an offer to provide 4-6 foot green plantings from
the rear of our garage, down the entire length of the property line between us, at our exclusive
expense, entirely on our side of the property line, in order to create a natural privacy border.
We ended our conversation that she would discuss this with her family. As of this date, we
have not heard back from there, Our offer, of course, still stands.
With respect to our alternative to more closely -comply with the guidelines for total lot coverage,
we would like to offer the following revision:
• Reduce the proposed deck size from 18'x37' to 12'x12', thereby reducing the deck size
by 522 square feet, and reducing our variance request from 30.6% to 25%.
We hope that this change meets your approval. We truly believe that our proposed
modifications will enhance our property and surroundings, while allowing us to better utilize our
home and investment, without any detriment to the character of the existing community and
without any hardship to our neighbors.
We respectfully request that you consider our revised proposal and approve our request for
variance. Kindly advise us if we can be included in the January 1999 schedule so that We may
Bring closure to this matter and move forward.

This is our second objection to a variance for an addition to our neighbor's, the Maury's, home.
We are unable to attend the public hearing to be held on Thursday, January 21, 1999; however,
we ask that you accept this letter as our response and enter this letter into the official record. On
file is our first letter dated December 5, 1998. At that time, we also notified the Maury's in
writing of our decision. Bill Maury contacted us on December 12, 1998 to discuss the matter at
which time we reiterated to him our objections.
We are in receipt of Mr. Maury's proposed plans at a second attempt to get authorization to build
an addition to his home. Again, we strongly object to anything that is above and beyond the
Southold Town Building Codes. In essence, we strongly feel that the market value of our house
will be irreversibly affected. The codes were put into place for good reasons -- to secure the
value of the community, the homeowner's investment, and to protect the aesthetics of the area.
We believe that in this case, granting a variance would be detrimental in every regard.

The proposed unheated enclosed sun porch room is consistent in nature and
appearance with the many others in the Laughing Waters Community, particularly those
along Minnehaha Boulevard. Many properties, particularly those on our side of the road,
have sun porches or dens in the front or side of their homes with large windows to enhance
their view of Corey Creek. Although our sun room will be on the side and rear of the
house, there will be a view of Corey Creek from the side windows.
The proposed shed is consistent in nature and appearance with numerous others in
the community, and practically identical to those on the neighboring properties.
The proposed deck is to be at ground level, or only inches above it where the yard
naturally slopes, and is well away from the side and rear yards. It is consistent with several
others in the community. Both side neighbors have decks as well.
None of our neighbors or surrounding "views" will be blocked or impeded by the sun
porch, deck or shed. The sun room merely squares off the existing footprint of the existing
house and garage. The deck will be invisible from the street. The shed will be painted to
match house and roofing material will match the house.
The extension of the front stoop/concrete porch will be practically invisible to anyone
since it only extends out to meet the existing roof overhang.,, about 2 % feet.
2. The benefit sought by the applicant CANNOT be achieved by some method, feasible
for the applicant to pursue, other than an area variance BECAUSE:
There is no other area of the property or house that is appropriate for a sun room, and
there is no other way to extend living space, without adding on to the footprint of the
existing house, unless we considered a second story and reconfigured the first floor rooms.
However, this would be inconsistent with the surrounding homes, which are all ranches,
and it would also be prohibitively expensive.
We have explored various possibilities for grade -level patios (including concrete or
blocks), but the space behind the house is directly above our septic tank. Unless some
reasonable means of access is maintained, any type of maintenance work required on the
tank would require the patio to be broken up or the blocks to be removed, thereby
destroying the grading and investment. A ground level deck is the most practical solution .
to provide .an outdoor patio area while providing access to the septic system by removal of
some replaceable boards without destruction of the entire capital improvement.
A shed is preferred away from the house to store a lawn mower and other tools and
supplies. This home is one of the few in Laughing Waters with no basement and no crawl
space,. so storage is limited. Our appliances,. heat & pumps already use up garage space.
The front concrete porch is very narrow such that when we sit out to enjoy the view of
the creek, our fleet and knees often hit the existing wrought iron railing. by making h a little
deeoer. we can out a bench, alidina rocker. rockina chair, etc. This tvae of seat will not fit
without the additional depth.
3. The amount of relief requested is not substantial BECAUSE:
There will be no change in character of the house. There vVill merely be an
improvement of the IMno soave and recreational usefulness of the orooerty.
4. The variance will NOT have an adverse effect or impact on the uhvsicat or
environmental conditions in the neighborhood or district BECAUSE:
No heating or plumbing will be installed in new structures. There will be no regrading
of land.

Please find enclosed a copy of the Legal Notice describing your application. The Notice will
be published in the next issue of the L.I. Traveler Newspaper, the Town's official newspaper
for 1998.
Pursuant to Chapter 58 of the Southold Town Code (copy enclosed), formal notice of your
application and hearing must be mailed and shall include a map or sketch showing the
location of this project with the setbacks and use noted. Send this Notice, as soon as
possible, with the map to all owners of land (vacant or improved) surrounding yours,
including land across any street or right-of-way that borders your property. Use the current
addresses shown on the assessment rolls maintained by the Town Assessors' Office (765-
1937) or the County Real Property Office. If you know of another address for a neighbor,
you may want to send the notice to that address as well.
Please submit your Affidavit of Mailing to us by the Friday before the hearing date, with the
post office receipts postmarked. Later, when the green signature cards are returned to you
by the Post Office, please mail or deliver them to us. If any signature card is not returned,
please advise the Board at the hearing.
You must post the enclosed sign no later than 12/3/98. Post the sign facing the street, no
more than 10 feet from your front property line bordering the street. (If you border more
than one street or roadway, a sign is enclosed for the front yard facing each one.) The
sign(s) must remain in place for at least seven (7) days, and if possible, should remain
posted through the day of the hearing. If you need a replacement sign, please contact us.
After the signs have been in place for seven (7) days, please submit your .Affidavit of

NOTICE IS HEREBY GIVEN, pursuant to Section 267 of the Town Law and the Code of
the Town of Southold, the following application will be held for public hearing by the
SOUTHOLD TOWN BOARD OF APPEALS, at the Southold Town Hall, 53095 Main Road,
Southold, New York 11971, on THURSDAY, DECEMBER 10, 1998 at the time noted below (or
as soon thereafter as possible):
7:30 p.m. Appl. No. 4633 — WILLIAM AND ROSE MAURY. This is a request
for a Variance under Article IIIA, Section 100-30A.3 and Article XXIV, Section 100-
244B, based upon the Building Inspector's September 18, 1998 Notice of Disapproval
for a Building Permit, for permission to construct additions and accessory shed, all of
which will exceed the allowable lot coverage of 20%, and addition which will reduce
the required total side yard setbacks from 25 feet to approximately 20.9 feet.
Location of Property: 3145 Minnehaha Boulevard, Southold, NY; Parcel ID #1000-
87-3
The Board of Appeals will at said time and place hear any and all persons or
representatives desiring to be heard regarding this application or desiring to submit written
